- Liz| 4 repliesI got a call from this number, and the message that was left for me was from a Malcolm Stone. He said it was really important that I return his phone call, as I missed the mandatory 10 day notice. I called him back and asked him if he mailed anything. He said he mailed it to my address (he read it off for me), but never told me what date it was mailed out. He then transferred me to their "compliance" department where I spoke with a man who was very rude. He told me that I had a felony charge against me from a company called America Advance and asked if I had ever heard of them. I said I had heard of Advance America. He said well you tell me, this is just how they have it listed here, in a very rude tone. Anyway, he then said he had pulled up my background and there were no previous charges on my criminal history. He then told me I owed $600 dollars and did I have it to pay. I said no. He then said, well are you willing to go turn yourself in? I said, wait a minute. You supposedly sent me a letter and I had ten days to respond. But I never received said letter so how am I supposed to be able to respond if I never got the letter you allegedly sent? He spoke over me yelling at me and then called me a filthy scumbag before he hung up. This is a scam and a joke and these people are completely ridiculous. Any bill collector would not act like that, and can be turned into the Better Business Bureau. I almost want to call them back to try to get their information so I can turn them in.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

By falsely stating you had a felony charge he violated Federal Law, the Fair Debt Collection Practices Act. If you could ever find a valid address for the company, you could sue them. Do report this call to both the FTC and your state's Attorney General. More and more states are going after illegally operating debt collection companies and winning judgments against them.
- BREE replies to LizThis is the exact same thing that just happened to me. Malcolm called my mother and told her I had a felony arrest warrant out and was going to prison!! My mom called me crying because of this @sshole!!! They are just trying to get people to give them money!!! Wish I knew how to get these people "busted" or at least shut down!!!
