If necessary, send them a Cease Communications letter via US Mail, Certified, Return Receipt keeping a notarized copy for your records. If you were scammed once, others will try the same thing. Unless they can prove you owe the debt and they have the legal right to collect in your state, you do not have to even talk to them.

Do you have a judgement against you? How did they start garnishment without a judgement? If there was paperwork faxed to your employer, then what is the name of the entity that sent it? I would suspect you would know if you are so upset about this - Mike-in-MD replies to ChrisSince they will not mail you the legally required documentation and you cannot find an address for them ignore their calls. See if you phone company can block their number or purchase an external Call Block device. They run about $60 on amazon.

Garnishments are not initiated by FAX.
As Vinny Gambini stated, garnishments are issued only by court order, AFTER a judgement.
That means you must have received a summons to appear, and would have received mailed copies of court documents. No FAXes.
If that is true, you should be able to give us the information at the top of the summons or court documents, since it is now "public information".
Give us the court name and location, the name of the judge, the plaintiff's attorney's name and Bar number, and the name of the company or person that is suing you, the date of the trial, and a docket number.
Can you do that, to prove your statement?
I betcha you can't. You didn't even give the physical and web address of the company that uses this phone number, so we could check their validity. It seems you cannot even remember the correct name of the company that supposedly called you!
Do not bother to return and argue these points, unless you can provide the data I requested. - Bacon| 4 repliesJohn (or Jon) Tomas from legal processing services left a voicemail on my phone saying "We have been retained to process legal paperwork under my name and social security number this is a very serious legal matter and that i can reach him at1 312-971-6237." Im not sure if its a scare tactic or that he can somehow sue me. I did acquire some debts in my younger years that have gone unpaid but I have not received any paperwork saying I was going to be sued. The only paper work i have ever received are the typical debt collection letters. My suspicion is that im now 27 and this debt is approaching 7 years and they would like to get it taken care of before that happens. Does anyone think I have cause to fear lawsuit?

Or is it a legitimate debt collector with misinformation? Also, wouldn't such a debt be reported on a credit report? I would think those receiving this call should request their credit report and see if anything is showing up there before returning a call like this.

The 7 year limit is for unpaid debts appearing on your credit report.
This does sound like scare tactics but that only means they have not yet filed, if they can file. Most old debt collectors prefer not to file since bad things can happen in court if the defendant contests the debt. The hardest part for buyers of old debt is proving a clean chain of custody giving them clear title to your debt and the right to collect.
Knowing you do have old debts, you will have to decide how to deal with the calls since what you reported so far has not reached the level of an FDCPA violation. - Mike-in-MD replies to CharleeIt may be, especially of you know you have no old debts. You can request a copy of your credit report from the three agencies to see if anything is present. However, old debts fall off the credit reports after 7 years so anything older then that would not show up even though the debt still exists. If you do decide to talk with them or call them back, demand written proof of any debt they claim you owe in the form of a Debt Validation Notice sent via US Mail, do not accept any other form of receiving the proof. You should also go to the FTC website and review the information for consumers there on dealing with debt.

- CWG40 replies to RONOnly a judge can order a garnishment. Only after some sort of hearing where you are given a chance to defend yourself. They may be trying to scare you. No employer worth his salt will garnish anyone's wages and turn them over to anyone in the absence of a court order.
