    This number calls often. I found on another website that it's Financial Management Services. Is it them? Not sure why would they call me...

    Company name FMS.  They are 1st & 3rd party debt collectorS.  They are a legitimate company.  I unfortunately had a financial situation a couple years ago and worked out payment arrangements with them.  The person i've worked with has always been very pleasant.

    The regulations under which collection agencies are held accountable in the United States....
    At the federal level, agencies are largely governed by The Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. §§ 1692-1692p, a Federal Trade Commission (FTC) regulation.

    Collectors may not communicate with a consumer at any time or place which is unusual or known to be inconvenient to the consumer. In the absence of knowledge to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is between 8am and 9pm (Section 805 (a)(1)).

    If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt (Section 805 (c)).

    The term “consumer” includes the consumer’s spouse, parent (if the consumer is a minor), guardian, executor, or administrator (Section 805 (d)).

    The best way to stop calls from a legitimate collection company is to send a written demand that they cease communications.  The Fair Debt Collection Practices Act (FDCPA) requires that they honor written requests like this, and stop almost all communications.  If you send a letter like this, you should do so by certified mail, return receipt request, and keep a copy of the letter together with the return receipt.  I have posted sample letters on my web site's law library.  http://www.sue4abuse.com/library.html

    If they refuse to honor that request and there is a violation of the FDCPA you can get up to $1,000 in statutory damages.
