You need to IMMEDIATELY file a complaint with the Attorney Generals' office in your State, but also with the FTC and the New York State Attorney Grievance Committee (listed in my previous post, above). Threatening to have you arrested is a BLATANT violation of Section 807 of the FDCPA:

False or misleading representations  [15 USC 1962e]

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

(2) The false representation of --

(A) the character, amount, or legal status of any debt; or

(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

(A) lose any claim or defense to payment of the debt; or

(B) become subject to any practice prohibited by this title.

(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

(13) The false representation or implication that documents are legal process.

(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

Person named Jason Carey from Evan Law has phone # is 1800-459-1223 xt: 21 has been calling my family members tellign them that they need to have me call them back, that they are a lwa office and need a statement from me.  I am going to call them and sk Mr. Carey for a debt validation notice, which I will send to my attorney.  If I did have a debt it would be about 10 years old.

I looking at my credit report and I seen this law office of Jason Evan and I tried to look up the information about this so called law firm. Hmmm well I did a address search and it turned out to be a hospice which made me laugh my a** off them. So I called my local Sheriff's office and told them what was doing on.

Hi everyone,
you need to immediately tell these people that they are in violation of the FDCPA (Fair debt collections practices act).  First, you need to know your rights.  go to http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf and read the brochure reagarding your rights.  THEY are violating the law and your are entitled to compensation.  REMIND THEM they are breaking the law and  you plan on filing a complaint with your local State Attorney, Their state attorney and then use the yellow pages and hire and attorney.  I work for a local debt collector and they are giving the rest of us a bad name.  Do not drop the matter.  Get dates, times, write down exactley what was said and who said it.  Make sure you go to the above website so you KNOW what laws they are breaking.  If they dig their hole deeper let them.  That will mean more $$$ for you!

they law office of jay evans calls my brother in alabama, looking for me .
They state  im a plantiff and they have been retained by a defendant. IT IS a civil matter and cant get a hold of me, not sure what to do?

Bill, called as an attorney stating that a case was filed against me in the county where I live.  When I informed "Bill" or "Jason", I disputed the bill with the credit buerueas he informed I couldnot do that.  "Bill", didnot know my background as a Paralegal and a proactive consumer.  When I said I will not pay the  disputed amount and told him correspondence would only be through Mail he hung up.  When I called back to get the 'case number' he fast-talked at the begining of the conversation, he refused to give it to me.  That is not legal.  He said my name as soon as he answered as if caller ID would scare me.  This outfit is wrong accorrding to the Fair Debt Collecting Act and I will be reporting them to the credit agencies and also to the FTC, BBB, and the FCC (because they abused their status over telephonic communication).  Now I don't mind people doing their job, but when they try to intemidate, outspeak, and keep putting 'law office' in the conversation when they are asked if they represent a collection agency and deny it, that is unacceptable.  I did tell 'Bill' I was going to report him.

These people also called me saying they were calling regarding a fraud case involving my social security number.  They left a reference number as well as the 1-800-459-1223 number. After reading these posts I have decided to do nothing but erase the messages until I get something in writing that I can see were the debt is that they are calling about.  I won't allow these people to harrass me.

Dear Mr. Jason Evans,
This message is composed to make you aware of a few unprofessinal staff members working at your firm. I contacted your firm this evening in response to a voice message received on my answering machine from a Jason Gary. Jason was not in the office as I was informed by James. I attempted to explain to James that I was receiving calls and shouldn't be and would like to request them to stop. James proceeded with rude questioning, what's your social secuirty number, who are you. I immediately explained to him that 1, I don't need to supply him with my SS# and why would he be asking me for that if I already explained I have no case with nor thru the Jason Evans Law Firm. After I told him I was only interested in being removed from whatever list I was on due to the fact that I have nothing to do with it, and informed him he was being rude, he abruptly hung up the phone. I returned the call to the above number and Ron answered, I attempted to explain to Ron my previous encounter and then Ron mentioned he needed to investigate, next, I am forwarded into I believe Jason's voicemail with no prior notice. I attempted one more time to reach an compitent person at your firm and the last gentlemen refused to provide me his name, he only told me I didn't know the Law, when I mentioned people are sued everyday for hurrasing people. He told me you were a Law firm and you knew the Law, thus I figured perhaps you need to refer them back to Law School and it might help benefit your practice, if you required some professional classes as well, just common courtesy would be nice. I'm not how you stay in practice with such behavior. Nonetheless, I have nothing to do with the case Jason Gary has open and would like all communication to cease immediately, please Sir. It is with regret that I have taken the time to send you this message, I deal with customer service on a daily bases and would love to train your office on what it that it is.

