Did they give you any information as to what company they are or what they want? Just received a very odd voicemail from them.

They called me as well.  They claim to be a legal firm called Smith & Travis, but they seem like a low budget collection agency that tries to harass family and friends of people that might have debt with them.  Lots of yelling and threats, basically the scum of the earth type people.  I hope one day they find a real career.

I just got served with a summons. Attached to it was the card member agreement, some statements and a copy of a letter they supposedly sent me on December 30, 2011 saying they purchased the account. Can they wait over a year from sending the letter to sue me or do they have to send a fresher letter? What do I do next?

I DID hang up on them last month and now the summoms came. I can't afford to pay the bill or a lawyer. Is this legal to sue me ?? Please help I never been sued before and don't know about this stuff or what I should do .

I would like to see a copy of a Summons and/or Complaint that was received from this firm.  We are in the midst of preparing subpoenas to track down the actual "owners" of this "litigation firm".  So far no actual lawyers have been linked.

I am dealing with these people. I have contacted my local Sherriff, BBB, FTC, and recently the Internet crime Division of the FBI. Please let me know if you can help me with these people. I am beyond stressed out!

They were listed as a plaintiff, there is another law firm in my county that is actually representing them. It says Smith & Travis, Ltd.

VS.

MY NAME

They had some lawfirm with a completely different name actually sue me, but they are listed as versus me. Does this make sense? Is this how it's done?

I too called my local P.D. and they were rude in bringing up my past shoplifting arrest ad told me to pay y bills.WTF. I made a pymt agreement with them rather than get dragged to court and have to quit my job to avoid the garnish.

What are you stressed about? Having to pay what you owe? I didn't know debt collector calls were a police matter. Oh,it's a "fake" debt right? But you wouldn't be stressed about that now would you? You know it's TRUE! Man up and pay your way!!

Who are you to judge me?! I am paying on this bill but I am NOT going to pay it to a bunch of scam artists. The fact that these people can not be found by anyone doesn't sound weird to you? The way they went about contacting me, threatening to have my wages garnished and my assests seized is illegal. You should do your research on what the leagality is on FAIR debt collection practices are before you jump on here and make assumptions of people you dont know. Why are you on here make rude comments unless you have something to do with these people? I HAVE done my research and am protecting myself and my family. If they are a legitimate law firm I will see them in court.

They are trying to collect a debt that was dismissed in a lawsuit because it wasn't mine over 6 months ago.....when I tried telling them that,  they called me a liar!!! Really now? ..... I have the court documents to prove it.  I do have a recording of the conversation  and a threatening voice mail....it's in my attorney's hands now.

Really,it's illegal? Then how are people sued and garnished everyday in U.S. courtrooms? What makes you so special? If you were paying your bills nobody would be calling or suing you.Get your head out of your azz anf grow up.

There are legal ways to go about and ILLEGAL ways to go about it. You CANNOT threaten to do it. If that is the ultimate way the debt collector gets there money they just have to do it. They CANNOT call repeatidly with the intention to annoy or harrass. They CANNOT use profane or abusive language when speaking to someone about their debt. They CANNOT discuss personal debt with anyone but the debt owner. They HAVE to send you documentation in WRITING when requested. ALL OF THESE ARE THINGS THIS COMPANY HAS BEEN ACCUSED OF DOING!

It seems they did call and discuss your debt with you and said they were going to sue you.Soo what is illegal????? Really if all this is so legit then why was i contacted by the Ohio State Attorney General today? why would they want all the info I have then? why wouldnt they just tell me to Shut up about it?? hmmm....weird

The Ohio Attorney General's office contacts lots of people on Saturdays. Yeah, sure they do. You're so funny.

I received a message from Hayley (sp) a "paralegal" with Smith and Travis on my answering machine and heard it when I got home.  Hayley (sp) actually threatens me right off the bat saying I was going to be sued and that my car (which is paid for, so I'm pretty sure that's impossible) would be taken away along with my home (you might want to ask my mortgage company if that's ok with them).  Now, I know that whatever small (and I mean small) debt I do owe is not even close to what my car and/or home is worth.  If I receive ANY correspondence in the mail or any other calls from this "lawfirm", I will be reporting them to the proper authorities.  I know my my rights as a consumer, and am appalled that this kind of threat and some personal information was laid out on my answering machine before initially speaking to a person!  The call didn't intimidate me, it just made me mad.  So, Smith and Travis, you will most definitely NOT get any information and/or money from me.  I don't owe you one red cent.  I'm pretty sure you're monitoring sites like this (LOL, lol and umm ok...) to see what people are saying about you and your harrassing phone calls.  I believe you've crossed a line in collecting debts and don't have a clue as to what you're talking about.

Any property you own or have equity in can be attached to pay your creditors once they obtain a court ordered judgment that you ay them a certain amount.If your car is paid for it can be sold at auction and the proceeds would go to them to cover what you owe and the excess returned to you,same with your house the excess would go to your mortgage company or you,if you had more equity than you owe on this debt. Please remember "small" debts add up quickly once you are sued due to court and legal costs you would be ordered to pay for refusing to pay a valid debt and forcing your creditor to sue you.Best thing you can do is stop playing lawyer and pay your bills.Creditors have rights and have the means to enforce them.Looking for loopholes and ways to avoid paying what you owe does not work,and many people have lost their homes,cars,etc. by foolishly thinking there is a free lunch.There ain't. Man up get a second job,cut out the smartphone,cable,starbucks,etc. and pay your way!!

Creditors have rights?  Well so do alleged debtors.  Debt collectors need to follow the FDCPA.  Leaving messages as described by the previous poster that include any info about the debt on an answering machine is a violation of the person's privacy and is not legal.  I'd also be interested to know if the company mailed the person a debt-validation letter proving that the person not only owes the debt, but that the company has the legal right to collect on it.  That's also required by law.
