- Jim KA$$holes keep calling for Ariana Starks! Keep telling them no such person at this number! We have no rights! I have repeatedly told them my name and asked for them to stop calling, the national no call registry is a joke, and if I threaten them then I get in trouble. Contacted a lawyer but can't do anything because there is not an individual to go after, they call illegally from a basement in a home so no ties to the company. If anyone has any other suggestions that work please tell us, I am getting tired of 6am phone calls for the [***] Ariana Starks that committed fraud and gave my number.

Well you have lots of rights. The DNC does not cover debt collectors. It was never designed to do that because first they are not selling anything over the telephone (telemarketing) and second DC's have their own special law called the FDCPA, and in this case you would probably have a TCPA cause of action as well. "Contacted a lawyer but can't do anything because there is not an individual to go after," I guess you need a new lawyer because you could certainly sue the company. It is always best to research before going off on a tangent.

You need to send them a certified, return receipt cease and desist calling or "not me" letter (think of it as the best $6.47 you ever invested). You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. I am reading that they operate as a "third person" operator so they don't fall under the FDCA laws? Is this true? They call 5-6 times a day from different numbers every time 😡

There are sections of the law for the original creditor, and sections for any other business that now claims the right to collect that debt.
