    Chase has been calling me every days for the past 5 days 20 times a day. It is very annoying. I am a bit late with the payment, and they are harassing me with their calls. I don't think their strategy makes me pay faster. I am seriously thinking of moving to a different bank.

      Me, too!  A bit late, and the "check is in the mail" - I paid on-line, and in full but they have called me 3x today (work and cell)and it's not even noon!

      I know! Its so frustrating. Every time I call back or ask them to identify themselves, they hang up. So I've simply blocked the number from my cell phone and contacted Chase directly through email asking why they were calling me and asking them to please refrain from doing so and stick to email. The constant calling is extremely frustrating! I'm also thinking of switching to a different credit card company. This is getting out of hand.

          if you have a smartphone with windows mobile. used smartblock from Efficasoft.com. works great for me. Blocks call and txt messages. Now I can sleep..

        A "Cease and Desist" letter like this is a remedy provided under the Fair Debt Collections Practices Act, Section 805. Unfortunately, the problem with sending out the letter is that it may leave the debt collector no option except to obtain a judgment against you, which will show up on your credit report and may subject your income or bank account to garnishment.

        Certainly, when you are on the verge of going crazy from the volume of calls, it can be appropriate to send out the C & D letter. But you may be able to stall the creditor by asking them to identify themselves, give proof that the debt is real, prove how (if this is an assignee or purchaser of bad debt) they have the authorization to contact you, etc.

        Of course, in the end, you will have to settle the debt somehow, or accept a trashed credit rating. Unfair collection practices, high rates and fees aside...you did take the money and should expect to pay it back. The creditor is not responsible for your financial hardship that hinders your ability to pay back what you voluntarily accepted!

          These people make a living trying to collect bad debt.  Yes, how do you get blood out of an onion, is my thought.  Most of the american people have or on the verge of bankrupcy.  These unscrupulous collectors let alone bankers who rob people blindly with their fine print and increasinly rediculous finance charges on top of compounding interest rates, membership fees/annual dues ect..  high way robbery and mostly the folks that are calling you generally are not even calling you from the united states so, they really don't give a crap and they are not regulated by our laws....they aren't even illegal immigrants or anything they are outsourced callers.  Yes, if the calls are being recorded refuse to speak to them if the calls are being recorded.  Let them know that you intend of repaying what you owe if they can prove you owe them and then hang up if they are recording, ask for their name and id number and an address.  Start a phone log.  Heck, you could always file a personal bankrupcy if it is all that bad, since threats of ruining your credit are happening already.  Why not start of with a clean slate, sure your credit will be hard to re-establish, but you can and will do this.  It's just as hard to clean up a record that has been jacked up blemished with their reporting....get a free copy of all  3 reports...garnish your wages...okay whatever, they will need to take you to court first, better yet prove you owe them jack.  If you even owe them.  It's so stupid, I was a day late on a payment.  They charged me late fee I knew i paid off my merchandise purchase.  Went out of town , what wound up happening....late fee on late fee....they said I owed them more money they I had ever even borrowed on credit from them, in late fees and interest on late fees alone.  Talk about a bunch of crap.  I asked the lady to tell me what it was that I owed and why for what purchase, because of 1 day late, a snowball effect.  **ck you, yes, the american people need a forgiveness clause a brand new start for us all.....and new phone numbers and laws in place..something....our own government gets it's bailout...we are the people...we really need to wake up and regulate...really regulate....they work for us..we are not their loan slaves...no way. start living below your means america..

            I get these calls also. I'm about late them and another card. The other bank actually called me and tried to settle. What I've noticed is that after repeated failed calls, someone from another department of the bank will eventually call and leave a message, pretty nice message, something like this "we understand that you are going thru some financial hardship, but you have been a valuable customer and we still want to continue business with you. We have a few options we will like to discuss with you. Please call back at xxx.xxx.xxxx to discuss these options. This means that they want to settle or provide you easier options to pay. First option is a reduced payment, no more interest accruals. Second option is about a 30 percent repayment in 92 days. I took the latter cuz it helps me get out fast. Short term, i will be broke, but after 92 days, u r done and if i'm not mistaking, they put something not too bad on ur report....so it's ur choice.

            Live below your means...   wow, now there's an insightful thought.  Really.  They call me 10 times a day...and yes...i lived above my means and I DO owe them.  I hate to file bankruptcy but I'm doing it.... Need to start over and be better this time.   I will strive to live below my means.  In the meantime, I will be a part of the problem before becoming part of the solution.   I can't wait to live on cash only and stop being part of the problem!

