If they call you on your cell phone with a predictive dialer they owe you $500.00 end of discussion. That is a violation of the Telephone Consumers Protection Act. Make sure you document the day and time that they called you on your cellphone and wait for your bill. When you receive your cellphone bill fire off a letter telling them that you know that they broke the law with a redacted copy of your phone bill and wait for their attorney to call you. If done properly you can leverage this to get rid of a debt they are attempting to collect and maybe put some cash in your pocket. Just remember each time they call you it is worth $500 dollars if they do it with a predictive dialer to your cellphone.
From the Telephone Consumers Protection Act:
The use of autodialers, including predictive dialers, often results in abandoned calls – hang-ups or “dead air.” Except for emergency calls or calls made with the prior express consent of the person being called, autodialers and any artificial or prerecorded voice messages may not be used to contact numbers assigned to:
any emergency telephone line;the telephone line of any guest or patient room at a hospital, health care facility, home for the elderly, or similar establishment;a paging service, WIRELESS PHONE SERVICE(including both voice calls and text messages), or other commercial mobile radio service; or any other service for which the person being called would be charged for the call.
Calls using artificial or prerecorded voice messages – including those that do not use autodialers – may not be made to home phone numbers except for: emergency calls needed to ensure the consumer’s health and safety;
calls for which you have given prior express consent; non-commercial calls;
calls that don’t include or introduce any unsolicited advertisements or constitute telephone solicitations;calls by, or on behalf of, tax-exempt non-profit organizations; or calls from entities with which you have an Established Business Relationship.
