This is an attorney's office that is apparently trying to collect a debt. I have explained that the debt is not mine and asked for time to investigate the charges they are saying I made but never paid. They are rude, horrible, unkind, awful attorney's that find guilt in all no matter what. I would seriously watch your back when speaking to these people. - Time To Shine replies to Bill Payer| 6 repliesI dealt with Barrett & Associates. I actually work for a company who investigates and profiles companies who practice debt collection law. After extensive research and even a few "bait" phone calls it seems they are compliant with federal and state laws. It is not uncommon for an individual whom owes a debt to feel as though their back is up against a wall when approached legally with regard to a delinquent debt. From what i have learned most complaints are bogus or are generated because of companies calling relatives or third parties. We tend to look at both sides of the coin. Many people in debt get upset when they are "found" after many years of going into hiding from creditors...They often complain of harrassment and unfair treatment.
We have closed the file on this company with no further proceedings. This is over a credit card debt that is past statute of limitations and informed that they do not represent the original creditors

Most companies these days purchase debt and file suit against those contracts that are legally enforceable with the use of a debt collection attorney on staff. Usually these companies are structured to have a collection department and a legal department and the attorney is usually the head of the legal department or kept on staff wwith retaainer to file law suits on these accounts at any given moment. They should not be stating they are a law office but it is ok to state that you work under an attorney or calling on behalf of one.

They call family members as a way to "lure" the person there trying to get a hold of by trying to embarrass them. I spoke with him and he's spitting laws out of his mouth that aren't even true. So if you "investigated him, then you need to find another job because your a horrible investigator. I found dirt on him in less then 10 minutes that I can prove in court. So bring it on mister Davis. I can't wait to fuc* you up in court. You won't even know what hit you!
- Fed up!| 2 repliesI continue to receive calls from this number, and from a man (same man every time) claiming to be an attorney looking to collect a debt. The debt isn't even mine, or anyone in my family, or anyone living at my address! This has gone one for many months, and today they repeatedly called (every 30 seconds) while I repeatedly hung up on them. Finally disconnected the phone after hearing "You don't have to hide now...get out from behind the couch!" What a creep. Am reporting this outfit to the Attorney General's office. I'm fed up!

He asked for either me or my husband and said it involved a pending legal matter, an investigation regarding an individual by the name of ... It was regarding my estranged sister, whom I haven't seen in about 19 years. In fact, I didn't even know her current last name. He gave me her maiden name, then her married name for her first marriage (both names which I knew), and then her married name from her second marriage. Until tonight, I did not know her current, married name from her second marriage. He then asked questions about people he had in his file and who they were, family members, also of whom I've had nothing to do with in 19 to 21 years. I now know my other 2 sisters' married names, too. I told him how they were related to my sister because, quite frankly, I could care less about the jerks. But I did not appreciate getting a call from this guy. I prefer to leave the pain in the past and this just dug it up for me. He also called me at 8:30 pm. Rather late for a stranger to call my home. It's now almost midnight and this whole thing is really bugging me. I have to work tomorrow and can't sleep. This is bugging me out. I started doing research and found that the number is El Cajon, CA. When I did a web search for Charles Martin, Offices of Barrett and Associates, it brought me to this website. Actually, I don't know how he got my husband's name and how he got our phone number. I'm really bugging out over this. At least after coming to this website, I now know that he's probably looking to go after her for debt owed. It must be a significant amount of money for him to go as far as he is? Who knows. All I know is that I will report him if he calls again. I already told him I haven't seen her in nearly 20 years. There's nothing more I can tell the guy about her.

And I don't know how some debt company would have obtained information about her entire family, including estranged family...and my husband?