            Really?  I'm not on the verge on bankruptcy.  I read contracts before I sign them.  I don't blame banks for my own lack of self control when it comes to spending.  As a responsible American who works hard every day, I resent being lumped in with these idiots that can't read fine print and them blame banks for the situation they find themselves in.  I don't need a foregiveness clause and I don't want to pay for one for the rest of America.  Nobody should get a bailout.  Not individuals, not corporations, not banks.  You want a bail out?  Get out of bed in the morning, bust your butt working - create a new business, innovate.  That's what made America great once - and if she's ever great again it'll be the strength of her people not their neediness and hopeless begging for bailouts that gets her there.  I'm ashamed for you.  I'm embarrassed of you.

              well how about when 5 years I signed on with a credit card company, I don't owe that much, but to much to pay in one lump sum. I'm not late, nor have I been, but the interest rate has gone up almost 6% from when I took the card 5 yrs ago, to no fault of mine did the interest go up, just the CC company themselves are raising thier interest rates to "offset unpaid debts of others" so basically i'm paying for the other idiots who aren't so the CC company can stay afloat in the economy. I have one CC I just paid off, I pd. online, it took them the 2 days to process, since they don't count saturdays, it made my payment 1, I repeat 1 day late, after they moved my due date up 1 week (which puts it in between my receiving a paycheck) because it made their billing easier, they raised my interest out the roof for 1 late payment in 2 years, I got it back down after DAYS of arguing/requesting, I then transferred my balance to 0% interest with a diff comany and paid it off. I don't beleive that was good custoemr service, for a good-paying customer.

              That's really nice for you.  But when a bank tells you that you have a certain fixed interest rate for life, and then changes it because they are not making enought money and several months later they double your minimum payments--even when you have NOT been late at any time since you have have your accounts is not right.  Then they decide to lower your limits and close your account--still without missing any payments is not right.  They got their bailout with taxpayer dollars and are now screwing their customers.  Maybe you are one of the fortunate ones, but this could also happen to you.

              You know, your statement is completely insensitive and absurd.  Sure, some of the people who are on the verge of bankruptcy have bad spending habits, but some people just hit some rough times.  I am not, nor have I been, but I know many people who have been or currently are.  It was never due to overspending or living above their means.  This economy hit people hard and a lot of once successful business have lost a lot of money and therefore, have had to cut costs through lay offs.  It's not easy to find a new job right away, as it once was.  Often when people do find jobs, they are lousy hours and low pay, making it hard to cover the bills.  It's not always black and white with situations like this and people like you, who put themselves on pedestals and say that everyone who is dealing with financial hardships is lazy or incompetent is what makes the situation even more sad.  I am ashamed of you, DannyH.  I am embarrassed FOR you.

          Olen, I would have to agree with you. In that letter the conditions would trigger a motion on the creditor's part to seek a legal remedy. Unfortunately all one can do is wait until you get the first summons and then get a bankruptcy filing within 30 days of service to appear for a debt. That would cost the creditor some legal fees and halt their action. Now they can always come to court and protest the bankruptcy, which RARELY happens, especially if the collection agency is outside of your State.
          I have not answered calls, but have made token payments until last month. I have been advised to get past the 90 to 100 day mark since last using the cards. After 4 months of not paying I will address the collection agency letters by asking them to provide me proof of the debt with copies of the charges and also a copy of the contract they have with my creditor. The ball now goes into their court.

            About a month ago I tried to work out some arrangements with Chase.  I had received a somewhat nice letter and called.  After about 20 minutes on the phone I told them what I could afford to pay, they were going to knock my inteerest rate down to a certian level and I had to pay it off in five years. To help with the approval I had to come up with the current past due, which was basically two payments.  I really did not have it but told the guy I would find a way if it meant I would ahve a set payment amount and reduced interest.  Two weeks later I received a letter saying I did not qualify for the program and I had to make my regular payments.  I am trying to pay my debt, even willing to pay the whole amount over time, but 29% interest is crazy.  I will be dead before I can pay this off.  How can my tax dollars save banks and the bansk will not help me.  Olen, I agree with you to a degree.  The banks took out bad debt but my tax dollars saved them.

          We aren't children, olen, I'm pretty sure we are all well aware of the fact that we must pay the debt. The frustration is with the fact that our interest rates are and have been ridiculous... unless I make large payments, I don't make even the slightest dent in my payments. It's a never ending bill that I can't get rid of because I can't afford to make large payments. Fortunately, I have a large amount of money coming to me (which doesn't happen with most people), and I will be able to pay this off all at once, and I will NEVER use Chase again. I am 10 days late on ONE bill, and for the past week I have been called at least 20 times a day, and from different numbers. 800 numbers, 866, 800, and 407 numbers. And what's worse is when I DO answer, I am put on HOLD and told to wait for a representative! Then to top it off, I can usually barely understand the person on the other line, with a ridculously thick non-american accent. I have no problem with other races, but this just goes to show how cheap they are, that I'm getting called from another country, because every single time I answer it's from someone I can barely understand, (after I wait on the line, which is freaking ridiculous.) And for that matter, someone with that strong of an accent shouldn't be working at a call center or with telecommunication of any sort. Harrassing me 20+X a day will  not get me to pay the bill. My credit is already horrid, they can't really hurt me when I don't have much to lose. Fortunately I know I have good things coming, for reasons that are personal, I have fallen into some luck, for the future. But when I decide to travel down the avenue of loans, credit cards, or anything of that nature, Chase will not be an option. They are scum suckers, the worst kind.

