We've received a number of these calls over the past 6 months.  My wife finally called back last night and talked to woman.  She had tried to call on one other occasion and received a recording with no real information on it.  These A-clowns then gave her a hard time after she found out this so called debt was for a person who had had our number over 3 years ago and when she started to fight back they hung up on her.  She called right back and yelled at the human operator that answered the phone who then hung up on her.  About ten minutes later she called back and asked for a supervisor and explained what happened and they told her they would remove our number from there list.  So feeling like she had finally found a freindly person there she requested a letter of apology from the woman who hung up on her and was told she'd get one when hell freezes over and he hung up on her.  So after reading all of these posts I think I'll join the group and go to thee BBB and the FTC and seeing as these tactics are illegal I think I may get some where.  Here is some more information on this group:  They are part of SITEL Risk Management based in Omaha Ne and the CEO's name is Michael W. Fletcher and second in comand the President and COO is Roger E. Carney.  So here are a few true names to pass on.

NATIONAL ACTION FININANCIAL has the rudest and MOST uneducated employees working there. I have been receiving calls for 2 months. I have called back their number only to be treated nastily and with attitude and told that I AM THE ONE WITH THE ATTITUDE. Well, YES, perhaps I DID have a bit of an attitude since I KNOW I DO NOT OWE ANY CREDITORS (Shiny 730 Credit Score) and have NEVER defaulted on ANY PAYMENT.
Last month when I called I was told the debt they were trying to claim was from a Talik Stewart (or Stuart). I told these jerks OVER A MONTH AGO NO Talik Stewart Lives here. They are simply going by a phone number AND NOTHING ELSE.
They TOLD me that they would REMOVE THE # from their lists.

TODAY, 11/27/07, I receive a message from a different phone number than the one that previously called and , BY LAW they MUST send NOTICE of ANY of their claims, BY MAIL, within 30 days of calling. I have NOT received any letters here at my residence.
I called today and an Mr. Martinez answered, I said (verbatim since I RECORDED EVERY CONVERSATION) "This is the second time that I am calling you guys to tell you to stop calling my house, that you have the wrong people and YET, you're still calling me house."
HIS RESPONSE: " Well, I'm not YOU PEOPLE for ONE"
MY RESPONSE: " Yes YOU are, you work for this company"
HIS REPONSE: " NO I'M NOT YOU PEOPLE MA'AM & I'LL be happy to help you if you calm down a minute I can take care of it"
MY RESPONSE: "This is the second time I have HAD to take care of this. I gave my phone number last time and TOLD them the person you're looking for doesn't live here and they told me it would be taken out of your computers"

(NOW MIND YOU, I AM NOT YELLING, I AM SPEAKING)

HIS RESPONSE: MA'AM ARE YOU GOING TO CONTINUE TO YELL, BECAUSE I DON'T HAVE TO LISTEN TO THIS. I'LL BE MORE THAN HAPPY TO HELP YOU OUT, I'LL BE MORE THAN HAPPY TO HELP YOU OUT (Yes, he said it twice like I'm deaf or hard of hearing)

MY RESPONSE: " YES I'M SURE YOU WILL BE MORE THAN HAPPY TO HELP ME WHEN I FILE A SUIT AGST YOU FOR CONSTANTLY CALLING MY HOUSE AND HARASSING ME"

HIS RESPONSE" RRRIGHT... ARE YOU DONE, ARE YOU DONE (I am not talking now so I'm beginning to think this moron has a stuttering problem or maybe a tic that makes him say things 2 times, LOL)

MY RESPONSE: Are YOU done?

HIS RESPONSE: "YES, HAVE A NICE DAY' AND THEN HE HANGS UP
(Which seems to be NATIONAL ACTION FINANCIAL'S WAY OF "HANDLING" people.

I Did

I CALL BACK AND GET THE SAME MORON Mr. Martinez

MY RESPONSE: I WANT YOU TO STOP CALLING MY HOUSE

HIS RESPONSE: WHEN YOU TALK TO ME THE WAY YOU TALKED TO ME MA'AM I DON'T KNOW WHERE YOU WANT ME TO GO WITH THIS IF YOU'RE GOING TO CONTINUE TO TALK TO ME THIS WAY. I WAS IN THE PROCESS OF FIGURING OUT WHAT HAPPENED
(Does ANYTHING I said above constitute being RUDE or nasty? NO, THEY have been calling MY house HARASSING ME)

MY RESPONSE: OK, FIGURE OUT WHAT HAPPENED

HIS RESPONSE: "AND THAT'S WHAT I'M GOING TO DO, HAVE A NICE DAY"

AND THEN THE STUPID MORON HANGS UP AGAIN SO AM I MAD NOW, HELL YEAH I AM!

