Repeatedly calls me at work trying to collect $38,000 on a supposed Citicard.  I've never had a Citicard and pulled all three of my credit bureaus and this debt does not exist under my name and/or SSN.  The woman is abusive when she calls and threatens legal action.  However, i've never rec'd one piece of correspondence pertaining to this supposed "debt", only harrassing phone calls.  This is an obvious scam of some kind.

very abusive lady calls my office from this number threatening legal action for some supposed debt that she has never been willing to identify.  She did leave one very rude vmail that I have saved should this turn out to be a legitimate collection, again failing to identify herself or the company she was with.

Called my cell phone and asked for James Walden, after identifying himself as Mr. Anderson from First Financial.  After telling them that he did not exist at this number (has been mine for over a year), the male voice became very rude, and stated that "we know what we need to do next" and hung up.

Got two calls from this number. The second time a man left a message asking me to call him back at a different number than the one he called from. He did not say what company he was with, only that I should call him back. I researched the number and got no clear answer as to who had just called me. So, I called the number that had called me before (not the number the man asked me to call him at), and a very rude woman picked up. She demanded my number, and when I gave it to her, snapped that my number was not in their database and that I should disregard the calls. She then immediately hung up. I'm thinking I should NOT call the different-number answering machine guy...

A rude woman called asking for my mom, wouldnt tell me who she was. I told her she will never get a call back unless she identified herself. He last words were for my mom to lawyer up and call them when she's ready. I had my brother call form another state to find out who they are cause my mom dont speak english. It turns out they made a mistake and they were looking for someone much younger, S.S. they have on file did not match. Me having worked in the financial world all my life, people like this don't give up too easily, do not fall for it.

Sarah Miller is looking for somebody that is not me.  She says it is not a sales call-it is important number.  Cannot be that important since she doesn't know who she is calling.

this # has starting calling the phone in the empty cube across from me at work, my job to take those phone msgs... very annoying, supervisor called the # today finally to try and explain they are calling a company with no knowledge of whoever they are calling... weird, since you have to dial an extension to get to the phone, and it is total simulated voice on the messages.  leave an 800 number with a "Mr. Green" name, otherwise no other specific info.

Got a voicemail from 561-687-1915, and the male voiced recording calling himself "Robert Smith" (uh huh, right), told me to call this # back.  Research on both numbers shows scams and various intimidation tactics, not to mention asking for someone I've never heard of (this has been my phone number for 6 years).

Tell him you will be filing suit against him and his employer for harassing a non-debtor:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

    Annoyed Debtor
Correct me if I'm wrong there is a Fair Debt Collection Act isn't there?  I'm getting calls before 8:00am from these people.  Whoever they are, they obviously don't care about regulations.  This is ridiculous.  While I do owe some money to some people, I'm not going to pay a collection agency that doesn't follow the law.  I have been making minimal payments cause times are hard.  But this is insane that they can keep calling at all times of day and night and badger anyone that answers the phone.

    Check this out:

In 2004 this company (I believe it is the same) had a class action suit filed against it for violations of the Fair Debt Collection Act.  Looks like it is time for some or all of us to either find a class action or file one...

got a call from a very rude "Mrs. Robinson" who would not disclose the name of the company or a first name. She kept insisting she needed to speak to my husband about "business" and when I asked her what about, she would not disclose. Both 561-689-9494 and 561-687-1915 have called the house repeatedly without regard to time of day.

Troy Holbert has rang my phone off the hook today, leaving me messages about how he is trying to collect a debt and if I do not call back and "DO THE RIGHT THING" like Troy claims to be doing, that further legal action will be taken.  This man was very rude and was threatening in this voice message.  The number he called from was 561-689-9494.
