    I had a call from this same guy, and boy does he have attitude. He rattled off my social security number, all kinds of info but didn't want to answer any questions about who the heck he was! My issue was a cash advance payday loan I forgot about in November, he tells me it was fraud and if they take me to court instead of the $220.00 I owe it will be $3000.00! However, i'm far from stupid and promptly called my lawyer. I don't appreciate scare tactics and trying to insult my intelligence.

    Don Sherri (?) Fazon Law Firm in New York, called my home looking for a distant in-law concerning a civil matter that he could not discuss with me. When I returned his call minutes later, he answered the phone with "hello".
    There was no mention of business name or his name. I was told that my name came up in a search of this in-law's ss#.  I informed him that I had not contact with this person and that if he could find me in a search for him, that he should be able to find him!

    Just got a call from Donn Sherry with Falzone Law Firm on my cell phone.  Called asking for me by my former married name from 5 years ago, had my social security number and my Mom's name.  Interesting that he had this cell phone number as this is not the same number I had when I was married before.  Called claiming that I have a payday loan from 2003 that is now in litigation.  I offered to give him my attorneys number but he wouldn't take it, sent a text to my cell phone with name and phone number.  Looked up Falzone Law Firm and am not able to locate it anywhere!  Looked up the phone number he called from and found this and other blogs complaining about calls from this guy and this number.

    Man calls my mothers house talking about cease and assisting something. Said for me to contact Don or Dawn Cherri. Left case # and said from Balzone law Firm. SPoke very fast and very unclear  -  sounded as though he was reciting a skit he does often. Said i have 24 hrs to contact him and they just talked about my situation in a conference. Left the last 4 digits of my social security num on answering machine not even knowing if i live there or not - WHICH I DON'T!!!    If this man could find my mothers phone # why has he not contacted me - I am listed in the phone book!!! Sounded very fishy!!!  Also, called me by my nickname - not my full name.  He tried to sound threating - think he is full of crap!!!

    I'm Chryssy's mother. Just called the 800 number back to suggest to Don Sherri???? what he and the Falzones ??? could do to entertain each other this week-end while they await Monday morning for the opportunity to continue to intimidate & harrass people BUT when told to leave a message it was impossible. I pressed "0" and got nothing but "elevator" music and no opportunity to speak. Hope to catch them Monday. Let you know how it goes.

    I just received a call from 800-403-4920.  They refused to ID themselves after i asked them to several times.  I advise the person that they have not read me the mini miranda during the first initial greeting of the call.  As well as the threats of being sued, when they have not filed.  I called back again and advised them of the Collection laws and what will be my intent if i received one more threaten call from thier company.  He was speechless.  Listen anyone who receives call from business in general like this should not have to take that type of abuse.  I'm also reporting them to the BBB for harassment.

    I had 2 messages on my answering machine about cease and assist.  I called the number left 800-403-4920 and it was answered "hello" instead of a professional office greeting.  The man threatened legal action (garnishment of wages, freezing bank accounts) if I didn't make a check by phone payment.  I refused to give my account information so he said he'd see us in court.   I hung up.

    I received a phone call from this number 716-558-7629 at 4:00 today.  I did not answer as I know nobody in New York.  The message sounded very threatening and also talked about cease and assist.  They left me this number to call back, 800-403-4920 and a case id #.  They had the last four of my social security number & were very threatening on the phone so I got very defensive back to them.  They never would tell me exactly what it was about but had something to do with bank fraud.  I knew then that it was bull.  It sounded too suspicious.  After putting me on hold and it sounding like at the most two people whom they seemed to be passing me back and forth to, I told them I was not verifying any information over the phone with them and hung up.  They called back but did not leave a message.  Is there not a way to get these people for this?  Is this not harrassment?

    My mother received a message asking for her directly to contact 800-403-4920 to speak to someone named Thomas at ext 13 in reference to case#9137326. Falzone Law was the name of the company left. I called them back for her because she is older and has a difficult time understanding. When I called, the man who answered didn't identify himself and transferred me to ext 13. The man at ext 13 didn't identify himself and started indicating that I owed money for bank fraud. I asked him to forward me the information in writing but he refused and was very vague about the entire situation. He wasn't vague however of all the information he had gathered on my family and me. After indicating he had already sent letters, he then contradicted himself and said he isn't responsible for sending letters. I insisted on written documentation. He then offered to send an email. I agreed to that, but when I advised him to include all the information like company name, address, phone number etc of his firm and the firm he is supposedly working for, he became agitated and started threatening me with lawsuits and jail time. I advised him that if this was a legitimate claim that I will need to have something in writing to verfiy the claim with my people. He then started berating me saying that he figured I would protest and use a stall tactic on him. He demanded that I pay him over the phone.I advised him not until I verify what is going on, who he is and what exactly this is for. Also, he then indicated he was not going to send anything and that he was going to pursue this in court.  Then he hung up on me. He never even took down my email address. His tactics would have bullied my mother into paying him over the phone.

