    I received the same call and as soon as I started asking questions about the particular reason for the call, I was told that he would report that I wasn't willing to comply, and told me to have a good day and hung up on me!

    The lady stated that if I did not pay the payday advance that I supposedly owe that I would be arrested on three counts of check fraud. She also stated that if I did not get back to her by the end of the day with a payment then she would continue with the arrest warrant procedures. I told her too kiss my [***] and that I would be recording the rest of our conversation.

    Good for you!  Debt is civil, not criminal, so even if you did default on a loan, you would NOT be arrested, nor would you be charged with check fraud!  Please do report your caller to the FTC, FBI and your state's Attorney General.

    I received the same call, and the guy actually left a message with NO company name, he stated on my voicemail that he has 3 pending felony charges for check fraud and he was going to have me located if I didn't return his call. It is against the FDCPA to utilize misleading tactics to collect.

    He just left a voice mail on my Phone too and said the same thing about three pending charges he told me I could send the money to this adress on money gram to payment management solutions account #617632 to Amherst NY is this a scam he told me today was the last day if not he was going to issue me a warrant for my arrest he also said to call him back to give him the 8 digit confirmation # is this a scam

    I received a voicemail from this number and company as well. He did leave his name: Investigator Dave Wilkins with Eagle Mediation Services and that he was with the Bank Fraud Division. Said that he has a legal order to locate and have me notified of 3 pending felony charges. Said that he needs my statement and said maybe we can rectify thus before a warrant has to be issued. Left a case number which was 6 digits. If there was an actual court case it would have had 14- or 13- and then Some numbers after it. I will tell you though that I did actually have a civil warrant for me for a pay day loan that I was unable to finish paying after having paid on it for a year and a cop told me that he didn't have the time to take me in for that right then and suggested I take care of it asap. (I was involved in a car accident where I was rear ended at the time) The problem is that you are correct that they cannot mislead and even leave information such as this on a voicemail as it is third party disclosure due to them not being the original lender of the loan. Meaning they are a third party agency representing the company. So, their tactics are illegal under the FDCPA as a third party company however, remember the old 'debtor's prison'? They can and ARE using those old laws and tactics to recover funds now. I know because I actually did have a warrant for one that I had actually been garnished for, it was paid in full almost 10 months prior by the time the cop told me about it. So I had to call the collection company/attorney to actually have them lift the warrant because they do not follow up to release it after it has been paid! Be careful and don't just dismiss if you have an unpaid pay day loan.  Either report then and fight their tactics and/or get them paid as they can have a judgment placed for garnishment/liens etc and at the same time they are able to obtain a civil warrant.  It's insane!  Pay day loans are awful but sometimes necessary and the one I stopped paying on was one committing illegal practices under Colorado law and they weren't applying my payments plus overpayments to my balance so it never went down.

    It is not as simple as that.  In fact, your oversimplification of the issue, plus your use of the term "voicemail" rather than "snailmail"  tends to make your story a bit ... shillish.

    This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    * Debt collectors may NOT
    - repeatedly use the phone to annoy someone.
    - falsely claim that they are attorneys or government representatives
    - falsely claim that you have committed a crime
    - falsely represent that they operate or work for a credit reporting company
    - say you will be arrested if you don’t pay your debt
    - say they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
    - communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
    - say that legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action
    - use a false company name
    - take or threaten to take your property unless it can be done legally;

    The debt collector may not garnish your wages unless there is a court order to do so.
    + Many Federal benefits (including Social Security Benefits) are exempt from garnishment

    You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

    Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.