Still bugging the hell out of me. They may be trying to go after people for debt, but I'm not even the one they're going after and look at what this has done to me. This is NOT right! I think this guy crossed the line contacting me, or my husband. I thought he was calling about a criminal case or something! This is excessive! I'm getting very angry and very upset about all of this! Also, when he called me at 8:30 pm my time, it was 5:30 pm in CA. So this guy doesn't even care about the time difference from where he's calling to whom he's calling! I think I'm going to call him at 8 am my time! I believe he called me from his home.
- LAWS replies to Char| 2 repliesTo the person above - i believe you are being a bit paranoid and making this situation bigger than it is. Companies of this calibur have special licenses to use databases thaat provide relative and associates information on a person that they may be looking for. You were simply a part of that database just like everyone else in the world - its public info from county records. I wouldnt worry about it too much.
The law states that he can call you if he is investigating the whereabouts of an individual and cant locate them or does not have valid contact info. All you have to do is politely tell them you have no information and they will remove your number. If they are trying to find someone i am sure them man would appreciate you at least telling him that much so he doesnt spin his wheels calling you over and over again. Its wasting time for the both of you. He did not cross the line by calling you - he followed steps anyone in his position and line of work would have.
It seems your problem may be with your relative in question not this MR. Martin guy. Last, the law states that he can bcall you from 8am to 9pm in your time zone. Its crazy i know but thats the law. I ran accrossed this site looking for a collection job in san diego. I do this for a living and have been for almost 10 years. This same guy has been calling my family looking for me and they called me thinking that I was in trouble with the law and I haven't even received a ticket in I don't know how many years.
This is some jerk collection agent who is trying to scare family into revealing info even if they don't have any. I call him a jerk because I know in California they have to reveal that they are attempting to collect a debt, and in all cases he hasn't done that when contacting my family. - TheRealStoryIs... replies to LAWS| 1 replyYou make many valid points however the real story is that in the real world many third-party collection outfits do not abide by the FDCPA and work on consumer's ignorance of above mentioned code. This website is rife with complaints of mistaken phone numbers or just even "fishing" for information in a particular geographical area. Many times information is outdated and or useless. I can see calling relatives once to inquire as to the whereabouts of someone, but in fact it is excessively done and just really amounts to harassment. But even if the smart consumer sends a legitimate request to cease and desist, this is no guarantee that it will stop. And yes there are remedies available to the consumer in this event, but on the whole, profit is derived from ignorance.

I have been reading through all these "complaints"..I would argue that anyone who has tried finding a loop hole as well as hiding out to avoid taking care of the obligations that they commited themselves to is somewhat of a "scumbag" themselves. Who is more wrong?.. The person who breached their contract and then hides, or the one who makes an attempt to right the original wrong? How do you feel when you trust money to someone and the don't pay you back..

You're such a lousy actor. Just admit you're one of the seedy "collection agents" everyone is complaining about here. Why else would someone come here and enter a phone number except to complain about unscrupulous activity or to act as a shill for the "collector"?
Go back to your boiler room or you're gonna be short on your hourly phone call quota. - TheRealStoryIs... replies to know what you meanwhen the above mentioned individual calls your family he actually legally cannot state he is calling to collect a debt on an aswering machine or to a third party. This would violate third party disclosure laws as well as your personal privacy. There is a law that states they do need to state its an attempt to collect a debt but only to you once either by letter or by verbal communication on a live call with you. The other law you may be referring to has to do with "fodey compliance" and this company only has to follow this law if they registered their company as fodey compliant otherwise they do not. You guys have to realize that even though their are many laws that protect the consumer from predatory collectors etc there are also just as many laws that protect the collection agency/law firm.

As for "My debt" as you call it, this "Charles Martin" was calling to try and collect on a credit card I never used! Here is the story:
I received a credit card in the mail (after appling online for a car loan) through Orchard Bank. It had a whopping $250 credit limit. I activated thinking "What the hell, small but something I can pay off each month". A couple of days later (I never charged anything on this card) I found out that this card had $190 in annual fees and only had $60 available credit on it. I called "Orchard (aka Household) and told them I didn't want the card and to please close it. They insisted that because I activated it I was obligated to pay back the balance on the card. I refused!
When we finally got in touch with this "Charles Martin" guy, he tried to get my wife to go to his office in San Diego and pay him a $500 payment to start paying off my $2,900 balance. All this on a card I NEVER used! So if you think you can come on here and play the violin for the "Poor bank who put it all on the line for me" and get a positive response...then you really are stupid! - superglam| 2 repliesI just got one of these calls from this Charles Martin guy and I'm so relieved to real all these posts. He left a message saying there's a pending investigation with a relative of mine. Never even heard of this person. But I called and left a message stating just that. What a joke.
