    Daughter received call from 619-677-5625 from a Steve looking for my wife, Called the number and spoke with a Steve who said my wife was going to be served with papers for a payday loan that wasnt paid. Told him we didnt have any outstanding payday loans. He stated if we didnt take care of it she would be served on Dec 28. I told him to go ahead and serve her and we would see him in court. This crud has been going on for three years about every four months. Have made many reports with police ,FTC,, FBI.

    This scumbag is a debt collector at a company called Barrett and Associates. This number is his cell num that he uses from his desk sometimes to call on payday loans and scare the consumers ---- here is his real info ........ trust me it is accurate I sat next to this

    This message arrived today, 1/25.11 around 11:20am, from a Steve ?? regarding an investigation of a (named this person) happens to be our son, & that we may be related to or associated with this person, & that he request that we return the call to his direct line, 619-677-5625.

    Our son has NO knowledge of this person or association & we feel that it is a "scare tactic" to SCAM us for money to "go away"

    To comment on the many negative posts in this thread i want to explain a bit of the legal process. Many of you act is if this is something new or a new tactic to collect a debt. What i am seeing here is that many of you fail to realize if you are legitamely delinquent on a debt in which you have a legally binding contract - you can be sued for the full balance on an account including any applicable court cost and attorney fees.

    It use to be somehwhat uncommon that a company sued for an unsecured credit card or fairly small debt. Now days, given the fact that the economy is in a state of turmoil, companies need to recover every bit of money they lose out on. Its a vicious cycle. The economy goes bad, debts do not get paid by consumers and the only thing a creditor can do to recover their money is sue.

    Typically this process starts out with a company first skip tracing or locating a debtor and verifying a physical address. Sometimes a private investigator is hired to do the job or the company may have an investigation/skip tracing unit. Once the location is confirmed. The complain is filed with the courts.

    At this time the company then must have the debtor served with a copy of a complaint and a summons to appear. This is carried out by a civil process server - this can be a sherriff, a marshall, an attorney service etc. At that point you as the consumer may pay a fee and file an answer and try and fight the case. You may need an attorney and its only worth fighting the case if you believe the debt was illegitimate or your wasting your money and time. Most contracts state that you may be responsible for their legal fees if you default.

    After the answer is filed the courts will grant a period of time for discovery for the two paarties to make a case. If the debtor does not file an answer the creditor may request for entry of default judgement. Judgement simply means the courts found the case in your favor.

    The creditor can then pursue post judgement remedies. Depending on the laws in your state, this can be in the form of a wage garnishment, a bank levy, pursuing assets/property, tax liens - it also damages your credit rating and shows as a public record. Employerss see this, banks see it. This appears on background checks etc. They can last anywhere from 4-10 years or longer if the creditor renews the judgement.

    It does not sound as if this individual is breaking the law. Many companies now have attornies on constant retainer to sue individuals. Gone are the days of a simple report to your credit, a collection call, the typical statement of "further action" and numerous letters. Companies mean business and they are finding the time and resources to recover their money through legal means. I have researched a bit myself on this company as it is not the first time i have come acrossed a complaint but they are legitimate. They can and will sue when legally entitled to do so. As with any company, they win some and lose some. The bottom line is, people such as myself are here to stick up for consumers and see that they uphold to the law. Complaint threads such as this are not always the best indicator as to how a company or individual does business.

    It seems many people use this site to bring negativity to companies whom are doing their job. Not many people have too many positive things to say about the collection industry as a whole. To be realistic, they have a job just like the rest of us and its those of us whom fail to pay our bills that give these individuals a job at all.

