Caller asked for a person not here, I asked who they were and what the call was in reference to, they told me they could not tell me. I told them to take my number out of the database as this person they wanted was not here and that the number we called was a business. They were rude and hung  up on me then.

AmeriLoan is located at the same address as USFastCash, & United Cash Loans. A subsequent BBB investigation determined that this address is the address for offices of the Miami Nation Indian Tribe. During its investigation of these companies, BBB employees visited the location as well as sent a certified letter to the Chief of the Tribe asking for further information regarding these companies. Employees of the Miami Nation Indian Tribe neither confirmed nor denied knowledge of the loan companies, and informed BBB staff that they would have to speak to the Miami Nation Indian Tribe's Leadership concerning the matter. BBB has not received a response from the Chief concerning this matter. At the present time, BBB does not know if these companies are operated by the Tribe, by employees or other people using the Tribe's addresses, or is a joint venture between the Tribe and a for-profit company.

The complaints against this company and others located at the same address generally allege the inability to pay off the requested loan, charges to the consumer's checking or credit card account despite never receiving the requested loan, or continued unauthorized charges to the consumer's credit card or checking account once the loan has been paid off.

BBB has determined that this company is not licensed in the state of Oklahoma to provide loans to consumers and does not appeare to be licensed in any of the states from which consumers have filed complaints with BBB. However, if the Miami Indian Tribe actually operates this business, it may not be subject to state laws regulating this industry.

BBB encourages all consumers seeking loans of any kind to research all of their options before providing any private financial information or signing any loan papers. Consumers should check with BBB on the company's grade, their complaint volume, and whether or not the company is licensed or regulated to provide the type of loan services the customer is seeking.

They call me three times a day every day at the same times on my cell as well.  I think I might find it refreshing to call back numerous times on their 800 number and scream as loud and long as I can to a live person.  It will be quite liberating.  If they are going to bother me, I'm going to bother them as well.  If they complain I have proof on my caller ID of how many times they call me.

    Annoying phone calls
In the past couple of months I have been getting a call from 1-800-326-5383, and when I answer they hang up. I called the number and the peson answering stated he was with Ameriloan and then asked for an employee that is not located in my state. The man I spoke with insisted that the person worked in my state. I tried to get more information from him but he hung up on me.

Too bad for him that it DOES "matter":

Let him know that if the calls continue, you will be suing him and his employer for TCPA and FDCPA violations:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

If they are indeed located on an Indian reservation then I believe they can't be sued for anything but the silver lining on this is, that they also can do nothing to you.

These people call my work phone 2 times per day. I haven't been answering the phone because I don't usually answer 800 numbers but today I called the number back after receiving a call. I asked the women what company she works for and why she keeps calling me at work. She replied that the number belongs to "National Telephone." She said they do not keep calling me and there is no way to remove my number from their list because they don't call me. What a lie! She then proceeded to tell me that I had mistakingly called 1-800-327-5383 instead of 1-800-326-5383. Not true. I don't know whats up with these people but the calls are really staring to annoy me because they interrupt my work!