I CALL BACK and get MATT on the phone this time

MATT is NOT too bad but still a jerk nonetheless

MY RESPONSE: I would like this company to STOP calling my house. I would like to KNOW HOW to get them to STOP calling my house

MATT'S RESPONSE: OK, LET ME FIGURE OUT WHAT THEY ARE CALLING, WHAT WAS THE NUMBER THEY CALLED? THE NUMBER THAT YOU ARE CALLING FROM NOW THE 24^-&*()

MY RESPONSE: YES, THAT'S THE ONE. I HAVE CALLED ALREADY AND INFORMED THEM THAT THE PERSON YOU'RE LOOKING FOR DOESN'T LIVE HERE AND NEVER HAS. I WAS TOLD THAT MY NUMBER WAS TAKEN OUT OF YOUR RECORDS ONLY TO BE CALLED AGAIN TODAY AND YET, I KEEP GETTING PHONECALLS FROM YOU FOR ANOTHER DEBTOR THAT YOU KNOW DOESN'T LIVE HERE. TALIK STEWART DOESN'T LIVE HERE.

HIS RESPONSE: OK, MA'AM, CALM DOWN, HOLD ON, I HAVE TO FIGURE OUT WHAT FILE THIS IS FROM AND THEN I CAN TAKE THE NUMBER OFF.

MY RESPONSE: THAT'S WHAT THEY TOLD ME LAST TIME

HIS RESPONSE: WELL I'M NOT THE ONE WHO CALLED YOU SO DON'T HAVE AN ATTITUDE WITH ME

MY RESPONSE: WELL YOUR COMPANY DID AND I CALLED THE NUMBER BACK AND I GOT YOU SO, IT IS YOUR PROBLEM.

HIS RESPONSE: ALRIGHT MA'AM BUT I'M NOT RESPONSIBLE FOR WHAT MY COMPANY DOES. I'M RESPONSIBLE FOR WHAT I DO.

MY RESPONSE: JUST TAKE MY NUMBER OFF OF THE COMPUTER

HIS RESPONSE: I SEE THAT THEY ARE TRYING TO REACH A TALIK STEWART. I ILL TAKE THE NUMBER OFF AND IF ANYONE ELSE CALLS MAKE SURE YOU "POLITELY" CALL THEM BACK

MY RESPONSE; I DON'T HAVE TO "POLITELY DO ANYTHING WITH YOU PEOPLE. I HAVE NEVER BEEN TREATED "POLITELY BY ANY OF THE PEOPLE AT THIS COMPANY AND I TREAT PEOPLE THE WAY I AM TREATED SO IF YOU WANT POLITENESS, YOU BETTER BE WILLING TO RECIPROCATE. THIS CONVERSATION IS BEING RECORDED AND IF I RECEIVE ANY MORE CALLS FROM YOU I AM GOING TO SUE YOU.

(NOW I'M BEING TOLD TO BE POLITE WITH A BUNCH OF APATHETIC MORONS WHO ARE CALLING MY HOUSE IN ERROR OVER AND OVER AND OVER AGAIN)

Do you know as soon as I hung up the phone THESE SOB's CALLED BACK!!!

716-650-6240 This stupid bi*&^ was a real person! I told her off and told her to NEVER call me again and SHE called me right back. I HAVE THIS RECORDED TOO! I had s few choice words for her when she called back.

Needless to say... I called back to get a supervisor who, as I was talking, was holding down the buttons on the phone so she couldn't hear me (YES, THAT WAS RECORDED TOO).

I called back, got another moron, and asked EVER SO SWEETLY for the physical address of the company. She told me she had to look for it (OMG THEY DON'T KNOW WHERE THEY WORK EITHER?? THEY MUST BE MORONS)

She came back and asked me WHY I needed it. I told her that I should be able to have the address of the company that continues to call my house without reason. SHE HUNG UP ON ME.

SOOOO.. they screwed with the wrong person! I am filing a lawsuit bringing along all of the phone records with 30+ calls since September 2007 and the phone recordings TOMORROW. I am tired of these IDIOT companies thinking they can HARASS GOOD PEOPLE.

The recordings will continue so now I DO hope they continue calling because each time they do, they are breaking the law.

That's amazing.  Good for you.  Please keep us posted as to the results of your judgement.  This company has been harrassing me as well.  Calling my phone at all hours of the day and night.  I've told them time after time that they have the wrong person, they have also told me that they are going to remove my phone number from their system, only to call me again the very next day.

I've had just about all I can take from this company.

Just send a C&D and they'll stop calling you IF the debt is legitimatly NOT your debt. There are laws that they're supposed to follow and if you can record the conversations with the threats as I have in the past (mind you, they were looking for a Talik Stewart) you have a great case of you want to take them to court. my atty just drafted a C&D and no more calls. Ahhhhh! probably will do the same for the disgusting tranny CHRISTINE RADTKE that seems to like to hrass people she buys from on ebay ;o)

C&D is short for "Cease and Desist". Here is an example:

Today's Date

Collector's Address

Mr./Ms. Collector,

I am writing in response to your constant phone calls!

According to the Fair Debt Collection Practices Act,   [15 USC 1692c] Section 805(c): CEASING COMMUNICATION: You must cease all communication with me after being notified in writing that I no longer wish to communicate with you. Therefore, I demand that you stop calling me at home, at work, on my cell phone or at any other location!