        You might want to check...this applies to Collection Agencies asking to stop the calls. Chase (in their agreement with you) is allowed to do this...but within certain hours of the day.....

        Sending this kind of letter if you owe them might upset them and even get more aggressive.

        If you are looking to settle the debt (and don't use a debt settlement service please)....I consult (for a fee of course) and can show you over a six month period on how to settle this debt (usually get derogatories removed from the credit report and have marked Paid Settled and depends on your situation).

          Hi Steve. Read your email about Chase and have to tell you I was with a Debt Consolidation company called Safeguard Credit Counseling and had no problem with them handling my debt.  Until my pay was cut and I couldn't keep up with the $500/mo payment. I discontinued the service and have been paying the remainder of my debt off with the same interest rates they charged me in the program. But they keep calling even though I haven't used the card in years and have been paying religiously for well over a year now. A very small balance left and then I AM DONE WITH THEM!! I know some debt consolidation companies are a rip off but Safeguard did what they were supposed to do with no problems. I have 2 Citicards left to pay off and a small amount on Discover and I will be done. Except for the 3 I still use for business.

        I've written the cease communition letter and they still call me 10 times a day.  There is a law firm that will sue them for you and you may end up getting money.  You  must keep track of all correspondence and calls to do this.       do what I did,I lost over 75,000 on financial stocks,bac,amex,citi etc.I have all there cc cards,I maxed every card out for 55,000,.."thats my bail out",they aint get'n a penny from me,let them call all they want,I have nothing more they can take away...

        Do you care about your credit score for the next 7-10 years? Obviously not, but thats your concern. CC companies will make 55,000 dollars in pretty much no time at all to take care of that debt plus some will take you to court. your bailout may turn into a loss of your house or personal property... bet ya didnt think of that one

          Credit card debt is unsecured debt...

          True the credit report will get dinged...but as long as no other screw ups...credit scores will go back up way before the 7 to 10 year mark as mentioned.

          Yes they can setup a lawsuit in court...again I posted a message about some of the best ways to deal with this and how I might be of service.

      OMG!! Chase is so annoying!!! The call relentlessly throughout the day and when I do answer their calls, no one is even on the other end! The hang up! Well, they definitely aren't going to get money from me this way. It just makes me completely annoyed.

        Chase is horrible as far as their service goes. I have been paying them 30% interest for a while and my payments have been in good standing for years. They actually bought out the banks that my cards were originally with, and upon doing so, hiked the interest to a "standard" 30%. Granted, this last month or so I have been out of work which is why I am behind and the collection calls are coming in; however, they have no real "loyalty" to their customers. I just got a new job and start on monday. Believe me when I say, they are the first card to get paid off and cut. My favorite part of the call was when they asked me if I had friends or family that could cover the payment... like I never thought of that one. I know the person on the line is just doing their job and following a script, but whoever wrote that script should be on the receiving end and see how it feels.

      as soon as my payment hits, the calls start again.. i'm waiting to get some money to pay the card off and get rid of it, for the meantime, they keep raising the rates and won't work with me, so, i pay what i can.. i just go on line, set up a payment when i know i get paid, and the calls stop.. what pisses me off, is they call my cell phone... how did they get that number is what i want to know!!!

        i too have been receiving these phone calls from chase. i cant pay my full amount i owe at the moment till the end of next month. i personally called and told them that and they were nice about it. now theyve been calling me 5-10 times a day. even into evening hours and one phone call was at 1am in the morning! isnt that illegal?

          Yeah I hear ya there, I was a week late on a payment several months back, and they called and I told them I was going to pay it  off on a specific date (that friday, and I believe it was a monday) and I said they could even charge my card if they put it on a hold for friday, which they did. The lady said, well sorry but you are going to continue getting calls until then. I'm like ARE YOU FREAKING KIDDING ME? I was so pissed. They continued calling 10+ times a day for that whole week even though they had my debit card payment on a hold for friday!

      The fair Credit Reporting Act prohibits harrasing phone calls. Paragraph 806, sub paragraph 5. www.ftc.gov. You can download and print it. Send them a copy.
