    A man named Paul Lynch called  saying I owed paydayone money. And then I had to be in court on Friday. They had my social security number address. A bank account number that I have. But when I took the payday one loan out it was with a different checking account. Like a dummy I gave them my credit card info. Then call the bank. It was a scam so I had to cancel my card. Don't fall for it!

    It sounds as if you put yourself her, and have an issue dealing with collections.

    Simple solution, pay your debts, and you don't have to waste your time trying to slander a company trying to do there job.

    Maybe you should give sense to those that call and are RUDE!! If a debt is owed it will be paid but, being unruly will not help the situation.

    Funny story... Paul Lynch called me too. I was told I had until 7-31-15 or a warrant would be issued, time sensitive matter, etc. He claimed it to be about a PD Loan with First Bank of Delaware. I asked for verification of the debt, how much it was, possible payment arrangements, and asked for a letter stating the information he provided. I was emailed "contract" with my name but "PayDayOne" as the creditor. This doc was a simple Word.doc that was still editable by me if desired, not even on letterhead... I called and asked wth that was because that's not what I was told - Bunch of BS. The original creditor they are claiming doesn't show on any of my credit reports, there's no website for Evergreen Acquisitions, no business license to collect in my state, etc. I contacted First Bank of Delaware, because by all means, if I owe them money, I owe them money. They have no record of me or my SSN, they have no knowledge of this third party collecting debt on their behalf either.
    I've filed complaints with FTC and my State Attorney General's office, as of 7-31-2015. I would suggest you follow up in the same.

    The address listed on the web site is (gasp) a UPS store, who woulda ever thought that?
    I did however find a listing for a company by that name that is 2 months old in Western New York, which would be the right location for a criminal debt collector, and they are working out of a building that has 2 store fronts for the first floor and what would probably be apartments in the 2 upper floors.  In other words, kitchen table Buffalo Bullies.

    Don't fall for it . . .  don't even give them the time of day. They are a scam and are relentless leaving messages trying to get people to call them back. Read these other comments and hopefully you will be saved from falling for it. I hope they call again when I can answer as I will give them an earful!!

    Keep getting calls from them.  I called back and told them to leave me alone as I have no debts to anyone anywhere.  Paul Lynch starts asking me if I know Morris Mullins.  No, I don't, but that's none of his business.  Really, nothing about me at all is his business.

    Though I;ve told him to stop calling, I get another call the next day.  I again call to tell him to quit calling me.  Again, he's looking for Morris Mullins.  Again I tell him that's not me, and there's no one here by that name.  He says the phone is registered to Morris Mullins.  I tell him it is not.  I have had the number for two years, I am not Morris Mullins.  He should remove my number from the record.  He says he has to verify it first.  I again tell him that he needs to remove it immediately, that I am not giving him any of my personal information.

    This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.  Now why would a “process server” want to do you, a stranger, a favor, and at the same time not get paid to deliver the papers?

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    *Keep all messages
    *Take a picture of your Caller ID
    *Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
    *Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
    *Check your SOL for your state as well.
    *Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

    BigA and Tamianth, you both seem quite knowledgeable, so I will ask this question in hopes that you might know the answer.  Upon whom does the burden of proof lie?

    Long story short, because of my line of business, I move more often than the average bear. Every time I move means a new landline number (my preference to have a landline). Phone numbers turn over quickly these days, and every time I get a new landline, it seems there is some recent owner of the number who skipped out on a debt somewhere along the line. Which means I have above average experience with informing collections agencies that they are calling the wrong person. I always refuse to give any personal information over the phone (to anyone, not just debt collectors). Every other agency I've dealt with might not like it, but they take my number off the list immediately when I tell them to.

    Let's pretend for a minute that this is a legitimate agency (seems unlikely, but just for the sake of the question, we'll give the benefit of the doubt). Let's assume that there is a real Morris somewhere who owes someone something. If Evergreen is playing by the letter of the law, maybe they've even sent Morris the paperwork. I wouldn't know because while he once had my number, he didn't have my address.

    So the agency is calling me, because that's the last phone number they know for the guy.

    Is the burden of proof on them to prove that I am in fact Morris to earn the right to keep calling me?  Or is the burden of proof on me to prove that I am not Morris?  If I tell them to stop calling me, and they are legit, do they have to actually stop calling?