In accordance with the federal FDCPA, now that you have received this "stop calling" letter, you may only contact me to inform me that you:

are terminating further collection efforts;
invoking specified remedies which are ordinarily invoked by you or your company; or intend to invoke a specified remedy.
Be advised that I am well well aware of my rights! For instance, I know that any future contact by you or your company violates the FDCPA and that since you already have my location information, calls made by you or your company to any 3rd party concerning me violates section 805(b)2 of the FDCPA.

Be advised that I am keeping accurate records of all correspondence from you and your company, including tape recording all phone calls. If you continue calling me I will pursue all available legal actions to stop you from harassing me and my family.

Ha Ha Ha Ha Ha! I like how you said that you didnt yell at them, but you typed in caps. Typical. You loser, you will do nothing. Your puny little law suit wont even phase them. Nafs collects about 15 million dollars every month! I'm sure your little $1000 claim of harassment has them shaking in their boots!!!!!! Wake up people!!!

Sounds like your the moron to me! Do you realize that NAFS can be sued for the amount they say that is owed and each person that has called and harassed you at home can be sued?  And who doesn't yell back at someone who is being a complete a-hole on the phone. Every one of those people at NAFS are complete pieces of you now what!!  Sounds like you must be one of them!  I do work for collections too but I know the laws and know that what they do is totally against the law, sooner or later a giant can fall! Enough law suits against a company can put them out! Wouldn't be the first time a collection agency went out of business.

Let them violate the law and it can help you.

I would check your credit report first, with all the ID theft now days you never know.  If nothing shows up and you want the phone calls to stop, answer the phone next time.  Tell them wrong number weather its your name or not, but thats up to you and your curiosity.  Some times they can get same names but not the same person.  They should verify they have the right person, they can verify by the last four of your social.  Most of the time they will want you to give it to them. With these scumbags at NAFS I would never give them your info! Ask them what they have, if they dont want to tell you the last four they can tell you the last 2 if not a match its not you. Then they must not call back or you can sue them for harassment. And from the look of things thats all these Scumbag collectors know how to do is harass people... they are idiots who cant get another job!!

It is the LAW they have to tell you there name and the company they are calling from. But you do have to ask them what company, they dont have to tell you if you dont ask, but they do have to tell you there name even when you dont ask they are supposed to tell you their name (first and last).

These stupid bastards called me today looking for my brother-in law and my nephew. When I called them back they were extremely rude as can be. Hung up on me 3 times. They used two different numbers 18006941113 and  17166506240They wanted to know where my borother in law was. I told them I didnt know. Of course I do know but I will be damned if these scumbags are getting any info out of me. Considering the guy just got out of the hospital after being there for two months because of bleeding in his brain and has some permanent brain problems as a result these skanks wont get whatever money he owes them. If they continue to call me back I too will file a lawsuit. Bunch of lowclassed thugs cant find any other way to make a living because they are to freaking stupid!!!!

my question is if they buy old collection debts from charged off accounts,do you have to pay them? I thought there was a time limit after which you didn't have to pay old accounts that were from a differnt creditor anyway. I don't mind paying the people I owe but why should I pay a third party that bought the account from the people I "did" owe, if the patment isn't going to them?????

Rating: +1 Amy - 2 May 2008
I have received about 4 calls from these collectors as well, and have to laugh at the audacity they have in what messages they leave.
There is a time limit to these collection accounts, I think, 5-7 years. Let's say 4 years go by, and you decide to pay the account then. Now it will be on your credit report longer because it starts the whole cycle again. So it depends on how long this has been in coolections for you, and whether you should go ahead and pay it or not. If it just went into collections, and it is verifiable that it is your debt, and shows on your credit reports, then I would pay it offf, keeping all receipts possible.
Still, as the debtor, you still have rights, and they have to follow laws. Best of luck to you.

after 10 years, in most states they can't sue you for a debt
 Reply
Rating: +2 Skeeter - 13 Jun 2008
Some states less than that, depending on the Statutes.  Also, many of you have caller ID or call block - USE IT.  I have saved all those numbers and compiled them into a group called "crap" with a special ringer called "silent".  Now, I don't hear those incoming calls any longer. It even works on "unknown caller" calls.  I assign a number to it and save it into my "crap" file - works like a charm!!!!

It is a debt that you owe, unfortunately, but some collection agency's ARE willing to help.  You can do a settlement with most of them.  Also there are limits on the laws, after so many years you cant be sued.  However they can try to collect for as long as you live basically.  It depends on your state laws on how long it can go before they run out of time to sue you.  I would suggest looking up your statue of limitations for your state.  If you want to pay off your debts and clear up your credit call them up see if they are willing to settle. Gets all your debts together, see how much you have to spend.  Most of the time the older the debt is the lower settlement you could get.  Debt collectors usually work on a commission so they want money too, we get paid squat! The nicer you are the more they are willing to work with you, remember the old saying of catching more flies with honey, it usually works.
