I received a phone call tonight at 8:00pm nov 26th from Dave. He stated that I had a judgement against me and had I not answered the phone he would have sent a sheirff deputy to serve me with papers. He said that I had a pending lawsuit against me and if I didnt pay the full amount by Dec 14 we would be in court.I attempted several time to reconcile the outstanding debt for years with no avail. Then out of the blue 10 years later... I was appalled when I answered the phone to hear "Dave" tell me that that I needed to settle the debt for 1109.00 I asked him why havent I heard anything until now? I also asked how he got my cell phone. He didnt know???? He also told me that the frim did not accept pymt plans..then he told me if I paid him 498.32 on firday then the acct would be closed. He kept pressuring me to tell him I would pay said amount. I told him i would call him back.... How does this happen????

10 YEARS LATER??!  This debt is not even legally collectable any longer (I believe Rhode Island is the only exception).  And it should have dropped off your credit report years ago.  That's assuming it was even valid in the first place.  All the collector trolls can do is hassle you - AND NOTHING ELSE.  Ignore them.  At this point, they're powerless and their threats are a childish waste of time.

I recieved a call today 11-26-80 from a private caller.  The lady left a message and said that this call was for <my mom's name here> (who no longer lived with me).  It said for her to call 1-800-459-1223 and to ask for Dr. or Mr. Whiteman.  Then it gave me a case #.  So I called out of curiosity and it said it was the Law Office of Jason Jay Evans.  I was confused and concerned so I hung up and sat there for a minute.  My curiosity got the best of me and I looked up this number and found this web site.  So, here's yet another addition to this tale of the 800 number..

I have received a few calls from this place and each call had the number blocked.  What was strange was that they started calling me on a new unlisted, unpublished number.  Not sure how they got it.  Anyway I have had dealings with a company like this before so I knew how to address this chick "Ms. Nelson".  She said needed to verify my address to have court papers served on me before the middle of December due to the fact that the statute of limitations is 5 years and will be up.  First of all in South Carolina (where I live) the statute of limitations is 3 years.  She seemed a bit stumped by that and there was silence.  She then asked for the name of my attorney.  I guess she assumed that I didn't have one but I do!!!  I gave her the name and number!!  She seemed stumped by that also!!  They can be suied for trying to get a default judgement and collect on a debt that is out of the statues of limitations.  I know this because I was awareded $25,000 a few months ago from a "law firm/debt collector" who was trying to do the same thing.  They had all kinds of fair debt collection violations.  Don't let these guys trick you into feeling like you don't have any rights!!! YOU DO!!!!!

Called a nephew of mine in a state in which I have not lived in 20 years and told them they were trying to serve me with papers to appear in court on a breach of contract lawsuit.  They told them I had used their name as a reference in getting a Citicorp Mastercard.  They referred to me by my maiden name, (my nephews name).  I have been married for 12 years.  I had a Mastercard over 15 years ago, and not since.  After calling the number left by the "lawfirm of Jason J. Evans", I was told they had a copy of my Florida drivers license, and would use any method they could to reach people like me who avoid the service of court papers....etc, ad nausem.
My attorney is sending them notice to deal with her Law Firm in the future in trying to reach me.  I'm sure it will be the last of it.

THESE PEOPLE NOT ONLY CALLED AND HARRASSED MY 75 YEAR OLD MOTHER FOR A DEBTH THAT MY DEADBEAT BROTHER OWED, THEY ACESSED HER CHECKING ACCOUNT AND TRIED TO TAKE HER SOCIAL SECURITY MONEY.  THEY TRIED TO GET 1800.00 AND SHE DID NOT HAVE THE FUNDS, THEN THEY TRIED 500.00, BUT HER SS CHECK HAD NOT CLEARED.  SO 140.00 IN OVERDRAFT FEES LATER, MY MOTHER CONTACTED THE BANK AND HAD TO GO IN AND SIGN AN AFFIDAVIT TO KEEP THEM OUT OF HER ACCOUNT.  THEY GOT HER ACCT NUMBER BECAUSE SHE PAID 200.00 FOR MY BROTHER ONE TIME ONLY.  They also threaten her and call her a liar, etc.  I need to make them leave her alone.  She had nothing to do with his debt.

