Called me this morning and wouldn't identify who they were. They kept asking for my birthday and social to "verify" myself before they could release any confidential information. I refused to because debt collectors are required *BY LAW* to say they are debt collectors.

Don't give out personal information, people.

Your callers do not maintain this site or this web page. Your callers cannot magically determine which numbers should not be called based on anonymous comments. You cannot expect compliance with your orders until, if possible, you deliver them *directly* to your caller.

Mistrust of any ''wrong number'' claim is standard procedure at all the rogue collection agencies. They assume you are a liar until you give an answer which gets one paid. An ill-considered provision of the FDCPA is abused to permit this. To halt the misfired skip trace calls, laying a paper trail is far more effective than verbal denials. My advice for "not me" cases is found here:

Your dilemma is common, and your reading of the law is incomplete. The FTC makes two demands of third party collectors which are frequently in conflict. A collector must make ''meaningful disclosure'' of its identity yet respect the privacy of whoever is named on a debt account. Agencies invite lawsuits when their agents are found speaking to the wrong person. That's why the agent was trying to qualify you with identifiers. Until it's certain who's answered, the call is treated like a skip trace, and you *cannot* be told any purpose for the call other than the fact that a given person is sought.

You've no obligation to submit to questioning in any case. If you are the alleged debtor you can opt to wait for the required dunning letter and respond to that in writing as you should.

this collection company is actually a company of people. . . yeah some phone stuff, but their information / debt validation and work with consumers is commendable and should be the standard in "collections" aka junk debt. . . .best to call them back, VERIFY do NOT provide complete data, make them give it for your verification that its valid and work with them, they are legit.

you can also do as the law "suggest" and comply with VERIFICATION of information, you may have to explain it to the agent or supervisor . . . but their are required to verify that the person they are speaking to is the correct person or an approved representative of that individual. . . .do NOT give them full information. . . have them provide it for a yes/no response. . . .and this particular company practices some legit collection efforts with a real base in business and being human, they're not the big junk debt churning clowns who auto-dial everyone.

"Best to call them back"? What if I don't want to? What if I would rather get my G-letter before deciding that calls from a debt collector are so much more important than anything else happening in my life? That's my right, and I can "work with them" any way I choose, including by demanding validation on paper and restricting contact to what I deem convenient. Alleged debtors cannot fully preserve all their rights until they get on a paper trail. Anyway, from the recurring complaints here of sloppy skip tracing, there is a fair chance I'm not the hunted person in the first place.

My statement from seven months ago stands, regarding "no obligation to submit to questioning". The FDCPA does not suggest that consumers have to "comply" with anything a debt collector wants. The law governs how agencies treat alleged debtors, not the reverse. The entire industry's eggshell walk on the phone and during phone messages began after Paul Foti won his battle on privacy grounds with NCO several years ago.

Verifying my own identity is only the foot in the door. It does nothing to prove a debt valid or that you or your peers have any standing to collect it. "Being human", someone within your office walls is not prevented from exploiting the consumer somehow. I will judge for myself who is "legit" when I see the claim in paper and ink and review the collector's actions (or inaction) for legal compliance.

    Andrea Jones
Got a call, woman asked for my husband on my cell phone. I told her he wasn't at this number but I was his wife, what can I help you with. She said, "please have him call the number that called you". I said "and who is this", she said "have him ask for Andrea Jones". She never said who they were with and never asked for my name. I hung up, no debt collector has ever sounded so unprofessional and shy to give out any information.

I'm not telling you my name
Got a call from these guys and they left a message saying to call them back at 877-383-9784. I called back and they were very nice and said the name of the person they were looking for. I told them I had no clue who that was and they thanked me and said they'd remove my number. Easy enough. (And no, I didn't have to give them any personal info).

You should NEVER give your Social Security number to an unknown party over the phone. That's an easy was to get your identity stolen!

I had not supported disclosure of any privileged data, and still don't, to strangers on the phone.

The collection industry tends to lean on SSN as an expedient identifier, mainly to avoid getting sued for discussion of debt with the wrong person. Very likely the agency already has an alleged debtor's SSN from the day the account is placed, obtained from the debt portfolio or a credit report. So verifying or giving SSN probably won't reveal anything new. However, a tight lip remains safe policy given the sheer number of outright frauds at play who create bogus debts from thin air.
