They claim that there is a lawsuit against you but will not let you get a word in they will scream and threaten you that you will be sorry. I went right back at them.- Caller: BenjaminLaw
- L'Burg ResidentI began receiving harrasing calls from this number. I contacted a debt collection attorney who advised that this more than likely a scam. DO NOT feel threatened or give or confirm any information they may have even if it is correct.

Also they wanted payments from me and they were just complete jerks. I'm calling scam/fraud. I talked to the police, they say it's not real. I hope no one falls for it.

- Mike in MD replies to Jewels| 1 replyDebt is a civil matter not criminal unless intent to defraud can be proven. Demand they provide in writing by US Mail a debt validation notice. If they refuse, say "I take that as a refusal to pay" or continue with threats of arrest and bullying, you can be certain they are engaging in illegal actions. Go to the FTC website for information on the federal laws that govern debt collection practices:
http://www.consumer.ftc.gov/articles/0149-debt-collection
You can report illegal practices on the website.
As always, if in doubt about how to proceed, consult with an attorney. - Jewels replies to Mike in MDThanks for the info Mike!

- Jo in TX| 1 replyI started receiving these calls 2/19/13, at work! I have asked for a fax number to fax a Cease and Desist letter and they will not give me one. They are very threatening and harass you. I advised not to call me at work and they continue. This is ridiculous! Very rude, I was nice at first, then I had to get "persistent" so they hung up on me and called right back at work again, several times today. I am reporting to BBB but how can I get them to stop calling my work now? I just called them back from my cell phone, they read me my "rights", could not tell me who the lender was, which I do not owe any, but wanted me to send them $756.00 today or I will be arrested and that they will call my employer and speak to my boss and get me fired and for me to be prepared to be arrested. I advised that I am the Supervisor at my employer and his response was in my "f***ing" dreams and hung up.

- JUDGE JAN GROOM| 1 replyI called the number as requested by a citizen of our city. He had been informed by the caller that a warrant was issued by the City of Mabank and he was to be arrested unless he wired $200 to the James Morgan company. He has been harassed at his job in Dallas as well. I was cursed and told that the former defendant would continue to be harassed. That I had no authority. Our city secretary informed the police chief and the citizen that this is a scam.

- Husband and WifeWe just switched our phone company and have had our cell phones for not even 30 days yet. My husband continues to get harassing call from this number saying that I- his wife- owe them money and that they are calling on behalf of some sort of Law firm. This was shut down by my husband saying if his wife owed money he would know. They then start calling him swear names. They have since called using a foreign man, foreign female and then today when my husband threatened to turn them into the State Attorney, they called back FROM THE SAME #....and an American male started asking my husband how I liked him in bed last night!! Now he just hits the IGNORE key on the phone. Eight more calls since 9am.

- Rebecca OronozThis number has called my cell starting at 5:30am pacific time. I get to work and there is a message on the company voice mail in regards to me. My boss returned the call, telling this person to not call at work that I am not allowed to take personal calls at work. He then proceded to call back 15 times! My boss answered and said we can do this all day if you want! He called 10 more times and then stopped. OMG!!! I was so freaked out, even though I knew it was a scam he got to me.

- don replies to EsperanzaIt is interesting to note that American Cash Advance is not actually a lender. When a person sends in a application, they sell it to potential lenders. (Usually sleezy ones) Your name is also sold on a list by American Cash Advance. Go to their website and read all of the privacy notices and fine print.
Anyone who does business with them is going to regret it later. - jason replies to Jo in TXJo, You cannot fax a cease and desist letter. I wish everyone would understand that a Fax is not considered a legal document if a need arises. Nor is an Email. You should demand written validation of the debt from them via usps. Not a Fax, not an Email. Written validation via usps. They have 5 days to legally comply. (They can no longer communicate with you until this is provided) Advise them that you will no longer speak with them until you have received this validation of the alleged debt with all information concerning the Original owner of the debt as well as a copy of any contract that may exist with the original owner. Tell them that you want all information validated concerning this account including payments made or any other activity and the date of the last and final payment or activity on this alleged account. (This establishes Statute of Limitations on the alleged debt) Then stop all contact with them, have a meeting with your manager or HR people and advise them of what is happening. Provide them with a letter stating the same. (That's in case you should be penalized or terminated because of this) If this Scammer, and that is exactly what unethical collectors who do not follow the FDCPA are) will not provide you with written validation of the debt or for any reason claims that you are not entitled to it...that means that they don't have any validation. You cannot be arrested over a civil dispute or locked up. This is indeed unethical collection practices of an alleged false debt, or a scammer at work (Both the same). Not a thing can be done by him. Just scare and harassment tactics.
