    Every consumer has a choice to use services to help them settle outside of court.  The company in question, Cain & Daniels only works for clients that admit the debt.  If you are in dispute, they will not take you as a client.  They do not do bill board or print advertising to keep costs low and therefor a client can only find out about the services by a case representative calling the business, which is only found on public record with a recent legal action related to a debt.  They do not accept any money unless they perform the service of a debt settlement.  There cannot be a scam if the client admits the debt and is not in dispute and the service is validated through an attorney prior to completing the service.  If someone (other than the intended) was called in error, as this can happen when a company does not have a clear number listed and an erroneous number is associated to that potential client in error, it is not malicious or to scam.  This happens in error and we all move on to the next task. www.cainanddaniels.com

    Caller asked who to speak with regarding a legal matter was told who then hung caller up. I called them back the number and Lisanne or Anne answered the phone. I told her it was rude they way she handle the end of the phone call. She then said 'okay because I'm about to do it again' click. Very unfortunate to handle a phone call in this manner.

    This call came into our Wisconsin office on Nov. 26th, 2014.  It was picked up by our voicemail system due to everyone being out for Thanksgiving.  Lady by the name of Ann Walker said we needed to call her ASAP for a legal matter, and left her number (813-658-3312).  No respectable business would be this vague.  Complete scam for sure.

    I would like to address the reason that Cain & Daniels is so vague.  We do not know who might be listening to a company voice mail.  We only divulge the full weight of the situation to the owner or the one who handles the legal matters, once we make contact with that specific individual.  Since these are matters of urgency, we do not want to leave too little of a message to where we do not get a call back but the fine line of not leaving too much is also an issue.  I apologize if this put you off to calling our company back to help settle an issue that might otherwise be causing you additional financial and legal hardship.  Feel free to contact Ann Walker back because all calls are made only to offer services to companies who need our help with a legal debt issue.  If you were called in complete error, I do apologize.  We have thousands of clients who have been helped by using our services, but we know how upsetting it can be if we call in error.

    Ummm..........I thought it was ILLEGAL to contact a potential debtor at their place of work, even if the "debtor" is the business itself?

    Well "Administrator", I'm going to now make a simple request. Post the legitimate address & legal name of your firm. Some of the finest researchers in the country will see to it that you're made legitimate. Or exposed as just another bunch of bottom-feeders who can't afford to buy good paper. It's up to you. Post some verifiable information or get your legal team ready to try to play in my league.
    I'm not known to condone a lot either. If you think you're up to pursuing a libel claim on me, bring it on. Far better than you have made the threat. Some have actually tried. In case you haven't noticed, here I am. If you really want to keep yourselves in a "non-hostile" environment, don't come back here & try to legitimize your gutter slush crew.

    One look at the BBB  on Cain & Danies complaints tells much of the story by consumers and by Cain & Daniels themselves.

    The complaints include multiple calls of trying to settle a lawsuit filed against someone when the one they are calling were unaware of any lawsuit. Another complaint details Cain & Daniels calling and claiming a lawsuit has been filed against a company by someone they have never heard of, which is answered with;

    "We obtain our clients by calling from public records provided by the courts. What is not provided on those public records are the businesses phone numbers. In some cases, we might match up a wrong number with a similarly named company."

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    It seems that an "Administrator" at this firm has taken it upon himself to register & down vote posts. That's never a sign of high intelligence. Legitimate firms don't appear on this site. Legal counsel precludes them from doing so. Innocence doesn't require defense on a site that deals with questionable entities.
    It all boils down to a few details. If a person is called from "Cain &....", they need to DEMAND a notice of validation by mail. NOT e-mail or fax. That demand isn't even really necessary. The "Administrator" here knows that his "firm" is required to make sure that a notice is received by you within 5 business days following initial contact. If a person receives anything by mail (Yeah right, like that will happen), that person will have 30 days in which to contest that claim. By mail. To the return address on their mailing. Registered mail. That demand will be followed by a yellow slip from the USPS that your piece of mail was "Undeliverable". Keep that return receipt.
    I can go on. We can get in to the legal recording of calls. We could discuss how easy it really is to find a fraudulent debt collecting den of thieves. I've been at this for a while. Scrubs aren't worth the time or effort. It's the hunt. Making them dive for cover & costing them more they make is far more satisfying. Fraud hunting is a hobby that's not for most. I can afford it. I have a special skill-set & I'm supported by people that will give their life just as quickly for me as I'll give mine for them.
    Most "collection clowns" are complete & total cowards. 300-lb. black women that "offer jobs". Over the hill "Inchlings" that ran in to a dead end. NY players that thought that running a shop 30 miles west of their new home would insulate them. Charlotte runners have discovered that running is all they're ever going to do. Greenville, Columbia. Jacksonvile. It's never the $1000 hits. It's what comes from people that don't owe & who relish being threatened. The food-chain is something you should pay attention to ""Administrator". I'm Gunnar.
