Dear {insert name of collector or company},
I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.
This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:
(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.
I respectfully request that you provide me with the following information:
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)
Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:
because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.
you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.
I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.
Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

- UNKNOWNHey guys.....
I have worked for this company n u knw what guys it's a callcenter based in Mumbai, India.. working for Capital1 Third Party Collections.
Your account are given to these guys n when they collect the 21% as their payment
If u guys r looking to get rid of this Cap1 account call them on 30th/31st of any month give them a upfront payment of $100 and ask them to settle it at least 55-60% they r Indian n very good bargainers so beware and don't agree to a amount below that. Then get it converted into monthly payment of $50 every month most important call on the last day they will agree to any amount as mentioned.
(Or) tell them I don't have money and do what ever u want to.. (only if u r not concerned bout yr credit scores)
They have 10000000's of such accounts they will tell you I m marking your file as three r"s which is nothing
1) Refusal to pay
2) Refusal to corporate
3) Refusal to agree to card holders agreement.
And trust me guys there's nothing in FDCPA or law so called as 3r's.
All they will do is throw this account in MRV (Manager Review) status or refusal status.......
Trust me guys nothing will go wrong if your account is below $3000
Anything more than this I would suggest settle the account for 60% or there is chances of legal action.
You can write back in case anything more you want to know, just reply I will help you.....- Caller: mrs

- LBUI have been getting this call and voicemessage for weeks at least twice a day. I don't have a capital 1 account or anything and it comes from number with an invalid area code. I get no extension to call; just the 800 number. The call actually comes from a 223-987-5200. I am so confused and would just really like the calls to stop.

- DougCalled with a "paperwork crossed his desk for review and he has to make a decision on my behalf". Ha ha ha ha ha ha ha! LOL 1000x. Steve, you can't make a decision on my behalf WITHOUT MY CONSENT. He wanted to discuss it with me, but when I tried to contact him back at this number it was disconnected. If this is a collector, he is in for a big surprise. I have zero debts, and do not owe a thing to anyone. Once more the only card I ever did owe on is well past the "Statute of Limitations" (7 years in my state)and was declared in my bankrupcy, so they are already in violation of collection practices...I can't wait to get their licence revoked by contacting the Secretary of State. Another violation they have committed is that they did not clearly state who they were, or why they were calling. Just a bunch of bull, and a somewhat forceful message that is borderline of a threat. Steve..."Cease and Desist calling or mailing me."