    Ill keep my eye on this thread and if and when i do see this company breaks the law we will investigate the issue further. As of now, all i see is a group of angry irate poeple that are upset because they are being forced to pay those very same legal obligations they signed agreeing to.Caller ID: 619-258-1461

    Received a call from a person named Byron Smith...Called back and spoke with department Manager Mr. Davis. Was a bit skeptical at first, claimed regarding an account From First National Bank of Marin - something i stopped paying on in 2008. The company didnt have a website so i looked them up by phone number. I saw a number of complaints about how these guys do business but they never really mistreated me. I went a step further and traced the matter back from the original creditor and ended up at the end of the line with Barrett & Associates. I looked on the better business Bureau and they are legitimate but not accredited. Finally i asked for a copy of a contract and he said it would take 48 hours. Sure enough he responded by email with a PDF copy of the original contract. They ended up settling a $1,127.00 debt for $775.00 in two payments. I knew i owed it and remember the debt so i paid it. Why does everyone seem so unhappy and digruntled on here? I say if you legitimately owe a debt, pay it. Calling a company a scam just because you see a post from another person saying they think its a scam doesnt mean its necessarily a scam.

    On a another note, i checked into these guys. They are not a law firm but do have reputable attorneys on retainer. I learned my lesson here as i dealt with a company called Midland Credit Services a while back. They are not a law firm and advised me they would sue if i didn't pay - i replied telling them they were a joke and just a collection agency. Sure enough i got sued. Anyways, best of luck to everyone

    This is illegal and you have illegally accessed and breached this persons confidential information without their permission. This is a violation of Accurint Lexis Nexis and other skip tracing tools permissable use policy. This will be reported to them hopefully resulting in an audit and the lack of ability for you to continue service with them. I urge anyone who questions the legitimacy of Barrett & Associates to check with the Better Business Bureau, the California Buisiness Portal through the Secretary of State or the county recorders office as you will see they are licensed and they are a legitimate company. This blatant attempt at defaming and slandering a company's name below is illegal and will be dealt with through legal means as i know exactly who put this post up...Any questions with regard to legitimacy you may call Barrett & Associates directly at 619-258-0745 ask to speak with Dave or Steve.

    I see everyone's point on here but I think he is a joke because I filed a Chapter 7 BK and was discharged. My debt supposedly was owed back in 2008 but I filed my BK in 2010 and added everything that I know of. The bottom line is once you file BK you cannot be harrased anymore & they feel that its still ok to harass regardless of CA state laws!  So go ahead and sue me take me to court it will bounce back because I will file a counter claim of harrasement!

    This number actually belongs to Barrett, Garcia & Associates who sometimes identify themselves as Barrett & Associates. For all those who do complain or intend to file complaints do not make the same mistake i did. I got a call from this number and the man identified himself as "Steve"...when i looked up Barrett & Associates (as the caller id himself as) complaints it took me to a website like this for the number 619-258-0745 and i used the info on that page to file complaints with the federal trade commission and the Better Bus Bureau believing I had found the coorect party. A week later I got a call and response from a Mr. Barrett from the 619-258-0745 # identifying himself as the owner of the company Barrett & Associates aka Barrett Asset Recovery LLC and he mentioned he had no file or business dealings with me at all in his office and asked what # the call came from. I gave him the number. A week later i got a letter from Garcia Barrett & Accosiates and the name Steve Bickman was at the bottom of it with 619-677-5625 phone # and I had to refile my complaint properly. I attempted to apologize to Mr. Barrett and was informed if it didnt stop immediately i would be sued for defamation of charachter and slander. I agreed with him to retract my complaint and we parted ways.

    A bankruptcy is only valid if the defaulted loan is included. If it was not included, you are still legally liable. In addition, if you were awarded a Chapter 13 you are liable to the payment percentage the court has determined. Finally, 75% of Chapter 13 bankruptcies fail and the petitioner cannot again file and therefore are subject to full repayment.

    As Wolfie said.. Unsure why anyone would reply to a 3yr old post. Those are read and primarily used for a reference when looking up the number. The recent posts, if any, are those more in need of replies or further information.
    If the debt was included in the Chapter 7 Bankruptcy and fully discharged as well as "case closed" then the debt is void, dead, no longer owed.
    Of course that doesn't stop scam, criminal collectors and predatory creditors from continuing to try and TRICK or SCARE one into paying. That's where this site is also very valuable especially for those unfamiliar with these scammers.
