Just claiming that it was from a Process and Summons Division and to call 701-491-7809. I looked it up and its a number from North Dakota. I live in Ohio. Really??? And when I called the number back I got a voicemail from audix.

Last time we travelled a few months ago our credit cards were electronically charged to some accounts in Santa Domingo. Hope this is not the tip of the iceberg for another scam.

They said I needed to call this number immediately before I received a summons at my home or work. Really!!!!!!!! When I tried to call them back it goes to a answering machine with no name attached and does not allow you to leave a message. I think not and I should know. I'm a paralegal and my son is a cop. THIS IS TOTALLY A SCAM!!!! Do not give these people any information, just tell them you will report them to the police and hang up!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not…

Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.
Use the Telephone to Annoy or Harass
A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer’s name or address on a "bad debt" list is prohibited.
Contact By Embarrassing Media
A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.
Contact a Consumer at Work
A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
Seek Unjustifiable Amounts
A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.
Contact a Consumer Represented by an Attorney
A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.
Communicate With a Consumer After Receiving a Validation Request
If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.
Communicate With Third Parties
A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.
A Collector Says I Will Be Arrested if I Do Not Pay
This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. - anonymousI get the same call at least 3 times a week. Now I just got one saying this was a final notice and will be serving me papers at my job or home, but needed an address to do so. You'd think they'd have that already. Who are these idiots. I don't use checks so how can I have committed check fraud, and when you call the number back all you get is a voice mail. They don't even identify where they are calling from or what company. They just say they are from the summons processing depart. I'm sick on these crazies call my phone all week.

If your callers refuse to MAIL proof that you owe a debt and that they have the legal right to collect said debt, they are owed NOTHING, per the FDCPA. It's also illegal to threaten people with lawsuits to intimidate them into paying a debt. If you're concerned that you may actually have a lawsuit against you, call your local courts and ask them if your name is on any of the schedules. Call your local police - they'll even tell you this is not how the system works.
Advise the callers that you're recording all calls they make to you so your own lawyer (even if you don't have one) can file a lawsuit against them for multiple violations of the FDCPA. Report the calls to the FTC, the FBI, the Dept of Justice and your state's Attorney General. - DleoI got this call yesterday for the first time and on 3 different numbers. First time was at my work, second on my cell phone, third time was on house phone. I called back and spoke with a very rude person saying I was being charged with two counts of fraud by some payday loan company. Said first was breach of contract, second was for owing them money. I laughed at her since I have never had a pay day loan in my life! I told her they were not allowed to call my work anymore or I would be putting in a complaint with the police department, she told me they would call whatever number they wanted to if it meant reaching me. I again laughed at her. I then asked to verify the name of the company she was calling from and the address, she told me I did not need that information, after much back and forth told me they were calling from ML & Associates, looked up the name doesnt exist anywhere. Then told me they would be locating me through a US locator service in the next 24-48 hours to serve me papers. Sorry but if you have all my information you could easily find me through that paperwork they supposedly have! I said good luck with that and hung up. Any way to get these calls to stop? I could care less that they call my cell or house because I can easily ignore those but I cant have them calling my work!!

- SuspiciousI have received several calls from this number, called back yesterday and was told that this was the National Attorney Network, they wanted to verify the last four digits of my SS number, I told them that they should already have that if they are filing a summons against me. She got a little upset with me, she said that I could be anyone calling this number and she could not give me any info if I didn't verify who I was. I then told her to do whatever she felt she needed to do, but I wasn't giving her any personal info since I had no idea what she was calling me for. I then hung up the phone. Since I have no outstanding unpaid debts, I know that they must be trying to scam people.

- Frustrated in TexasI have received the same messages from this number. I called the number and a lady by the name of Michelle Lewis answered the phone, but the voice recordings were that of a man. Needless to say, me and this lady verbally had it out and I informed her that I would be reporting them to the Dept. of Justice, FBI, FTC, and the Texas Attorney General. Then she said, "The FBI really? Well, well, you don't have to go and do all of that we will just remove your number."

They had a very old checking account and routing number of mine, as well as my maiden name (I've been married 4.5 years), and my old employer's name, and the name of 2 references. What gives, do you think they are legit, or is this a "scare tactic" to get me to pay an old debt (that I don't even remember).

- Anonymous| 3 repliesI first received a message from a "Debra Roberts" (972-715-3097) claiming she had "received an order in (her) office today to verify my address and employment to complete a service and process request regarding several legal matters you are currently being investigated for" and advised that I needed to call 713-588-2647 immediately. She provided a "case number" for reference. Michelle Lewis answered the 713 number and also said I was being investigated for check fraud and asked if I took out a lot of payday loans, which I do not. She also mentioned a bank account, long since closed, and said the debt was from 2008! She didn't even know the original amount! She babbled about speaking to some arbitration person to give me a "settlement deal" if I would agree to pay the the arbitrary amount she gave me with a credit card. I laughed and hung up. This is a TOTAL SCAM!! I The next day I received a call from the 701-491-7809 number. These people are unbelievable! I'm reporting them to the FTC and have blocked their numbers on my phone.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
