- Derrick Jenkins| 7 repliesThese people name was Dell Ray Capital, which is a credit collector and they are saying that I owed 1,855 for a pay day loan I never took out and they are saying that I have to pay this loan out or be served and would have to go to court. I told them to serve me. I am waiting to see what happen.

- Vigilante8 replies to KK| 3 repliesTrying to track down chain of title from a payday loan. Contacted by a Simon Eichler and Associates who are trying to charge me a ridiculous amount of money. I spoke with a Mr. William Childs who sounded very shady on the phone. Basically lied and told me he could charge double the amount owed legally. I called Delray Capital and get a voicemail everytime. Funny thing is it sounds just like William Childs of Simon Eichler and Associates. Does anyone know if there is information that has to be provided to prove the validity of the debt and that they are not slick scam artists?
- Elspeth replies to Vigilante8| 2 repliesLEGALLY - they must provide you written (not via email or fax) validation of any supposed debt you owe - who the original creditor is, the amount you owe, when this was incurred, etc. If they DO NOT give you this information via mail then you can be sure they are scammers or rogue debt collectors. Tell them you've reported them to the FBI and also your state Attorney General.

I dont feel comfortable with these people having my address - Deborah| 2 repliesjust received a call saying I am going to be sued by a loan company. They said they would set up payments but then the phone hung up. The company that called me was Nationwide Arbitration Services. I looked them up online and there are so many complaints against them. So I called the company I defaulted on the loan with...became very ill and my life fell apart and I couldn't keep up) and they told me they sold the loan to Del Ray and that Del Ray could have sold the loan to someone else. All I get from Del Ray is a recording to leave my ph# and name. I didn't, I hug up. Now I don't know what to do. I told Nationwide I could set up payments. They put me on hold to set things up, then the line got disconnected. I called back and the same thing happened, disconnected. One man I spoke with at Nationwide gave me his name...then handed the phone to another man who gave me another name. They sounded exactly alike!

- scammed| 4 repliesGot the infamous phone call from Cooper Mediation supposedly working to collect a payday loan. At the time I could not get into my computer to verify if authentic. Call was about step daughter and payday loans. Wanted $933 or they would release a warrant for her arrest unless paid that day. Had a lot of personal information and since I couldn't verify settled with them for $633. After getting info I need from her bank there was no loan deposited to her account on date they claimed. Fortunately, I had charged this to my credit card, waited until loan was taken out and closed account. I waited for letter I was promised, never got. Have called back and lady was very apologetic, would send out, never got. Talked supposedly to a higher up and he made threats he isn't allowed to do, warrant for her arrest for fraud as account was closed, etc. Traced number back to Delray, very confused as to who these folks are but they are scammers.
Contacted state Bureau of Financial Affairs, first time said to write them, second time they said they had a cease and desist notice to the Integrity Payday, the loan company, as they are not allowed to operate over the web in this state. Next contacted Federal Bureau of Affairs, filed a complaint with them. Most importantly, since all I get now when I call is a recording asking for name and number and they will call back (never did)
I reported the transaction as fraud to my credit card company as they have more power than I do. They reimbursed my account and am now waiting for their resolution.
Interesting, just got another call from Delray Associates (who this other firm was supposedly working for) that they had just bought this account and are a collection agency. Guess the right hand doesn't know what the left is doing. Anyway, beware of phone numbers 513-474-1989 supposedly in Towanda, New York
and also 888-348-7190 wherever they are.

The people represented themselves as Amy Bishop - paralegal (and then upon a 2nd call as Amy Bishop), referred me to a man named Mark Austin, who represented himself as a senior attorney with the law firm of Clark & Fuller at 1300 Main St.#323, Houston, TX, who also put me on hold to consult with his other senior partner. There is no such firm on record in Texas at this address and neither of these people have any type of law certification in Texas. This is either a "clever" collection agency ploy, or outright fraud. Beware.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?
The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. They (or someone with the same name or similar name) have a long history of debt scamming on 800notes.
If someone calls you and claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else another dime until the debt is validated

If they continue to bother you, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. These are the names of the individuals that have emailed me or called saying I was preapproved for a loan they both told me I had to show them I had a $120.00 in my account and then they would deposit the funds into my account in 7 minutes. I told them I did not have the funds and they wanted me to borrow it from someone,I told them if I had to give them money to get a loan I did not want it. , the other party name is John Williams of Money Finance he called from the (321)352-3095 number also. I checked the number thru google to find out it was a Scam. They still keep calling especially John Williams. I wish they would leave me alone. How can i Stop this. Your best option is to contact you phone service provider and request your phone number be changed without providing auto-forwarding or message "the number you have called has been changed to #####..." services. - Hunter P.| 1 replySeveral of my family members received calls from a lady named Tina Sanders stating to be from a mediation company seeking to file civil lawsuit charges on me. I find it odd that ANY collection or debt agency would give out my personal information and nature of the call to the family members they called, as that should be private information only given to me. I called back and this lady stated they were seeking debt for non payment of a pay day loan I took out on October 31, 2013 in the amount of $800. However they were seeking payment in the amount of over $1700 to settle the debt today, if I didn't pay and settle the debt today they would file the complaint with the courts and sue me. She then stated that once the charges were filed they would most definitely win and would send an auctioneer to my house to take anything that was not a necessity including anything from my son's toys to TV 's, etc and use these items to cover the cost of the debt.
The time frame she is claiming I took the loan out I was in Afghanistan as a private contractor. I had just got out the marine corps and accepted a contract for private security on a one year your in Afghanistan. She did not have my email address and did not give me what address she had for me when I asked. She only kept saying what they could do to me if I refused to pay today. This is a loan I did not request or take out and I have never heard of the company I supposedly got the loan from.
I asked why I never received anything via regular mail and she stated that all transactions and contacts were done via the email address provided to the loan company. I thought all debt collection attempts had to be sent regular mail. She then placed me on hold stating I needed to speak with her COO Pamela Atwood, as she attempted to transfer me the line disconnected and this other lady called me back from a different number. Both ladies claimed to be calling out of New York but after a lot of searching I found the company was actually out of Ohio. I requested more information and stated I needed to look into this more and I wanted something in writing at which point she stated I did not have time for that because it had to be taken care of today or the charges would be filed tomorrow. She stated I was in default of the supposed loan because I gave the loan company 3 "bad checks " out of an account I wasn't even using at the time nor was I state side.- Caller: DELRAY Capital and Nationwide Mediation Services
