- Somebody replies to Rick| 5 repliesYou wont go to jail for this. Debtors prison went away YEARS ago. The only way you'll go to jail is if you violate a court order. Meaning if they actually do get you in small claims for the miserable 400 dollars you borrowed or what not, and you dont show up when you're asked, you'll be arrested on account of not showing up to court but never for NOT paying a debt. Just show up to court, do it legally and right and they can do NOTHING about it.
If they call you and threaten you, harass you, tell you that they're gonna take your HOUSE away, its all lies. Further, if they are bothering you to the point where you cannot function, you can stop this by filing a complaint with the FTC @ http://www.consumer.ftc.gov/articles/0149-debt-collection
Dont be afraid. Sometimes people go through hardship and they INTEND on paying, but just cant seem to do so.

Somebody - Nope... replies to SomebodyYou won't be arrested simply for not showing up in court. If the alleged debtor doesn't show up to contest the (likely fraudulent) claim, a default judgment may be awarded. Plus, the debt collector has to mail proof that the alleged debtor actually owes this money to them. Just because someone calls and says you owe doesn't make it true.

If you don't show up they win by default and are issued a judgement against you. You then tell them you are not going to pay the judgement and there is nothing they can do about it. If you do show up and the debt is past the statute of limitation for your state the judge Will dismis the case.

- JenniferAlways, ALWAYS: Ask them to provide a bill of sale on the debt to prove that they actually own it, proof of the debt and the amount, and check the dates as the statute may be expired.

- ambie replies to SomebodyAlso, it is illegal for them to threaten you with jail time, getting arrested, or take something away from you. Remind them of that. Also ask when the last payment was made, it may have reached the statute of limitations and be time barred from from legal action anyway.
- JCI didn't answer, and they didn't leave a message. but i had 2 capital 1 accounts that were charged off about 3 years ago. i was going through some hard times.
on the 1 account they got a local attorney to take the case. i replied to there 20 day summons. stopped them from getting a default judgment. but they ended up getting a judgement for $600. after several letters back and forth through the local court.
capital one is getting more aggressive. - bobcontinual daily calls even though each time I do speak with them they admit wrong number

- KPH replies to SomebodyActually you won't even go to jail on the court order of payment. The only thing a creditor can do, by law, is get a judgement against you. The judge will grant a court order saying you owe them money, but cannot make you pay that. You will not go to jail or anything for not being able to abide by that kind of judgement. It will stay on you until you either pay it or file for bankruptcy. That is it. If you have property or something of that nature, they may could get a lien on it, but other than that, they cannot force you to pay the judgement.
