- ljm0141| 1 replyMy husband recieved a call today from 615-752-3817. They threatened to issue a warrent for his arrest if they did not recieve 300 by then end of the day for check fraud. She had told him it was from a payday loan place. I did some research and found out that a payday loan default is civil not criminal, so I called to gather information about their company. I was informed that it was for a hot check and we dont even have a checking account. I called my husband and he again called them back and again they told him it was for a payday loan. She said she was from NCIC. Then she told him that she was just gonna go ahead and issue the warrent since he is trying to get out of it. She also told him to lawyer up cause he will need a good lawyer. All we are trying to do is get to the bottom of this situation. With all the scams running around I dont feel safe just sending money to anyone. The weirdest part is that they said they can take credit, debit, or check ( which is odd since they are accusing him of check fraud)

- TJ replies to ljm0141Your intuition is correct; it's a scam. Pay no attention and ignore all calls from them. Or if you DO answer, say "[your county's] police non-emergency line, how may I direct your call?" Guarantee they won't call back. It's no use asking for a name and address to send cease and desist letter bc they'll either hang up in your ear or give you false information. Another option - tell her/him "BRING IT ON!" and hang up.
- whiteline1I received a call from this number stating they are National Check Investigation Services. Derek Smith,
lead investigator at 615-752-3817. He called my parents, saying I had committed check fraud and I was being investigated.
When I called them, they informed me that the PayDay Loans that I could not pay and were returned NSF, I was being prosecuted for Bank Fraud, Check Fraud. I would have to post bail for $5,000. This could all be avoided if I pay them $1,800 by tomorrow morning. He was giving me a courtesy call, since I had no prior convictions. And this conviction would ruin my life. I filed bankruptcy since losing my job and they were listed on my creditors list. I told them, how can this be fraud with PayDay Loan and not being able to pay it?

- ShaunI also received a call from Derrick Smith stating I was going to be arrested for bank fraud with a felony. Im not understanding this all happened in 2008. Why is this happening? He called from 615-530-6083. I think this is a scam!

- Brent JI also got a call from Derrick Smith stating that I had committed a felony with malicious intent and had to pay 1969.00 or he would have to submit a warrant for my arrest. Said he could call the District Attorney and see what he can do. He came back on the line in about 6 minutes and said "Bad News, they don't even want the restitution, they just want to prosecute, but he agreed to let me pay them in pieces." How can anyone call a DA within minutes and get a response back that fast?!?!? Anyway, I had done some payday loans in the past and I was worried. I have kids and a new job, I could not afford to be wrong, so I paid 172.14 and said that I could pay the additional 1769.14 on Friday. They called at 8am and demanded payment. When I started asking questions, looking for some sort of proof, etc..he said that his supervisor would have to call me back....
Are you kidding? This has to be a scam.
Said he was in tennessee....Why would he be calling a DA in Orange County, CA to have me arrested? I don't buy it and I won't be sending the rest of the payment either!- Caller: National Check Investigative Services
- dolphinsfan| 1 replyI also received a recent phone call from derrick smirh in regards to a old paydayloan from almost 5 years ago. I rceived the same treatment and threats that I would have a warrant issused for my arrest and the whle malicious intent and no priors courtesy call. I did not have a bank card till today and was supposed to give my payment but after reading all this I'm not sure its the right thing. Also I thought payday loan defaults are considered a civil not criminal matter ?? My calls did however come from 2 different 615 numbers. Both attached to magic jack

- spiritual mom| 1 replyI received phone call from 615-530-5639 from a James Lee with National Check Investigative Services about an unpaid payday loan. I guess this company is based in Tennessee. He told me that I needed to pay $935.40 by the end of the day but they would take $500 in restitutions they could take credit, debit or Green Dot Money Pak card. If not paid he would call the attorney and have me arrested for fraud this happened in the state of Washington.He also said that when the pay day loan company tried to get their money there was no money in the bank and I did this on purpose with intent to commit fraud. He also stated that I could serve 18-36 months in Jail and a bail of and with no 10%. I did get a couple of Pay day loans years ago and paid them off. I could have forgotten one but I don't think so. He also said that they have been trying to contact me for the last 4 years, by email, phone, etc. but I have gotten no contact from him or the company that allegedly hired him. Help WHAT DO I DO. After reading these comments I am not sure this company is for real and I am trying to investigateit.

- Mike WEveryone. You should be inclined to ask questions if you receive a call from these people. Do not agree to pay ANYTHING unless they have proof of the alleged debt. And that proof had better be in writing and they need to send it to you. They are required to send you, in writing proof of any debt owed. Also, do not be taken in by threats of criminal charges. It is a ploy to get you pay or be coreced into paying or entering into some agreement. They may use jargon or codes and statutes that don't have anything to do with what they are telling you, but matters like this are civil.
I had a run in with one of these people. Asking for proof and knowing about debt collection laws makes them angry. This person decided to threaten and curse at me. I immediately hung up.

- Katie T| 1 replyI got the same calls but by Investogator Wright... He was so mean and rude! He was saying all the same stuff! I called my local non emergency police department and they told me there is no way that they can arrest you for this! They didn't say anything about fraud to me but an arrest warrant and everything. When they called back and I told them I talked to the police he said "we knew you were going to do that, and that they are filing the arrest warrant now" and hung up on me. I was trying to ask a question. I am so glad I didn't pay and seriously let them call me back! I hope these posts help lots of people! They are scams! They are not a recognized company by the Better Business Bureau! Don't send them money!!

- Alfalfa replies to Katie TThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - TGThis is 100% scam. I have worked in financial services in the past and am quite familiar with debt collection law and how customers may be contacted. Everything these people are doing is illegal. Intimidation, repeated and harassing calls, etc are all illegal. Additionally, it is likely that just about the same time they began calling you would have received documentation in the mail regarding a debt and their intention to collect it. Writing is the only form of communication that is legally able to be used for "official" notice of the debt (though they are allowed to call until you ask them not to). Real debt collectors will have no trouble offering you information about your debt, their efforts to collect it, etc....but more importantly any unsecured debt that is legitimate is a civil matter, not a criminal one. Any threat of someone showing up to work and arresting you is just bogus. Plan and simple.

- Not that dumbThese losers have been calling me for a few weeks now. They always seem to forget our prior conversations - the ones where I told them this debt was discharged in a chapter 7 and to go get stuffed. So now I saved their numbers in my cell phone and just have fun screwing with them when they call. They get really, really angry when you mess with them. They screamed would be arrested by 5:00 the "officer" with a warrant was on his way and I told them I'd bake a cake and put some coffee on - he never showed up. I called them back and asked when he was going to show up and they nearly blew a fuse.
