    It is a debt collector agency.... and they do not seem to abide by the law.  They continually call our place of business looking for an employee even though they have been repeatedly told that the person does not work out of this office and not to call her anymore.  I currently have a complaint in against this organization with the Federal Trade Commission.

    Ms. Tucker 800-568-4116 x1277 left a voice mail at my work place asking me to return her call.  It seemed suspicious to me because she just stated the James A West Law office and no reason for the call.

    I googled the phone number she left and was fortunate to find this discussion taking place.

    Thanks all for the heads up that this is a potential shady business.

    I had disputed some bills only for AMEX and never received a response from them. I clearly stated that I disputed the charges and to show proof to each and every charge. I had some ex-employees that had frauduantly used my accounts. I did file police reports. Over a year later I received a letter from the Office of James A. West, P.C. form Michael J. Young (they are really a collection agency - http://wildwildwest-law.com ).

    I responded with these exact words:

    Dear Mr. Young.

    • Please provide the following:
    • (1) the amount of the debt and how you arrived at that amount;
    • (2) the exact legal name and address of the creditor to whom the debt is owed;
    • (3) Provide a verification or copy of any judgment (if applicable)
    • (4) Proof showing signatures authorizing this debt;
    • (5) Proof that you are licensed to collect debts in the State of Texas.
    I also request that if you provide me any credit reporting agency, that you have notified regarding this debt and inform them in writing that I have placed this debt in dispute and that your are to provide me with proof that you have done so. Furthermore, I asked that you immediately send a copy of that dispute letter to the company (creditor) that you say I owe money so they are also aware of my dispute with this debt.
    I must remind you that any attempt to collect this debt without validating it, violates the FDCPA and that I am recording all phone calls and keeping all correspondence concerning this matter. Be advised that I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the national Better Business Bureau.
    Please provide this proof within 20 days of receipt of this letter or I will assume this debt to be invalid and any further attempt to collect to be regarded as harassment.

    I received almost 3 months later a copy of a credit card request that does not even state American Express on it. Non of the other documents were produced. When I called them, I was never allowed to speak to Mr. Young or Mr. West.
    Now they have filed a lawsuit.

    I would like help on the proper terms to use to deny the lawsuit.

    What remedies do I have and how do I go about filing a complaint.

    I have received 2 calls from this company.  My question is are the really a law firm, and do they file lawsuits?  What is the best way to handle this company?  We do owe money, but due to unforseen financial problems, we cannot pay them at this time.  Scare of these people!

    Got a call from these people and they informed that they are taking me to court and will start garnishing my wages.  i offered to make a payment arragement and they refused stating that I need to pay in full or two very large payments.  I told them that this was not possible and they said that they would call me back and let me know the decision.  This site was very helpful.  I will not make arragments with these possible scammers....

    If at any time the caller says they are an attorney, ask what state they passed the bar exam, what year and their name.  All attorneys are posted--if this person doesn't give you this info, then they just violted the FTC because it is unlawful to represent yourself as an attorney.  Contact your State's Attorney General's Office.  Also, if they say they will have you arrested, will garnish your wages or will contact your employer, contact your SAG--these are all FALSE and ILLEGAL statements!

    From their website: “We focus primarily on purchasing charged off debt. This type of debt includes but is not limited to Credit Card, Consumer Loans, Lines of Credit, and Retail Accounts. We also work on a contract basis with some of our clients. Whether we own the debt or if we are working the debt contractually we try to treat each account with special attention…”

    VRM purchases old, mostly worthless debts from such names as Unifund, inflates them, changing some dates of last activity and reports them to the credit bureaus as legitimate accounts.

    He is an ACA member, has a surety bond as required by Texas law, so anyone filing suit stands a good chance of collecting on successful claims.

    my father got a call friday for a woman, he is paying them $200 a month since the first contact. 2 months ago, this woman said that they could not continue with the payment agreement, he had to pay the balance in full. He is 78 yrs old, and retired, she told him, that he needs to get a job, or borrow from the family or get a loan to pay this debt off. She made him so upset his asthma started acting up. I am going after them, any suggestions where to start?
