      It's not against FDCPA - in fact, it's required by it.  The FDCPA provides specific guidance for the specific phrasing they are required to do.  Without knowing what your "mini-miranda" comment means, I can't know for certain.  See http://en.wikipedia.org/wiki/Fair_Debt_Collection_Practices_Act for a good overview and http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm for the full text.

        I am a friendly debt collector, but also a debtor.  I am not perfect, and knowing the FDCPA as well as I do, I am more than happy to sue any third party collection agency that violates the FDCPA as well as help the public to understand when a violation has occurred....about the Mini Miranda answering machine message, it goes like this...."This message is for (Johnny Debtor).  If this is not (Johnny Debtor), please hang up or disconnect.  If this is (Johnny Debtor), please continue to listen to this message.  There will now be a three second pause.  (Three seconds of silence).  By continuing to listen to this message, you acknowledge that you are (Johnny Debtor).  This is an attempt to collect a debt; any information obtained will be used for that purpose.  Please contact me about an important business matter at 1-800-xxx-xxxx."  Any variation of this message will be allowed, as long as the Johnny Debtor states the persons full name as listed in the account and the front part is NOT changed or altered in any way (front being everything before the 'three second pause').  However, they MUST leave this message if they believe this is your HOME number, cell number, or your PRIVATE POE (collector jargon for place of employment) voicemail box (i.e. 'This is Johnny Debtor with Custom Services'.  NOT 'Thanks for calling Custom Services.)  I know it sucks, but it is the FDCPA law.  By the way, I am about to sue a 3rd party collection agency for leaving a message on my answering machine saying that they have some good news for me of a financial nature.  @ words will get me out of an old debt.  Shame shame....J from STL

    This number called me at a family members residence, not even my own, and stated I needed to contact them without explination or what corp. they were affiliated with. Also the number on the ID was not the same number they told me to call.

    The caller asked if I knew a certain family member.  Then the lady wanted me to give the family member's number or else give him a message.  I told her I would relay the message.  It sounded like a collection call.  When I relayed the message, so she gave me the number with extension and said he should ask for Miss Riley. When I asked what this was in regards to, she said to tell him it was "C.A. C.".  When he returned the call, my family member said the he was told he owed money.  When he said he didn't owe any money, the lady told him that perhaps he didn't remember and that he had missed mailing a payment.  He told them "No, he hadn't".  The lady hung up on him.

    Called an acquaintances work place saying they were looking for me.  Gave them the names of my family members and said it would be in "my best interest" to call them back immediately.  Said they were calling to collect a debt, I have not received any prior notification regarding any debt what-so-ever, for anyone.

      This is a clear violation of the FDCPA. Her is some a text rom the law.
      It' illegal to:
      (8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

      § 805.  Communication in connection with debt collection   [15 USC 1692c]
      (a) COMMUNICATION WITH THE CONSUMER GENERALLY.  Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt --

    She said "Hello, this is Ms Cobal Rubias please call me today 1-800-303-7276 at ext 538, it's very important that I hear from you today. Thank You!"  Needless to say she called my work number which i don't give out willingly and I didn't call her back since other people said the same thing.  If she would have said my first name I may have called her back.

    Called me, left a voice msg,asking for a family member that does not live with me.  Sounded indeed like a collection agency, but left no info other than this number and an ext number

    A Mr. Gallaway left me a voice mail telling me I owe a debt, on my answering machine which I know is against all FDCPA laws.

        A company however cannot call a relative or someone that lives by you and tell that person that you owe a debt.

        That's not true. You must be a debt collector trying to defend what you are doing. It' spelled out in the FDCPA that you may not mention or even hint that you are a debt collector. It can't even be on the envelopes being mailed. The country have enough terrorist to worry about we don't need "financial terrorists" on top of that. Here is a quote;

        Under the Fair Debt Collection Practices Act, FDCPA, debt collectors have strict guidelines for when and how they can communicate with you. If a debt collector leaves a message on your answering machine that even hints he's a collector, he's breaking the law. In that case, you can sue. Since debt collectors can't communicate with third-parties about your debt, they can't leave messages about your debt on answering machines that others have access to.

    Have called this number back numerous times; they are trying to collect from a person I do not know but they continue to call me. I have just been hung up by four different agents from there refusing to let me talk to a supervisor. I have received comments like, "this is not a concern for a supervisor, they are very busy with "real" people", "for you to be needing a supervisor for this reason shows you have to much time on your hands", "our supervisors are to busy to talk to you right now" "I will not give you our address, we are an undisclosed location". All four times I was told I was being dramatic for wanting to speak to a supervisor, the agent refused to give me there address so I could put my request in writting and eventually hung up on. I have filed a report with the Federal Trade Commission at 1-877-382-4357; I was informed by them this company was breaking the Fair Debt Collections Act by not telling me there address, not letting me speak to a supervisor and by continuing to call me after they were made aware they had a wrong number. The FTC also informed me this company already had numerous complaints about them. I encourage you to file a report as well.

      Don't let them off the hook, they are "nasty" people. Anyone having job like that must be a "jerk" by nature. Here is a letter you can sent if you don't want them to call you anymore.

    I have gotten 2 calles in the last 3 days stating that I owe dept. The 1st call was a man, the 2nd was a lady that did NOT say where they were from or what their names were. The 1st phone # was 405-425-1500. the 2nd # was blocked(on my cell phone) and she gave me the 800-303-7276 number to call back on. What is with these people?

    Party called and left a message that they were trying to collect a debt.  Left this number to call "immediately!" They did not tell who they were seeking, they just left the info on my machine.

    Reading all the entries before me is distressing as I recieved a call and the Call came up Unknown but left a message.  Woman said her name was the same as my case worker at Social Security Admin.  Left her number and said I should call.  I returned call.  A man answered and said something like CAC Financial Instition, I said Excuse me? Where am I calling?  He repeated himself and I said I'm sorry I thought I was calling the Social Security Administration, not a Bank. This man then said my first name and I quickly hung up as it scared me as I thought how do you know who I am. I thought it was some kind of scam or something playing on those of us that are disabled and receiving disability pay.  So I got on the Internet to try to find the number and came across this web site with all these entries. But I don't owe anyone anything so why would this place call me and leave the same name as my worker or know my name or number? If this place is as horrible as the other entries seem to indicate it scares me to think why they would pose as a Gov't Worker and then be some kind of financial institution, whom all the rest of the entries here say are some kind of a debt collector. I think I will call my State Attorney General's office as this has to be some kind of scam.
