          Dear "You do not need to know",

          Speaking of "standing up for yourself", why didn't you give your name to John since you obviously believe that you're a stand up person with a strong backbone????

          This backbone that you wrote about actually seems to be missing from you, as is evident by your attacking someone who you chose not to face or identify yourself to, and obviously feel superior to as was marked by your spelling correction to him, and by your asking him if he still lives with his parents Ms. / Mrs. "You do not need to know"  (Please excuse me if I misinterpreted you gender). (Surely you noticed that this was a run on sentence being the genious that you must be, . . .or did you notice that?).

          You mention that we have a "crabby pissed off world".  Is this the "positive" model that you live by due to your strong backboned, mature self who tells someone (anonomously) to grow up???  Or, . . . are you one of the people who think it's alright to call someone at 8:56 at night to see if they are the person responsible for the debt your company is attempting to collect without knowing who you're calling?

          On behalf of John, I'm Eric Schwartz (who has also received several phone calls from these @$$ - holes trying to collect a debt that belongs to someone else).  The day that I have to call someone to ask them not to call my phone number and state that I'm not who they are looking for will never happen.

          Instead, I have notified the Colorado Attorney Generals office, who will be looking into "ERC's computer based phone phishing activities, and I encourage others to ask their States Attorney General's office to follow suit.

          Lawsuits are great tools for people like this John!!!

      call the number back give them the number that was dialed, it is juat a collection agency.  most likely your number is in the system by mistake. it takes two minutes and the calls will stop. it is not that hard people and you do not have to file a lawsuit, it is a company doing their job to try to collect moey owed, and if you owe money, work it out or quit spending and these calls would not have to happen in the first place.  Why does everyone jump to a lawsuit to solve thier problems. not everything in this world needs to be solved with a lawyer take action yourself or take responsibility for your actions. ITS SIMPLE.

        I've gotten three calls since telling them they have the wrong guy.  They are punks who acted like the whole thing was MY fault.  It's not SIMPLE.  I hate lawyers, but if they call one more time, I'll be suing too.  Why should I spend even one second correcting their bad info?  I don't owe them squat.

          Goodness, the dialogue... Now I'm the guy you really want to hate. X Bill Collector turns Lawyer. Kind of between a Rock and a Hard Place. The guy you love to hate until you Need Me. Nevertheless, best not to get on the collection agency "R&R" file Yes, Recreation with Relaxation... Stay under the Radar, regardless or especially if your a debtor (not a bad term, a legal one...) that can't or does not want to pay a debt. Smart bill collectors and there are a few, do not have time to waste on those that Can't Pay! Move on and "Cream the Files" for the ones that do or want to pay. Get on the wrong side, and then they take your number and well, make life not a pleasant place.
          These guys are so used to threats of suits don't waste your breath, the best thing, if your serious is to Suck them in and get as much info as possible then Hammer them with a Civil Action. Let the Collection Agency Defend your action... and don't forget to Name the original Creditor in the action. They can bring a lot of pressure on the collection agency to, well, Settle or Drop the collection activity and "C&R" the account. That's Cancel and Return. The ones that Buy accounts for penny's on the dollar, will just sell it to another agency... So again, just Fade Away... They will too...

        If lawsuits aren't the answer to persuade these people from breaking the law then what is?  I guarantee you that they are going to do the same thing if their claim is justified and they are indeed owed money.  So if they can file lawsuits when somebody wrongs them then why can't the people that they wrong?

          Well, Happy Dog if you have the financial resources and a Good Cause of Action that won't end up being Demurred by the collection agency 'Retained' counsel, have at it. But, the tables can be easily turned. If you in fact have a viable debt that an agency is trying to collect, they will find good cause in filing an action to recover what is owning them or their client. If your challenge is found unfounded, they have the right and financial resources to file a counter claim you will have to defend. All this equates to money and time spent. Not to mention the stress and potential liability from loosing the law suit.
          What I'm trying to emphasize, right or wrong, tossing around law suits sounds good but can come with unrealized consequences.  This come from 40 years of experience... Some times it's just best to move on with your life and save the legal actions for really important things... Then you can have a True "Peace Out"

      I too have recieved calls like this.In fact,nearly every day.Must be a bunch of real a-- holes.Either that are just plain dumb jerks.I never answer those types of calls.

      There was a law passed just recently that prohibits automated calls.If reported those people can be assessed a heavy fine.
