- Alfalfa replies to Benjamin VuagniauxThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - EricSame as above. Got a call from "Nicholas Smith" (fake name) this morning. Stand strong and resist giving in to these fraudsters! I know it's tough, and they're persistent because they want to seal your money, but if you give in, they win. Make sure you report these sorts of calls to your state's Attorney General's Office.

- ScamMeNotCaller claimed NOT to be a debt collector but wanted me to settle "out of court" for a bogus debt that I never heard of. When I asked for his company name, it was "IBM & Associates", a company which apparently doesn't exist. He wouldn't give me his business address either. When asked if he is refusing to give me the mailing address, the reply was "absolutely". He then said he'll send a court summons and hung up. Which was interesting behavior for a company who supposedly was getting paid for "arbitration".

- JENNReceived a call from this number last week saying his name was Nicholas Smith and was working with the county in which I live regarding civil/criminal matters that were valid against me. I looked up the number and found the same person has called other people. I called the number and it went to a recording saying it would transfer to a Nicholas Smith. I found it interesting that it didn't mention a company name. The same number just called me on my cell and work phone but left no message this time.
- Caller: NICOLAS SMITH

Just tired of the calls. Wondering how he got my work and cell phone numbers. And the last four of my social.- Caller: unknown never said
- GitelleI get a call from A Nicholas Smith with a threatening call about a lawsuit against me. The voice was an electronic voice trying to sound human, but the message has been used so often that it can not mask the sound of an electronic voice. They called my step daughter as well. I do not know how they associated me with her, as we don't communicate, and she lives in another state with a very different last name. This needs to end
- Pooh BearThey called my job twice and then emailed me a fake copy and paste letter and this was my repsonse back to them!

- ScamI am not a lawyer and everything I say in this post should be checked with your local and state laws
This is just a short list of warning signs and things you should look out for.
First off you should know that the company is not real and this is just a scam.They have no recouse at all even if you took out the loan since it is a non licened loan and therfore an illegal loan. Also know that it is illegal for them to misrepresent themselves by saying there is legal action against you if there is not. I would sugest you contact a lawyer but you must first have there correct information such as address if within the USA most of the time this scam is only routed thru the US and they are in fact calling you from outside the US. Just remember that they are trying to scare you and get your information and if any collector is blatinly breaking the law were you have the ability to sue them then they are not ligit. Collectors for real companys know the law and adhere to it 99% of the time and are only doing a very difficult job. The best thing you can do is check your credit report and watch it closly because they have all your information and even if your credit is bad now down the road when you fix it they will still have your SS number.
They can not give false information such as saying they are lawyers when they are not or that they have filed legal action against you unless they have.
They (collectors) can not call your Cell unless you have given them permission prior to there call (BIG RED FLAG)
Ask them for there company name and also there address then check on line if it is real and the number matches the one that called you...Most of the time they will give you a real and legitamit company but that company has no idea who they are.
Finaly if you did take out a loan ask them for there lending license for your state if they don't have one then most states now declair the loans illegal and un enforcable...They know this and this is why they use this ilegal tactis to try and collect.
Your state should have a list of all licinced lenders that have to adhear to strick rules as far as rate.
I hope this helps- Call type: Debt collector
- Glad this info is here| 1 replyI got this call today except it was from a Stacy Parker and I was glad I was in front of my computer. I didn't answer the call but listened to the message and typed in the number and found this. Strange I only have my cell number for a few weeks now and havent used it for anything except friends and family. Anyone have an idea how they got my number. I have noticed I have been getting strange calls for the past week asking about a security system and a extended warinty on my car that I havent had for about 6 years,
I called her back to ask who she was and I only get a VM and the google voice that does not say her name correct. I didn't leave a message. Her message sounds pretty scary is this really a SCAM and if so how can people get away with it without someone shutting it down.- Caller: Stacy Parker

