- Jamie| 2 repliesSo my mother, who's in her mid-fifties, picks up the telephone. She says, "Hello?" and when he asks for a Mark, says "no, no Mark" as she doesn't speak English fluently. This man yells at her to "Wake up! Get a job! Learn to speak English!" I hear all of this, ask her for the phone and politely ask what the problem was. He very rudely drawls, "Yes I need to speak to someone who KNOWS ENGLISH." I told him there was no Mark with this number, as we've had it for two years, and told him to get a life. He rudely continued to insult me, so I said, "Hey, how's this for English? [***] off." and hung up. Called the company back and some lady with a clear New York accent (I live in California) told me she would take the number out of her record book. We'll see if it's true. I posted this on another website so people will know about these fake pricks.

It takes bout 2 seconds to start threatening you with jail and fraud and the IRS and all kinds of garbage. They grossly exaggerate everything and try to scare you into giving them money, like they have a judge standing next to them just waiting to penalize you for thousands of dollars and freeze all your bank accounts and throw you in jail. Lies. All lies.

- Spears| 4 repliesI had a similiar call last night from a Michael Davis. Said he was from Nicholas & Grant. He told me I was going to have a warrant for my arrest issued for felony check fraud and I had to pay him right away or they were filing my case with the district attorney the next morning. He was pretty code spouting off all these penal codes and sections from the state of California laws. After processing all the info I got to thinking about it all and he was way over exaggerating the situation. H just kept going on and on. He even at one point early on in the conversation said he was from the district attorneys office I think. Anyways dont be taken for a ride by these [***]. They are just trying to collect debts and what they were calling me for you cant even be charged criminally for. Watch out for them..Oh and the phone # they gave me when I called it last night after taling to him went to a voicemail box for an Anna. There wasnt even a recording for or about any law firm...SCARY!

What should I do????

- OperatorB replies to EricaThis is a SCAM. They may have information (probably stolen) but they don't have any legal claims. They can't/won't do ANYTHING but try to scare you into forking over money. Don't give them a blessed thing. If they threaten to arrest you, tell them to knock themselves out. Call their bluff.
Tell them the call is being recorded for legal purposes. Tell them you have checked with the State Attorney General regarding all laws and rights pertaining. Demand written verification.
Better yet, just hang up and refuse to answer any calls from this number. If they call from other numbers, hang up.
Remember, this is a criminal extortion scam, not a legally operated collection agency.

Extortion Scam Related to Delinquent Payday Loans (*or bad checks, which is the new scam)

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a pre-paid Visa card. The statement further declares the victim will never dispute the debt.
If you receive these calls, do not follow the caller’s instructions. Rather, you should:
Notify your banking institutions.
Contact the three major credit bureaus and request an alert be put on your file.
Contact your local law enforcement agencies if you feel you are in immediate danger.
File a complaint at www.IC3.gov.
Tips to avoid becoming a victim of this scam:
Never give your Social Security number—or personal information of any kind—over the telephone or online unless you initiate the contact.
Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
Avoid filling out forms in e-mail messages that request personal information.
Ensure that your browser is up-to-date and security patches have been applied.
Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.

- YogiAutomated service call my employer looking for me, threatening that if I don't call them they are going to have me arrested for hot check on a delinquent payday loan. Message was left on their answering machine. I live in Texas. Send me a certified letter threatning me, if you got the cajones. These people are nothing but slime who hide behind their phones harassing innocent people. Love to meet them personally.

They have told me I am being served with malicious intent and check fraud charges.That I have a "rapidly approaching court date" and I need to call them to give them a statement immediately. I just noticed today, thankfully, that the message that he leaves is PRE-RECORDED! I saved the message from the other day and listened to it again after todays message, and its not a live call!! I know for certain that I do not owe any payday loans. I HAVE applied for them in the past, and I think that this is where they are getting my info. Im hoping to be at home and not work the next time they call.

- Irish princess replies to AmandaI started to receive these calls about three weeks ago and it is a recording that says a court date is fast approching and that I should have received a packet that was eitehr delivered to my work or home and I would have to had signed for it. and they needed to go over page 15 of the document. and they also said on the message that my name and phone number they received frm my credit report. I know this is a recording because the guy (who's name is James Grant) says the message the same exact way all the time and he is always running into court hearing even at 9pm at night when the call may come through. I just don't answer it anymore and I know most of the collections laws here where I live as my ex left me with a lot of debt. so I know that they can't collect on a credit card after 4years, forclosure after 6 months etc. trust me I have done my homework this is a total scam.

I was supposedly being sued for $3000.00 but he would accept $ 317.00 if I set it up. The phone number he gave me 716-242-8634 X107. Once I got off the phone I called the number and got an Anna Smith's voice mail. My daughter called the 800 # and got the same person's voice mail. SCAM SCAM SCAM

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Something about check fraud or bad check. We haven't wrote checks in years. And like you, when I called the number after hours, it went to a voicemail box to a woman and not a business. They ARE a scam and unless they submit something to me in writing, I/we will ignore all there calls and idle threats. I have never ever recieved a letter regarding this matter from whom they claim is making the false check accusations. And haven't dealt with that company in years. They are just group of people who buy peoples information or somehow get peoples information. Another 'so called" collection agency contacted me about a debt against me from a company I haven't dealt with in over 2 years. They had my bank account information and took it upon themselves to take over $400. I contacted my bank, had the charge reversed and now they are ticked. The transaction was NOT authorized by me and I can GET them for fraud. If you have any questions regarding this or any other so called collection agency, contact the BBB and state attorney general office. There are specific laws/rules these companies must follow and if they don't then they ARE a scam!!!