    If you really think about it, all the information they gave you came from your credit report and if you pull your own credit report @ annualcreditreport.com you will see a company from New york that pulled your credit.
    I got the same call. I found out that the statute of limitations for my state is 4 years on debt so this debt is uncollectable as it happened in 2000.
    All they have is hot air. they can sue you but all you have to do is show up (if you dont show up then you forfeit). You can counter sue for harassment. There is a letter you can copy, paste and send them on this website

    "The fair debt collection practices act offers protection from illegal and unethical debt collection tactics. This self-help site provides in-depth information about the federal fair debt collection  law and many state collection laws as well. The purpose of this site is simple; to help consumers better understand their rights and to help they learn how to handle illegal and unethical debt collection situations. "

    I heard about a call from these people. They called my parents. There is no way that is a phone number of record for me as I have kept my maiden name and my number's listed (red flag #1). They try to embarrass you in front of your family and make it sound like some dire situation. They apparently talked fast and said something about a subpoena. I haven't been served with one. These people are trying to bully my parents into paying them. What a bunch of azzholes.

    I got a call from ny from a very rude man. From 716-362-4900. He said he was going to begin legal action and he needed the number to my mothers lawyer. He also wanted my mothers cell phone number . I told him my mother wasn't in and that he could call back at 4pm. I hung up.
    Two seconds later i get a call back from the same man yelling. He said " DO YOU KNOW WHO YOU ARE HANG UP ON , YOUR MOTHER IS REALLY GOING TO REALLY  APPRECIATE THIS" and hung up on me. I called back and ask to speak with who ever called my number. A man who almost sounded just like the last person said hold on one moment ( i heard the phone moving around ) . The original person came on the phone and said " YEAH YOUR THE GUY WHO LIKES HANGING UP ON PEOPLE , I CALLED YOUR MOMS PLACE OF WORK " and then he hung up on me again . I called back a third time and asked to speak with the a**hole who just Lied and hung up on me. The nice person who answered , voice changed. It was the same guy all along. He said " FIRST OF ALL KNOW WHO YOU ARE TALKING TOO. I SAID I CALLED AND YOUR MOTHER A MESSAGE " he went into some mini speech but i stopped and him and said f**kyou and hung up.

    I knew he was lying because i called my mother and no body had left her a message at her job ( she is a teacher ).

    I checked my mothers credit report and guess what ? These scam artist don't even show up. I also knew he was lying because we just brought an house and we had to pay off every debt we owed to get our mortgage.

    who are these people ? why are they doing this ? Is it because of the recession ?

    East Point--
    They are doing this because they are under the delusion that they are above the law. Read my previous post dated April 27th.

    Too bad for them (and good for your Mom that she has you), that there are laws in place to protect her from dumpster trash like Falzone, who have already broken TWO Federal laws by:

    1) Discussing her "alledged" debt with a third party (Section 805),
    2) Threatening to take legal action they have no intention of taking (Section 807)

    http://www.creditinfocenter.com/legal/FDCPA.shtml#807

    The next time they call (and I am sure they will), that you (or your Mom) are recording their phone conversation (and don't let them tell either of you that it is "illegal", for it IS legal in the State of Georgia to do so), for use as evidence against them in a court of law for violations of the Fair Debt Collection Practices Act (FDCPA).

    Your Mom should then immediately send Falzone this letter VIA Certified Mail (request a return receipt and keep copies of everything she sends), If they continue calling after she has written proof they have received it without first validating the debt, they can face fines of up to $1,000.00 PER violation:

    Today's Date

    Your Name
    Your Address

    Collector's Name
    Collector's Address

    VIA CERTIFIED MAIL

    Dear {insert name of collector or company},

    I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

    This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

    (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

    I respectfully request that you provide me with the following information:

    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) Provide a verification or copy of any judgment (if applicable);
    (4) Proof that you are licensed to collect debts in (insert name of your state)
    Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

    because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
    you cannot add interest or fees except those allowed by the original contract or state law.
    you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
    Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

    I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

    Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

    I had checked the phone # for this firm & disregarded them basically because I saw the word fraudulent everywhere. The next thing I new I had a judgement for over $12,000 when the debt itself was initially less than $9000. I was charged fees & interest & now there's nothing I can do since these people have actually put a wage garnishment in place- over an autoloan for a car that was repo'd. I dont even understand how this happened, especially since I havent heard from anyone about this in 4 years. I am completely disgusted.

    a man from what he told my ex roomate he was calling from thomas wayne lawfirm.. and left the 403 number to call back with a case number.. then i got a call to my cell when my sister answered the phone the man started calling her me and insisted she was me on the phone then said he wasnt playing this game and hung up on her . i called the number back about ten minutes later and talked to the freaking rude man on the phone he starts telling me that he is taking an usettled webpay day loan to court for attemting to defraud or something along those lines.. i then told him there had to be an error and that if he sends me a bill for that claim i would take care of it.. he then proceeds to be rude and say its to late and that i was the one who answered the phone earlier and that i burned that bridge saying that i lied to him when in fact i hadnt. and wanted to settle this issue if i get a paper bill for the amount wich probally is about $250.00 he then get ruder and said i will be taken to cuyahoga courts and hung up on me again.. i then called today and asked for thier website the same guy answered and said there wasnt one and i asked for the direct line to thier place he then put me on hold and sent me to another guy who said no website yet and gave me that same 716-362-4900 number that one of your other writers made a comment on... there must be a way to stop the harrasment that they are doing .. because when i asked for a bill to be sent and they refuse then something isnt right about that...
