- Bobby A.I just received a text from an email address. The text, "Travel to the tropical islands, expenses paid! Call [404] 341-9051". This is illegal in multiple ways. Let me explain.
1. I never opted into receiving offers from this company.
2. If I did stay at a hotel where they opted me in, they would have had to clearly state on signed paperwork that I would be opting in to a text marketing list if I agreed to terms, checked a box and entered my cell phone number. They also would have to present a clear compliance statement saying, :Message & data rates may apply. Text, STOP to stop. Text, HELP for help. Up to 1 message a month. Terms and conditions at www.termsandcondtionslink.com". This was never clear presented to me. Nor did I consent.
I told the guy to show me proof of consent. He said you must have provided your number at some point. I said nope.
3. It is illegal to add a database of contacts without prior written consent. This violates the Opt-in laws for sms marketing.
4. Since they sent me a text without consent it also violated the Anti-Spam laws for sms marketing.
5. It is illegal perform sms marketing using email servers. (SMPT protocol/sending a text from a email)
6. I asked if I could reply, "STOP" to be removed from future texts. The guy said, nothing and hung up at that point.
