    I keep getting this number on my cell phone. It leaves a message- it is Jim -from 1St National Recovery. He says I need to call 1-888-999-7389 because of a pending matter or a possible legal violation. If I don't call they will take it as a refusal in this matter by me.I have not had a credit card in almost 10 years. I had financial problems and had to seek an attorneys help. I don't know how they got my cell phone number either. I was told not to answer these people. There is a statute of limitations on these debts. There is in my state. I am not trying to get away without paying. I paid for years on accounts I was able to thru my attorney. I was told once you contact these people the clock can start all over regarding these debts. My attorney said not to worry about it. If they want to sue let them go ahead. I used to get calls in the middle of the night. They would call relatives. I would tell them I was having financial difficulties. They weren't interested. These are not to owners of the original debt from years ago. They tacked on so much interest and other fees it would be impossible to pay. After years a $3000.00 debt is now $21,000. Has anyone else been contacted or had dealings with people like these?

    I have recieved 2 phone calls on my voice mail from this number, but it was from "Jeremy" of 1st National Bank.He said to contact him because I needed to give a statement reguarding 2 violations from ...(my ex-husband's name). Then he left a case number to identify myself with.  I have had nothing to do with my ex-husband since our divorce 4 yrs ago and our divorce decree states that I am not responsible for any of his debts.  What do I do? Do I call this person back and declare that I am not responsible and offer to send a copy of the divorce decree or do I just ignore it and do nothing.  Any correct advice would be appreciated.

    Peggy I to recieved calls regarding my ex husband . I chose not to return jeremys calls and was eventually served with a summons to appear in court . Apparently it was regarding a claim from an old creditor that I didnt realize was included in my divorce decree . My wages are currently being garnished at 11%.The balance went up several thousands of dollars because attorney fees and other court costs. I wouldnt let the same happen to you definetly call and straighten this out before he makes his recomendations.janice from utica

    After reading these posts I get the feeling that "janice from utica" is actually from the company in question.  My guess is they googled themselves and are trying to repair their (albeit criminal) image.  Her post really doesn't make sense and sounds more like a scare tactic to get people to buy into the company's scam.  I hope someone someday has the opportunity to force these criminals to emotionally pay for their actions.  Why would she have to pay for her divorced husband's bills?  She makes it sound like once this person makes their "recommendations" that it's all over with.  I'm not positive, but isn't it illegal to add interest to a charged off or sold debt?  My family received a call from these people.  I've never personally received any information about any bad debts.  That tactic alone says these people are shady and dishonest.  I'm checking with a lawyer.  What do other people think?

    They are lier's and theif's.  They buy debt's for penny's on the dollars.  I just had them call a relative and say they are law enforcment officer's.  Now that is down right dirty and unlawful I think.  I'm disabled and they don't listen to anything you have to say; they think everybody is a lier when in fact they are the lier's. I think that the federal goverment needs to put a stop to these practise's.  Allowing unlawful call's and lie's be tolded.

    I received a phone message from a Mr. Morgan of 1st National Recovery, 888-999-7389, asking for a Jeffery Longerbeam.  He gave a case number and urged a return call so he could make recommendations.  No such person lives here.  My machine message gives my last name and it's definitely not Longerbeam.  I guess the guy wasn't listening or is just plain stupid.

    This company called my sister's in laws parents and said he was a PI and that I had charges filed against me. This man, who would not give his name or the agency in which he worked for, went on to give, what he thought was accurate details about my family. His downfall was that he did not even come close to dates and activity that he thought would SCARE the person he was calling. Nice try butt munch, but not good enough! Little did he know, that I too can do a google search and get phone and name information. This  company works through lies and deceit. No one person especially a collector, has the right to use this kind of deceit. Don't be bullied by anyone like this. Karma has a way of coming back around ten fold.

    Under Federal Law, it is ILLEGAL for a collection agency to threaten you with an action they have NO intention of taking:

    § 807.  False or misleading representations  [15 USC 1962e]

    A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

    (1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

    (2) The false representation of --

    (A) the character, amount, or legal status of any debt; or

    (B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

    (3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

    (4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

    (5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

    (6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

    (A) lose any claim or defense to payment of the debt; or

    (B) become subject to any practice prohibited by this title.