Same as everyone else, get a call from a Jason Jay Evans wanting me to confirm my social - NOT!  The guy gets abusive and says good luck in court and hangs up on me.  I live in Texas.  I am not governed by New York law!!

I live in Texas too and just found out they have no surety bond in Texas, so they have no right to collect from you.  They have a court order that states they can not collect until they get this bond through the Secretary of State.  Get a lawyer, I did.

5/16/08. this same company I presume Evans Law A**, has been calling non stop from several different numbers, 716-362-0350,716-204-1083,716-362-3194. The only debt I know of is 13 years old, judgement and the workds have been filed 10 years before and no one showed up at the court so I am presuming this debt has a statue of limitation. How do I get these people to stop calling.

SO THIS MORNING MY DAUGHTER CALLS ME FROM MY EX-HUSBANDS HOUSE (WHICH I HAVE NOT LIVED IN THE PAST 10 YRS) AND SAYS A PERSON LEFT AMESSAGE ON THE MACHINE THAT MY SOCIAL SECURITY NUMBER WAS BEING USED BY SOMEONE AND I NEEDED TO CONTACT THEM RIGHT AWAY. THEY LEFT A PHONE NUMBER AND CASE NUMBER. SO IT WAS STRANGE TO ME BECAUSE I HAD THIS HAPPEN BEFORE WITH MY DAUGHTES SOCIAL # AND I HAD RECIEVED A LETTER IN THE MAIL FROM THE SOCIAL SERVICE OFFICE NOT A CALL. SO I DECIDED TO GOOGLE THE NUMBER AND FOUND YOUR SITE (THANK GOD) I SEE I AM NOT THE ONLY ONE DEALING WITH THESE LOSERS. THE QUESTION I HAVE IN LOS ANGELES CALIFORNIA HOW LONG CAN THEY TRY TO COLLECT A DEBT??

I received a call from this man yesterday at work concerning a payday loan that I have paid quite alot of money into already. The loan was for $400. He told me yesterday he was going to have me arrested & sent to jail. I decided I was not going to back down. I kept asking him what this was for. I eventually got him to send me all the information about this claim. As he hung up he said that he was told they would settle this for $750. I have already made a complaint to the New York Attorney Generals Office & the Public Trade Commission. Per the webite Jason Evans is a registered attorney in NY. I could not find any information on Neil Walsh. Here is the information that was sent to me.

As I read back on the posts I have noticed that Jason Evans presents himself as Jason Jay Evans or other names. The attorney that is registered in NY is Jason David Evans which no one has mentioned him using. I will have an attorney look at this also.

We got a call from a man calling himself Vincent, stating he was with a Law firm named Evans Associates.  I requested him to email the info regarding an unpaid debt as I could not understand what he was saying.  He sent me a form letter  for us to sign stating we would pay an unspecified amount of money on a debt we were unaware of.  This letter we were to sign gave them full authority  to collect this unspecified amount of money and no metion of the debt amount or information other tha we were to sign acceptance.  Thank you for this website.

Same thing happened to me.  They say they are Evans Law office, but they faxed a settlement it said Evans Associates.  I did not sign it either.  This was the only thing in writing I received from this so called Law firm.  Budhibbs.com has a lot of good info about these losers.