I'm a senior citizen and I keep getting these harassing phone calls twice a day asking for a person I have no idea of. I have asked numberous times for them to stop calling me asking for this bogus person. The next step I will take is call my local police department.  If anyone on this site has some infomation on how I can get them to stop harrassing me please let me know.

Caller left a message stating a persons name and that I or my lawyer needs to call them back at 800-459-1223 and refer to a case number. If I did have any debt is it now over 10 years old. Does the statutue of limitations on debt collection ever run out in OR or WA?

I just got the same call yesterday. He cited the Case # and his name and for me to call him at 1-800-459-1223......my room mate got the same call last week.  WE both are DEBT FREE and have been.  I pay credit cards in FULL always and even paid car in CASH.....owe nada~!! This SMELL LIKE A ROYAL SCAM.

Called to threaten me and my family with a judgement.  When I called back their other number 716-446-1070, a woman answered and said her number was an Indiana number.

Today, January 18, 2008, a woman left a message on our answering machine. The person identified herself as Kaitlin Campbell of Attorney Jason Evans' law firm. She said that she had to hear back immediately about a very serious matter reported to their firm this morning so she could explain in detail the accusations, what was being filed, etc. There was A LOT more, but the strangest comment was "We need to fight for your defense now - prior to them contacting your commanding officer in the military. This could get much, much worse." Finally, the woman said, "My number is 1-800-459-1223, direct office extension 18."

caller left a long fast hard to understand message on my answering machine for someone not at this number. When i called them back to let them know, the man who answered the phone was extremely rude and called me stupid for calling them, he threatened a lawsuit if i called them again.

The debt collection scams, cons and fraud out of Buffalo, NY never stop. Here is the latest entry into the world of the sleazy debt collectors, using the name Evans Law Offices. The problem is that New York State records do not show this organization and information we received purports to show that Attorney Jason J. Evans may be committing perjury and other illegal acts in his debt collection venture.

I am in receipt of a document titled: SWORN AFFIDAVIT OF DEBT printed on Evans Law Offices stationary and containing a signature of Jason J. Evans, Esq. where it (based on the attorney expert I showed it to) appears to violate federal debt collection laws. These are claims for old Discover accounts and attorney Evans makes statements that are false and misleading in his sworn affidavit. (perjury?)

It is tough to deal with a liar and a con man and the fact that the signature is over a PLLC that New York State records do NOT verify make this operation all the more suspect.

My advice to anyone receiving these bogus notices is to send (attorney?) Evans a debt validation notice, demanding all documentation that validates the alleged claim. Do not be impressed by his bogus affidavits of debt, they are worthless. Make him prove everything. Expect that his hyped-up debt collectors will threaten everything under the sun, as most desperate debt collectors from Buffalo do. The good news is you can locate a NACA attorney from www.naca.net who are REAL experts on debt collection laws.

The Evans Law Offices smell as big as Buffalo, stay far away from these losers, they are nothing but trouble. This operation has the Lenahan stink all over it. Contact me if you need assistance with these desperados.

You need to IMMEDIATELY file a complaint with the Attorney Generals' office in your State, but also with the FTC and the New York State Attorney Grievance Committee (listed in my previous post, above). Threatening to have you arrested is a BLATANT violation of Section 807 of the FDCPA:

False or misleading representations  [15 USC 1962e]

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

(2) The false representation of --

(A) the character, amount, or legal status of any debt; or

(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

(A) lose any claim or defense to payment of the debt; or

(B) become subject to any practice prohibited by this title.

(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

(13) The false representation or implication that documents are legal process.

(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.
