- Angela| 7 repliesRecieved call from this company First Legacy Asset Management, was threatened with papers being served to me on my job regarding some payday loan I took out(which I'm not aware of). I told him that I was not aware of the debt but the guy continued to talk over me insisting if I don't call this number and make arrangements for payment I would be served. I just asked that he no longer call my place of employment and hung up. Not even a minute later, got a call from a blocked number from some guy from H & Y Process Servers who said he was assigned to serve me "papers" on my job. I preceded to ask his name, his company name and my information such as my employment address and etc. just to see what all he knew. Needless to say, he didn't have any of the answers. So I told him Ok, he said are you sure you want me to do that, it will cause you embarrasement because I will need 2 witnesses to sign besides myself and the officer I will have with me for my safety. I was like ok, I'm up front and I can get two people, how soon will you be here. He was like in about 30min., do you want me to call before I get there. I said you can or you don't have to, I'm going to be upfront, it's your choice. He then just says ok and hangs up. It's now going on a hour since the phone call and no "process server" is here yet to serve me these bogus "papers". What a sorry hoax!

- Angela replies to Angela| 2 repliesPlease don't let these people threaten you into believing they can perform any type of legal action on you regarding a payday loan. I hate these type of collectors, because whether the debt is valid or not, they prey on the elderly or less educated and sometimes really get results because people are scared which is just not only legally but morally wrong. I have gotten calls from family members actually scared because one of these head hunters has called their jobs threatning to serve them "papers", which if it could happen could cause total embarrasement or even job loss. That's horrible that anyone tries these tactics to collect a debt. Have they thought of the good old fashioned way of actually talkig it out and learning a persons situation before resulting as low as threats. They may get better results, because I'm sure 85% of consumers who use payday loan companies, don't get them with the intentions of not paying it back, it's just certain circumstances come up. These people will get what's coming to them and if you are able to, sue the you know what out of these people for harrassment and illegal collection pratices, because I will.

I too received a call from a Process Server.... He was nice enough, but said to call the company at the "716" area code number and have them send him an R16 release that this was taken care of.

- Karen| 1 replyOn 10/27 I received a call at work from "Robert" who said he was an attorney with FLA and said that I had not responded to his calls and that it was a matter of urgency that I contact him. I had not received any previous calls so I looked up the 877 number (877-405-4615 ext 103) and found out it was from a debt collection company in Buffalo NY. I send a FAX (716) 725 6654 stating they are not to call me at work and since they were a debt collection company to send verification to my home address and provided that address. I also informed them that they have violated the FDCPA - which they obviously did by insinuating they were attorneys and I would be reporting them to the Texas State Attorney General and to the FTC. No sooner did the FAX go through but "Joe" called my office and since I was on another call it rolled over to a co-worker. Joe was less then friendly and when she transferred him to me he was not on the line. I found the number and called and was put through to 'Joe" who claims he was not the "Joe" that called but told me that he did not need to verify anything with me, it was a 'stall tactic' for people who owed money, etc. I still have yet to hear what the debt is in relation too. Eventually he told me it was a payday loan that his company had bought but that was all the information he provided. Joe was less then pleasant. He said he didn't care if I was going to contact the Texas Attorney General, he was sending papers to a 'lawyer' in Texas to sue me. I don't know what he is suing me for but my lawyer will figure that out. I don't know why he doesn't use his "ATTORNEY" Robert. I told him to send me verification and he again refuses. He said he would give me until noon tomorrow to settle the debt or he would make it his PERSONAL MISSION to see that I pay in full....pay in full for a debt that has no name or originator. I will remind JOE that section 809 Validation of Debt (FDCPA) states that I must be informed within five days after communication (which is today) as to the nature of the debt, amount, creditor and also 30 days to respond.. Apparently Buffalo is not subjected to the Federal Law. Anyone that has been harassed by this company file a complaint, remind them of the FDCPA because it seems to upset them. You have rights as a consumer and you do NOT have to tolerate being "BULLIED" by unscrupulous debt collectors. Since Joe Bish seems to think he need not follow the rules, I am posting this comment as proof of our conversation and will report back in FIVE days as to the verification documents I have received from Mr. Bish and First Legacy Asset Management.

- KarenNot sure if anyone who is receiving these calls lives in Texas but I just checked the Secretary of State web site for First Legacy Asset Management and they are not bonded in Texas, which means they are not able to collect debt in Texas, which means you need to file a complaint with the AG, FTC and the NY AG as well.

- YEAH RIGHT replies to Karen| 1 replyTo the last "Karen", you aren't fooling anyone. Your scam is being exposed and your company being investigated by the Attorney General in more than 4 states. Under FDCPA, each and every violation is punishable by $1000 for the company AND $1000 for the collector who violates the law. Each and every time you call me at my office after you were notified in writing has been documented, recorded, and my file is getting very thick. I will enjoy the day I take you to court, and I actually DO have an attorney.

United process servers, inc. 800-396-9995 located in Santa Barbra, CA. This is a good company but may be using there name in another state. I have been a P.I. and Process Servers for 30 years and these people who call are fake. One name is Pat Miller. Company does not know him. Google business name and check website out. No process server is going to call you and let you know that you are going to be served. Per the contract you sign and leaving phone numbers for them to call you at, you are allowing them to contact you there legally. If you dont want them to contact you at work, pay your bill and you won't have to worry about it. I on the other hand have dealt with this company and they helped me out immensely. Stop whining and pay your bill. oh and any real attorney is not going to tell you not to pay your bills unless he got his bar from a cracker jack box. Stop using stall tactics and pay your bill. Let me know how it goes when you go to court and they garnish your wages to pay the bill.
