"This is xxxx from the Process & Summons Division...you are forfeiting your right to settle this out of court... you need to call us and give us your current address and contact info or [we're going to hound HR for that info and serve you with papers at work]..this is our third and final attempt...good luck in court."
Several robocalls have come in to the company switchboard that are all just slightly different from one another. They all come from new numbers, but the recordings and info are virtually the same. These criminals must change numbers every few days.
DON'T BE A VICTIM!
First of all, don't call these people back. Never give info, never discuss any supposed "debts" they try to threaten you with. Always, even if you think there might be a tiny shred of truth to their claim, say "I do not believe this is a valid debt." Keep saying "not a valid debt". Demand written verification of an alleged debt. When they refuse to give you their company name and mailing address, be assured that they are criminals trying to steal your money rather than legitimate debt collectors. Any claims that they sent documentation, or attempts to "email" documentation should be seen for the lies they are. Until you have paper in your hand, and have checked your state's web site to see if they are licensed to operate in your state, don't respond to their extortion. Also check for statutes of limitation. Know your rights and don't let thieves take your money.

The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.
Callers pose as representatives of the FBI, “Federal Legislative Department,” various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim’s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.
The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim’s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it’s the latter, the caller tells the victim that he or she is wanted for hacking into a business’ computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.
The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim’s job. In another instance, a phony process server came to a victim’s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.
If you are contacted by someone who is trying to collect a debt that you do not owe, you should:
Contact your local law enforcement agencies if you feel you are in immediate danger;
Contact your bank(s) and credit card companies;
Contact the three major credit bureaus and request an alert be put on your file;
If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a pre-paid Visa card. The statement further declares the victim will never dispute the debt.
If you receive these calls, do not follow the caller’s instructions. Rather, you should:
Notify your banking institutions.
Contact the three major credit bureaus and request an alert be put on your file.
Contact your local law enforcement agencies if you feel you are in immediate danger.
File a complaint at www.IC3.gov.
Tips to avoid becoming a victim of this scam:
Never give your Social Security number—or personal information of any kind—over the telephone or online unless you initiate the contact.
Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
Avoid filling out forms in e-mail messages that request personal information.
Ensure that your browser is up-to-date and security patches have been applied.
Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.

- Julie13I rec'd a call also about an hour ago from this number BOTH on my cell and house number. Called ID indicated wireless number. Why is this happening? This is the 5th different number used from these people
I have blocked the other number on cell and then again another number.. First 3 weeks it was for a person that wasn't me. Now they are calling using my maiden name which I haven't used in years.
I had a thorough back ground investigation done on me Dec 2012 to Jan 13. No fraud activity here .

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:

If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They left a number to call back but I looked up the number the call came from first and found this sight.

They dare call my parents who are on a fixed income (76 years old), my father has a bad heart and threaten them with going to jail for debt that is not even theirs. Not right Payday Loans and you can be sued over it. If they call again I will be dealing with them through the law.

- Fed up with these Jokers!They have called my job and somehow gotten my home number that is on the do not call list(s). So I called them back and warned them again not to call me. I've even given them my bankruptcy attorney's number, but they got rude with me stating that "I know I took out this loan and need to pay it back". I told them that I didn't know what they were talking about and that they should be speaking with my attorney. They hung up on me after I gave them a few choice words. I called them back at least three times. The first time he stated "too late, we're sending the law to pick you up now" and he hung up. LOL! I called again, he became quite annoyed that I actually called again. The last time I called them back, I had just enough time to tell them "now you know how it feels to be harassed and you'll be hearing from my attorney first thing tomorrow morning"!

- kirk| 1 replycalled me at 7am since i dont live in MO anymore, they claimed i had 2 accounts that they were coming after me for that they were going to issue a warrant for my arrest. I recently paid off a bill similar to this one. Now I think that one may have been a scam too. last month they called again and I told them that I was sure that that debt had been paid off. And I would like their information. They said that everything was fine and that I didnt need to pay anything. That was on another phone number that they called me on. Both times the lady who leaves the message sounds exactly the same.

- SherylI have recd 3 calls from them in a week and I have turned everything over to the Chandler Police Department. I cannot believe they do this....I called the number late in the evening and a gentleman answered the phone and said he had no clue who called me, and I told him the Chandler Police would be the next to call him. I cannot believe they just keep it up. I called the number during the day hours and it is just a recording, still have not spoken to a human being!