- MSA HoldingsGot several calls as above after the first message the others said she was returning my call but I never called the number. She called yesterday and it was a live call talking about legal action that was against me. Good thing my friend is a lawyer and I had asked her about the calls and was pretty sure it was a Scam. She first said she was working with and hired by my county court to get my statement she asked my name and SS and Address none of which I confirmed but she still continued to talk so I 100% knew it was a SCAM at this point since it is federal law that anyone talking on this type of issue must confirm RPC or right party contact. I run a collection department for a ligit company and have to follow the laws and get audited every month to ensure we do or face huge fines. She said I took out a payday loan and defrauded the lender by not paying the loan and would be arrested if I did not pay it. I informed her I never took out any loan I had looked last year for a short term loan to pay for some car repairs but never took it out after I saw the Rate and how much it would cost me. The way the companies work is even if you don't take the loan they still have and simply sell all your information. I asked for proof of the debt and she said if I was going to not cooperate she would have no option but to have me picked up and arrested. This is were I went into my rebuttal. I informed her by law she can't miss lead me with threats and dubious information such as acting as a lawyer if she is not. Saying she was hired by my county when she is not and not giving me her company name and address she then told me the name MSA Holdings only saying it was in Georgia. I was at my computer and yes the name comes up by searching it and has the address in Georgia but the state of Georgia does not have any company listing and the address listed is a dr's office not a company there is a Penn company but it is listed as a collection company not a legal or mediation company. I also informed her I had a lawyer who checked with my county and said they do not and never have used 3rd parties companies and no action was pending. She then hung up and said fine go to jail.
What I learned never put any information on the internet even if you don't take the loan they still take and sell your information. I did and spoke to a few friends who did the same and or took the loan and every one shortly after had there accounts ripped off. Also all have received this call or one very similar all I know is now I have to watch my credit from now on.- Caller: MSA Holdings

- So over itI and my children keep getting messages on our cells from these people for my ex wife. I know it's a total scam one because they can't leave messages like that even if they have the right person. It just pisses me off they have the balls to leave this message on children's phones. I called the number and the women stated at first the numbers were listed to my ex when they are not. Then said that my ex had used them as references when she didn't. I told her she is using a skip trace and just is looking for people with a connection to her. She then replied I can be charged for hindering this process so I told her go for it and charge me. She hung up after saying she will be happy to start the process. What a bunch of crap...
- amanda rosk| 1 replyFor all of you individuals complaining about the telephone calls maybe you all should of thought about the consequences of taking out a pay day loan. READ THE FINE PRINT, you have 2 weeks to pay off a borrowed payday loan and when it is not paid there is an interest rate for most loans at almost 700%. This company in particular as well as the other institutions contacting you because if there is one im sure most of you have an obscene amount of debt already they are trying to help you be responsible and pay back what you borrowed and spent. The economy now is so poor because of people that can not or will not should i say pay back their debts or bills. If your going to borrow a loan PAY IT BACK WHEN IT IS DUE OR DON'T TAKE ONE OUT AT ALL. ITS SIMPLE!!! Anyways this company helped my daughter and I pay back a loan she took out due to stupidity and we actually got a 50% settlement saving a lot of money, now don't get me wrong their messages are a little threatening but would you call back if they left a boring message saying hey im calling you about that bill you owe from last year its needs to be paid call me when you decide to pay your debts back to society, i think not. These loan institutions can and will sue you that's what they are retained for so next time you decide to try and steal money and think you don't have to pay it back, how bout just don't do it. The people that i worked with were very nice and understanding and did work to help me get the best deal for my daughter so in other words these people are not a scam, you people are the scam trying to get away with paying your bills.

- judt replies to Glad this info is hereI just got the same call with claim number uf 105 4542 from pinellas county. I hope this isn't real.
- Robert replies to amanda roskYou are full of it. First of all they are not a legal company and most likely if you pay them your money doesn't go towards any payday loan you might have taken out. Companies like this will never take you to court because they don't have a case to bring. The law is the law and excusing the messages that are against the law is a joke saying oh would you call back other wise. If you paid them then you are the sucker and I am sure you work for the company or are just to dumb to know your rights, And why if they are sooo great would you bother to look up the number and post here....SHILL alert.
