- This Just In...Consumer Alert: Attorney General warns Kansans of debt collection scam
January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers. Consumers are warned to not submit payments to these fraudulent debt collectors.
When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid. Consumers state they have never obtained such a loan or paid off the loan years ago. The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names. It appears the phone numbers used by the scammers are “spoofed” numbers, so that the number appearing on a consumer’s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.
When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent. These scammers have been able to provide consumers with identifying information, such as the consumer’s social security number, home address, e-mail address, names of family members and the consumer’s computer IP address. Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.
If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court. Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union. The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as “We’re filing an affidavit against you” or by stating a lawsuit has been or is in the process of being filed against the consumer.
A hallmark of each scam has been calling consumers repeatedly at their place of employment. This scam hit home when an employee of the Kansas Attorney General’s Office was repeatedly called both on her cell phone and at work. Despite the employee’s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an “officer”.
“I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ‘If that’s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming’,” stated the employee.
“It is important for consumers to know their rights under the law,” Attorney General Six said. “If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.”
Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact. The notification should contain information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

the next time they call you, tell them that you will contact the attorney general office and file a complaint for harassment!! by law, a dept collector can only call you at work once a day. at home or a cell phone "not before 8AM and not after 8PM.
so i patiently waited for another phone call, and did that, and i haven't received another phone call "from that number". you have to do that every-single-time to each and every number for it to work (unfortunately). - This is a scam!Every time you receive a call, call them back 5 times and yell at them. They are a scam and robbing people. They try all sorts of threatening tactics. When they call tell them you are recording the call and and ask them for information, company name, address, etc. They will hang up. Then call them back at this same number and ask them the same questions again. It's frustrating, but let the federal authorities handle them. They have been reported numerous times to the FBI, Attorney General and Secret Service. They will be found and prosecuted. IN the meantime, stupid is as stupid does... holler right back at them. They'll get what's coming to them.

- Scam spread to NJPlease beware!! This must be a nation wide scam, I live in NJ. This same person has called my mothers home and mine many times, stating he was a officer from a Department of loan investigation office, threatening me, claiming there is a lawsuit against me for not paying back a internet payday loan which I did not recieve. These people has to be stopped. Now the last time he called, which was today, He is calling from unavailable phone number. They will not give any necessary information to you about their company and will not send you legal documentation. Also, my husband just called the 214-461-0552 number back and finally got someone two seperate times and each time the same person answered giving a different name. If you keep calling them asking them questions,they dont like it and will hang up on you. They are now trying to say they are with the FDCPA but only problem is they are not saying it right. They are saying FDBCA. PLease Please beware.

- mr jacksonI called the FBI in Dallas and the only thing you can really do is change your phone number but I would still call Dallas FBI and complain. The addresses they gave me was 3002 W Kennedy Blvd Suite 208 Tampa Florida 33607 and 51 Hillcrest Rd Dallas Texas 75038. Remember keep calling.

I couldnt get him to stop, finally I kept call him back and asking questions like Mr. Jackson did and he kept giving different names one I believe of officer Jackson. I kept asking questions who they worked for, company name ect. They finally hung up on me so I kept calling back to the point they wouldnt answer the phone.

- Tina replies to hector| 1 replyyes they are scammers!! i called my attorney and contacted the police department and found out that different companies will sell their "write-off accounts" to fake collection agencies and those fake collection agencies will have all of your information on file i.e.: social security, date of birth, basically everything about you that will make it seem legit. then in return, you would feel comfortable enough to provide a bank account number or a credit card number to clear up any bad debt in which you have. but in reality, they would take whatever money you have in the bank or max out your credit cards. my attorney told me, that the fraud department told him that "214-461-0552" is on the list of a fake collection agency. the fraud department said you can always contact the company/business that you actually owe money to and pay them directly....no never have to go through a collection or a recovery agency.
so yes, this is a scam. - ChristinaThis guy kept calling me at my job and sexually harassing everyone here! he was saying obscene things like "[***]" and "how big are your nipples". he told the receptionist this and everyone who answered the phone. The manager finally called the police department to come down to the office and request a tracer to be put on the phone lines. The police arrived and they contacted our telephone company and had a faxed copy of all the calls that were received within the last hour. on that list was 214-461-0552 (which was listed 43 times in less that 1 hour). The police took the documentation to the police department and sexual harassment and regular harassment charges were filed against the entire company. Ultimately, it turns out that this company wasn't even a collection agency. This company is a company that purchased the debtors social security numbers etc from an actual collection agency. So when a person asks questions regarding their debt, it'll all be on file, right at their finger tips!!

- RobThis is truly a scam, this people as someone says buys information from someone you may or maynot have had business with whereas they can sell your information. I contacted the Attorney General's Office and the FTC (Federal Trade Commission) they are aware of this scam. It's just hard to track them because they move constantly all over the country. Please don't give out any more information than they already have. I do agree with you should harrass them like they do you everytime they call ask them questions about who, what, where and how, regarding a debt you suppose to have owed. Do this all the time they call. I even told them once to hold on while I go get my attorney, and of course they hang up. Hector, you must really be nieve or something because if you gave them you banking information that was not a smart thing to do. They will constantly debit funds out your account or you credit card. Either that or you work for them. I don't know brother. You seem to be the only one to. That's messed up. Anyhow don't give into these fools, continue to report them and harrass them too. I've learned my lesson, I got fooled once, but never twice, these fools will take all you got. Trust me.

A Mark Smith called me (with an indian accent). Gave me the lawyers information, a Mr. David Grey. I asked to speak Mr Grey, but Mark Smith said he couldn't transfer me.
I traced the phone to a company called ALLCATEL, in NYC. Turns out, ALLCATEL is like an outsourced phone system. I e-mailed ALLCATEL and notified them of this, and that if this continues, ALLCATEL could be legally responsible.... - JIMMY replies to hector| 1 replyTruly someone who works for them

stop and like you, he's calling my family and threating them and me and calling my work also. He
needs to be stopped. Hopefully they catch these people in time, its a big scam......whatever you
do don't give out any information about yourself or a credit card or atm card number. They try to be
so slick.
