- TSCAM!! DO-NOT-SEND-MONEY or give ANY information to them. If you already did, since they are very convincing and already have a good deal of your info, put your credit on lock (so you have to approve all new lines of credit), etc. They had a very, VERY convincing story that after my foreclosure I still owed the balance on my 2nd mortgage (80/20 loan) because only the first was wiped with foreclosure. She gave me a number that was supposedly Bank of America so I called and the rep said it was legit so I researched a bit on the internet and found that this actually does happen sometimes, so I figured I was toast. Called the collection agent back to get some time so I could talk to an attorney about this because it didn't seem right at all. I was positive I owed nothing after the foreclosure. She went over a bunch of payment options, all of which were crazy and impossible without robbing someone else. She also kept trying to get a bank account and routing number to start making $200 "good faith" payments until I sorted out my options. I didn't give it to her and said I'd have to call back. Then I called a known good BoA home loan number and had them look at both my accounts. I've owed them ZERO since my foreclosure, as I had already discussed with them over a year ago when it happened. The foreclosure wiped out the debt. There is a huge backstory behind the foreclosure which I won't bore you with, so I'm not excited that I somehow cheated the system or anything- I loved the house and didn't want to move but had to and could not sell or rent at all- (AND BoA backed out of a short sell AFTER they sent us the approval letter- yay). In short, if these criminals want money from you, don't give them any AT LEAST until you talk to a respectable attorney and present your facts. And don't give them any of your information. I gave some, which might very well complete their profile on me so they can pretend to be me. So, my credit will be on lockdown for a long long time, and I'm going to have to stay on top of all my finances even more because they are getting very very smart, and very very malicious. I hope this will help someone else out there. I'm not done seeing these people shut down.

- Mike| 1 replyFile a complaint with your States Attorney General. Filing a complaint with the FTC on the "Do Not Call" site does nothing.
Focus is practicing illegal collection practices. The only way to stop them is to file the complaint with the Attorney General. - Resident47 replies to tYour caller is not going to dutifully study random forum complaints and cannot magically determine which numbers should not be called based on anonymous comments. You must send your demands directly to the collection agency, which does not maintain this site or this web page.
- Resident47 replies to MikeAn AG complaint is NOT "the only way to stop them". You have both federal and state laws which grant private right of action. When collectors violate your rights, you can sue them into submission for low or no cost. You might have a hands-on AG, or you may have one who is content to send you a soothing form letter months after the fact, during which time you risk wasting your chance to go to court yourself.
- Resident47If you all don't stop chanting "Do Not Call list" I will become very cranky.
The DNC registry is for telemarketers, meaning sales, meaning all debt collectors are exempt. This fact was not kept secret from you when you registered your numbers. Attorneys general and the FTC are valid complaint venues which help the public good. But understand that you must confront collection agencies directly if you dislike their treatment of your privacy and consumer rights.
If Focus or any other agency thinks you owe something, be sure to respond on real paper to its federally required dunning letter with a dispute and validation request, adding that you either restrict or revoke consent to call again. Given the industry's documented need to break laws to get at your assets, you should dispute even if you agree slightly with its claim.
If the account is not legally collectable, or it's simply not you they want, you're free to send a full cease-comm, cutting off all contact. Send all notices via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft them. Pay close attention to all communication and document it well. If those contacts yield legal violations, you may collect from *them* through a judge or arbitrator.
