    Receiving calls about pay day loan on default. Saying that legal action will be done if I don't pay. And then I started receiving calls from unknown saying that im on his list to be serve legal documents.

    Said I owe an them...they bought this account from an "umbrella" account. Bayside is what they said. Its a fraudulent check. Couldn't tell me who was the original creditor is. They serving legal papers etc etc.  Spoke with a Tim Bryce...

    They will not be serving anything.  Demand WRITTEN documentation of this debt MAILED (post office) to you.  IF you were to be served, you would not be called in advance.  SCAM - can't tell you the original creditor??

    They emailed me some documents but still couldn't tell me the original creditor. Left message saying they were going to take action Monday.

    A phone call from a supposed debt collector is not legally sufficient evidence of debt.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

    You're being called from just another scammer in western NY. They're a dime a dozen. Just tell the caller that you've educated yourself as to your rights under the FDCPA. Do so! It's easy to understand. Just Google it.
    When the blow-hard calls again, tell him to mail (NOT e-mail or fax.) you the federally mandated notice of validation. Tell the buffoon that he's running out of time. Under the FDCPA he is required to mail you that notice within 5 business days after initial contact with you. When he claims that he already has (he's lying), DEMAND that he provide you with his valid physical address. He'll give you a box number, probably one at a UPS store. Tell him no, that won't cut it. When he refuses to give you a physical address, he has just given himself away. He's a minimum wage flunky trying to collect invalid, time-barred, illegal or purely bogus debt. He most likely is scamming for a low budget Junk Debt Buyer (JDB).
    Once you've familiarized yourself with the FDCPA, you'll realize how many violations this clown has already made. He's a powerless joke who depends on bluster & BS to "earn" his commissions. Ignore him or block his calls.

    No - because REAL process servers do NOT call ahead of time - they just show up, legal documents in hand.  They also do not tell you to call someone else to "stop" being served.  This is yet another scam attempt - nothing more, nothing less.  Report them to the FTC and your state's Attorney General.  And whatever you do, do NOT pay anyone who calls you unless they MAIL - do not accept email or fax - proof of debt/proof your caller has the legal right to collect said debt.  Refusal to mail this documentation within five days of their initial contact with you is another violation of federal law - the FDCPA.

    Yes, that is exactly what they said that if she didn't hear from someone at the number she gave me to call by the end of the day she would either come to my home or workplace to serve papers.

    same calls, today now Michelle Grant said she tried to deliver papers to my home, no one was home, and then was going to go to my work place to give me papers.  Not sure if this is legit or not.

    This company is so shady it is ridiculous. first a Max Gennings calls stating that hes perusing me for a claim, then calls from the same number pretending to be an attorney calling himself Anthony h Rodriguez. I am sure this was a mistake on his part but he then contacted my family and friends and gave them my social security number pretending to be my attorney and trying to get information. What kind of slime does that.
