- john| 1 replyI had a fella named Dave Birk call to tell me that I owe from a payday loan I took out in 2011. I had taken out a few loans back then but repaid them. I have had multiple collectors call for the same loan I paid for since then. So it is hard to tell who's legit, and who's real. I asked for the verification of debt, and he told me he couldn't send it to me, his supervisor had to and it would be at least a 1/2 hour before I would get it. It's been over an hour and still nothing. Another person who left an unclear name stating he has papers to serve me from a court in a county that I don't live in nor have ever lived in. I called that county court. They have no record of a docket for me to appear.... I am not sure what to do.

- Elspeth replies to johnIt's a scam - per the FDCPA you should not pay any caller who refuses/can't/won't mail - do not accept email or fax - proof of debt/proof your caller has the legal right to collect said debt. Refusal to mail this documentation within five days of their initial contact with you is another violation of federal law and you should not pay them. More info on this scam here:

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

- Elspeth replies to John| 2 repliesIf you do owe a debt, and IF it's been reported to the credit bureaus, then as long as it's not been more than seven years from the date of delinquency, it should show up on the report. Most delinquent accounts fall off the report after 7 years. (However, debt collectors can continue to call or mail you, trying to collect after that time - they cannot take legal action, i.e., sue you - after the statute of limitations for collection have passed, however. The SOL for debts is different in each state.)
The main thing is to know that if your callers refuse to mail the mandatory documentation showing original creditor, amount owed, and your right to dispute the debt, you can be sure they're trying to scam you. Legitimate, law-abiding companies have no problem complying with federal debt collection law. - John replies to Elspeth| 1 replyYes, this debt isn't older than 2010 and I didn't see this listed anywhere on my credit report.

Payday loan activity generally does not show up on the credit reports you get from the three major national credit reporting agencies (Equifax, Experian, and Trans Union). However there are specialty credit reporting agencies that collect some of your payday loan history. It is possible that lenders may access this information when considering you for future loans.
In addition, if you don’t pay your loan back and your lender sells your payday loan debt to a debt collector, it is possible the debt collector would report this debt to one of the major national credit bureaus. Debts in collection could impact your credit score.
Likewise, some payday lenders bring lawsuits to collect unpaid payday loans. If you lose a court case related to your payday loan, this fact could appear on your credit report and may affect your credit score.
Did you contact the payday lender? They may be able to tell you if they in fact sold your account on to a third party DC (debt collector). Again, though, the DC must mail that written, verifiable proof of debt/proof they can collect said debt - per federal law (the FDCPA). Any caller who refuses to do so should be considered a scammer. - JohnI just got off the phone with the originator of the debt. A rep from this company explained to me that the debt was way less than the collectors wanted, and that there was not going to be any lawsuits, court cases, process servers visiting me etc.. She said the worst thing that can happen to me is my credit report is dinged. I hate all these jerks that call to scare people. Should be laws against these individuals and companies and that they themselves have to pay the debts they quote us as punishment and then some!
