saiad that im getting sued over a check fraud. i called the company he said i owed money and it is all a lie. they r theives!

These people keep harassing my grandparents looking for me.  When I called I wuz told they were investigators and I was facing possible jail time and fines due to check fraud.  The company I owe I haven't heard from.   Who are these people!!!!

They are bill collectors, unless the check you wrote is over a certain amount, they cannot press charges and would have already.  They can file a small claims case against you, granted the statute of limitations is not up on the debt.  Look up your rights in your state, do not admit to owing anything over the phone and when they call ask them for a debt verification letter.  If they refuse to send you one, then tell them you will see them in small claims court.  The court will notify you if they file complaint for loss money, which is not big deal at all, you go to work and work something out with them.  If the statute has passed and you don't make a payment and haven't admitted to owing the debt, they cannot do anything and will not call your bluff.
Most importantly is to ask for a debt verification letter to be emailed to you, and if that is not possible, have one mailed to you.  They usually try to say that the process server is an investigator, that is just a way for them to scare you.  Legally, if they are calling NOW then there are NO criminal charges they can file against you.  They say that but if there were, they would have just filed them and not bothered to try to recover the money themselves. TRUST me! If you owe money to loan place or check casher, you are in breach of contract, not breaking the law!!  There are no debtors prison's in America, and having a check bounce get prosecuted right away, not one, two, or five years later.  The statute in my state is 7 years, ask what year the debt was from first and then ask for your debt verification letter.  If they don't want to send you one, chances are the debt is not valid anymore. Beware that they will lie and say that the statute is NOT up and they will lie and tell you the police are coming for you.  If they DO file a suit in small claims court, sometimes a Sheriff delivers the summons, that is totally normal and has not bearing on the civil complaint other than they are just using the sheriff deputy as a delivery method.  Be smart and look up your rights before dealing with any debt collector.

Our office questioned this firm advertising appearing on their website and on LinkedIn. The advertised claims in question are as follows:

1.Our network and service professionals have the tools and experience to provide our clientele with the most innovative techniques and receivables service that is unmatched by anyone in our industry.

2.This unique approach provides Thomas & Williams, LLC and our family of companies the comprehensive knowledge necessary to communicate, execute and produce results unmatched by anyone in the industry today.

Our office asked for written documentation to support these advertised claims.

On LinkedIn this firm states "we service distressed consumer and commercial receivable portfolios throughout the United States and internationally" and "with over 30 years of collection agency and collection law firm experience, it's no wonder Thomas & Williams, LLC is a leader in the collection industry."

We requested copies of this firm marketing materials used for the various services the company provides. This information would allow a consumer to make an informed decision. We also requested a copy of the collection license for each state this company operated in that would require such.

The company responded by stating "Thomas & Williams LLC is only licensed in the State of Georgia and only operates out of the State of Georgia. Our certificate # occ001053 is on the record with Cobb county! The licensing in multiple states is in our long term Planning process, because as you may or may not know this is a very, very expensive process, and as of this time it's something Thomas & Williams cannot afford. We are a start-up agency that wants to do everything the right way, that's why we sought this accreditation process in the first place. In my previous response I informed you a web site was under construction and should be completed by August 30th, 2011 I will be attaching a copy of our current power point presentation and pamphlet that we have previously used.this information will be sent to your email as an attachment."

As to date we have received no further correspondence and the company website has not been changed.

We received a voice mail on our cell phone and the foreign women speaking said it was regarding a case # and to call back.  We owe for nothing...get these calls all of the time.  Crooks-

Christopher Reeves?  Really?  These scammers love to use actors' names don't they?  Debt is civil, not criminal, so you are NOT going to be arrested.  To threaten to do so is illegal per the FDCPA.  Report the calls to the FTC, the FBI and your state's Attorney General.  Print off this page and give it to your HR Dept to alert them that you are being harassed by a scammer.  If "Christopher Reeves" refuses to mail you (not email or fax) a debt validation letter proving you owe a debt to his agency, then per the FDCPA, you owe nothing.

Next time the joker calls you, tell him that on the advice of your attorney (even if you don't have one) you're recording all calls he makes to you for multiple violations of the FDCPA.  Read about the FDCPA and learn your rights as a consumer.  Even if you do owe money, debt collectors are not allowed to harass and threaten you.