    (7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

    (8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

    (9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

    (10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

    (11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

    (12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

    (13) The false representation or implication that documents are legal process.

    (14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

    (15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

    (16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

    Get a lawyer Susan!
    Hey Susan you need a lawyer. You might be able to get back the money you sent these scumbags. Check naca.net for lawyers with experience in this area of law. As Alfalfa said it is ILLEGAL for collectors to threaten you with actions they cannot or do not intend to take. Of course if you didnt record this prior phone call you will have a hard time winning. But talk to a lawyer anyway since it is usually free.

    From now on know that NO one can garnish you without going to court first. The only exceptions are the IRS and student loans. Even then you must get written notice first and an opportunity to respond. That is called Due Process and it is in the Constitution. Also for anyone getting collection calls on their cellphone know that the TCPA, 47 USC 227, forbids these calls unless you provided that specific number to the original creditor. This includes the recent FCC statement in February regarding this law. You can sue for $500 PER call or you can file a complaint with the FCC and let them handle it (no money for you tho).
    Dont let these scumbags run all over you. Fight back!!!

    What is interesting to me about this company is that i received a call yesterday intended for my brother, who lives on the other side of the country. Some chap named Daryl left a message, and a file number, which i have not yet forwarded on (and really have no intention of forwarding).

    I received a second call this morning from the "law Offices of Mitchel & Kay" with a similar format, left a number, and file number (different from the first). It got me thinking that neither sounds really legitimate to me.

    I also agree that the lady from utica sounds like a planted message.

    I got a very official sounding voice mail from Tracey Silversteen (sic?) a mediation officer in the legal department of First National about pending matters in the state of California.
    The funny thing was the call was for my little sister that I have not spoken to in years.  At least I know she lives in California, I live on the east coast.
    At least now I know not to worry if my little sister needed the message.  If they call back I'll let them know I am a dead end.

    I received the same call with the same "bull" from 716-651-2250.  One, I have a family member who works for the government and pretty much everything that comes out of their mouth is a lie.  I'm told they read from a script and inform you (the very first time) they've exhausted all their resources and will now pursue legal matters.  One thing you can do is go to the gov do not call website and immediately register your number.  If you are registered, even better.  File a complaint.  The more complaints they receive regarding this telephone, the more of an impact it will make.  If you're just registering your number, you'll need to wait 31 days, otherwise, file your complaints IMMEDIATELY!  Everyone who has posted...do it! You can also keep a record of the calls, a copy of the detail call report of your phone/cell phone record to further be more credible.  For the post from "Janice", she's an obvious employee.  If the creditor is serious, they'll file papers with the local court for a judgement..PERIOD!  They won't come after you & make all the nonsense calls as this company does.  Old claims from old debitors are sold and the new companies that buy them use one of two ways to get the monies back.  1) They'll issue you a new credit card, with a new limit and your available balance will be minus what they bought the debt for 2) They call and indicate they're from a law firm, attorneys office, etc. and try to force you to give in by contacting you, your family members, work, etc.  Remember, it is illegal so you can file a complaint.  Another good thing to so is record your calls.

    They called my inlaws and left a message today, 3/30/09, that I needed to call with verification of my social security number. They think they're sneaky in finding a number with my husband's name. [***] can't seem to tell the difference between Sr and Jr though. It will do you no good to continue calling my inlaws. My father in law will not be a pleasant person to speak with. My advice is to stop calling the wrong number.

    I received a call from this number yesterday, Aug 4 from a woman named Lauren stating that my office has documentation with my name and SS#. I have never received any coorespondence from this 1ST National company and I believe it is bull. I am saving this message and hope that nothing more comes of it.

    Our company received a message from 1st National Recovery today regarding someone we don't know.  The name given that they were contacting sounded very common.  I'm not sure what they want, but we will not call them back.  After reading everything here, I can tell that both the person identifying themselves as "s" and "janice from utica" are plants, and pathetic ones, at that.

    Our struggle is with putting our number on the "do not call" list.  We've done that probably half a dozen times, and yet we still get junk calls like this, and various telemarketers.
