- Gerald| 7 repliesGot email saying it was a lawyer and that I commited check fraud and theft by deception. I called to see who I commited it against and they said it was some American loan co that operates over 300 sites. I ask what site, but they couldn't tell me what specific one, but wanted me to settle out of court. On top of all that when I called the person said they were Adam Thomas, the lawyer in the case, but someone else got on and was talking and I ask where Adam Thomas was, I was just talking to him and this person said there is no Adam Thomas here, so I hung up. The email was from a adam.thomas.barnhardt@gmail.com I think, but I already deleted it and am not too sure of all of it, but the adam.thomas.***@gmail.com is right, not sure about the "barnhardt" part.

- Slim replies to Miguel RodriguezA phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.
The "warrant" is fake, and will not be issued.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]
Source:
https://www.consumer.ftc.gov/articles/0149-debt-collection
Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.
IF you wish to communicate with the supposed collector / creditor, visit the following page, for example "Action Letters" to snailmail:
http://www.consumerfinance.gov/blog/debtcollection/
If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

- Tisha replies to Lynda SmithI have also received this email and phone calls. I asked to have the copy of the loan sent to me, the same email address they have and I have yet to receive it. They went as far as to go to my job and try to serve paperwork. When I asked why my job and not my house she said it was illegal to come to someones house. I stated they serve child support warrants to homes, whats the difference? Now today I get this email with a copy of the arrest warrant with everything but my name. You would think if they was gonna send you an arrest warrant the copy and past would not be over the words so you couldn't read them.
It has a judges signature on it as Dave E. (not sure of the last name) but signature is spelled wrong. They spelled it (signeture) - karen replies to Russell Taunitas| 1 replyI received the same exact message today. I am tired of these scammers. Isn't the government doing anything about this stuff. If anyone has any ideas I am open for suggestions.
