A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed - US Mail ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

This foreign named Benjamin Hall called stating that I owe money from a online pay day and I have 21 days to pay or they will sue me for $7,000 to $8,000 minimum. They did have all my info like last 4 ssn, dob, and very old address. I asked for proof of my internet application and they couldn't provide. The email they sent me was very broken English and a ton of mistypes. Very much a scan!!!

I have been receiving calls from this number, Jonathan Marcado. CashNet does not service my state. When I told him this, he quickly gave me another name which is not a real company. I made Mr. Marcado aware that I would take legal action if he continued to harass me. I also took the time to file a complaint with the FTC.

I received an email stating this is my last attempt and that I will be sued. It was for EZ Cash. He told me I would have to pay by moneygram which I found very hard to believe because it was a true debt collector then they would process using card or checking account. His name is Benjamin Hall and suppose to be an senior attorney or something.

    fell for this once
about 2 years ago, good old Jeff Anderson scared me into believing I owed money for some payday loan I couldn't finish paying off ( laid off then never heard back for over a year ). so yes I freaked out when I got the first email. but he speaks very broken English, can't spell if you pay attention to the emails. they can't provide proof, and worse - you have to submit payments on a green dot card. they aren't real, just a scam company scaring people into paying money. I laugh at their emails if I get them anymore, miss spellings and all.
