- Really| 2 repliesoriginally a 200 debt w/capital one in 1997 now the debt has become $6000 in 2014,account has been sold to numerous collection agencies but Portfolio Recovery has been the most anal, my question is, if the $200 debt couldn't be paid in 1997, do they really think $6000 can be paid in 2014 or a settlement of $3000????? R-E-A-L-L-Y, don't think so, if anything the original debt I will consider.

- Alfalfa replies to ReallyThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - ElbMissed 2 calls - called back and a very cordial man answered I explained I get a 100 calls a day for the deadbeats that had my phone number prior. He said he couldn't look up by name because they are nation wide and have thousands of accounts, didn't identify the agency, but when I asked if this was "Solicitation or collection" and he said neither so the "car repo company" that others are saying does fit his response.

This is a landline so block your number *67 and dial and message away (unless the phones are forwarded to a cell and someone answers). They specialize in repossessions and if you are a reference...they will call. Tell them you don't know anyone by that name. Remember, your consent wasn't asked for when you were listed by the person buying the car. I know that a third party collector CANNOT threaten, intimidate or harass at work. Writ a letter I couldn't find an email) telling them to cease and desist harassing yo at work or you will be fired. By law they must stop. But that doesn't stop them from calling home. Of course if your wife/significant other runs a home daycare from 8:00 am until 9:00 p.m., the same applies if written it disturbs her business. Debt collectors can't call before 8:00 or after 9:00 pm.
Tell them this is all according to the FairDebt Collection Act. The problem is that there are different opinions about whether repo men have to follow FDCA, but I do know the letter stops the calls.And if you are not the intended party,he isn't supposed to give any info at all! Or you can try one of the google apps that says what you want it to and hangs up heh heh.
If it is your repo keep it in the garage. I had a friend ldrive his car two years until a pissed off girlfriend parked it in a handicapped spot and got towed away....forever. Last course of action is to come out as they arehooking up your car, preferably with someone else and YELL at the top of your lungs "BREACH OF PEACE over and over. They must take the car peacefully. I knew someone who got in the car. Repo man said he would call cops to remove him so he got out. Big fat lie. Cops will come to be sure car is going peacefully, but wont remove you from vehicle so no repo. 4347697041486173- Caller: DelMarRecover Solutions

- Don't know anyone named Brandon!Caller asked for me by name. I asked who the caller was. Someone named Frank Harris (or something like that). Asked "Who are you, Frank Harris?" Seemed to think I had no business asking that question, at which point I informed him the person he wanted to speak to didn't know anyone named Frank Harris, so...yeah...do indeed have a right to ask. At which point he asked for someone named Brandon. Don't know anyone named Brandon. Not related to anyone named Brandon. Told him that. Hung up.
Fellow called back a minute later. I answered with, "Calling me again? What is your problem?" At which point he told me I was a very rude person.
REALLLY???
It is really disturbing that this gentlemen knew MY name, then wanted to speak to someone else I do not know. When I checked the number online and saw that it is a debt recovery service, I'm not sure what to think. I understand some sleazeball dodger who never intends to pay a bill giving someone a bogus telephone number, but in this case the caller addressed me by name. Did the company do a search on my telephone # and purposely ask to speak to someone associated with the public telephone listing? Or is someone out there purposely using my telephone #...and my name?- Caller: Del Mar Recovery
- ICEThe caller was very rude. Definitely looking for a relative but could not tell me for what, so I simply advised that I could not relay a message from someone I do not know for an unknown reason. Simply asked them to loose my number.

- R10ROTT replies to ReallyCheck the laws of the state you live in. There are statutes of limitations. If the debt is over that time period, they cannot collect unless you acknowledge that you owe the debt. If you have stated that you owe the debt, the time period starts over from that day.
- KarenI received a call from this number on 8-5-14 - it was a woman asking for Juliano. I told her she had the wrong number. I hung up and didn't think any more about it.
I just got another call from the same number today, 10-16-14, which went to my voicemail. A guy called Timothy left a message for Juliano saying it was about case number 97180 and asking him to call him back at 760-476-4125. I called the number and Timothy answered. I told him that this is not Juliano's number, I have no idea who that person is, and furthermore I already told that to his female colleague who called me on 8-5-14. He just said "that must have been from a different company ma'am" - which is crap, cuz how can 2 people calling from the same number asking for the same person be from 2 different companies? He said they would not call my number again. We'll see if they keep their word!
