Trying to figure out who this is and where they are from. Got a random email from them and they won't give me any information but say I owe them money. I asked for documentation and asked him to read me my social and he went all around the question threatening me with saying if payment is not made the next day action will be taken. I asked for proof before I sent them any money but he stated that I needed to send money first and then he would send documents. Doesn't sound right to me because you would think they would send documentation.

No written, verifiable proof of debt/proof that your caller can legally collect said debt = they can go pound sand.  Per the FDCPA.  In fact, per the FDCPA, you should not pay any caller who refuses to mail - do not accept email or fax - proof of debt/proof they have the legal right to collect said debt.  Refusal to mail this documentation within five days of their first contact with you is another violation of federal law.  The burden of proof is on the debt collector to show that you owe this money to them, not the other way around.  You were wise to refuse to pay until you get documentation.  By the way, just because a caller has personal information about you, doesn't make them legitimate - it's very easy for people to get your address, work history, SSN nowadays.

Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
December 07, 2010  FBI National Press Office
    (202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

I received an email and call yesterday from a Mr Mark Johnson (state attorney office in Los Angeles Ca)  saying I have an arrest warrant in my name due to non payment of a pay day loan.  It actually had an arrest warrant attached to the email!! When you download it though it opens in Word an I am able to edit the document.  This would not be the case with an official notice.  I have never used the company, US Cash Advance.  He would not say he would mail me any proof, though I asked repeatedly for information to by mail not emailed. He said he could email it to me. He said I was to wire transfer by Thursday or I would be arrested and end up paying up to $3000 or more in court fees plus the cost to pay back the loan.  Today I received an email with a loan document attached. I looked up Mr Mark Johnson in LA and found the man by the picture attached to the email. He said it was not him (another dead give away was the English accent the real man had and the un-understandable accent the man on the phone had). I forward the real Mark Johnson the emails I received so he can take the steps needed. Kinda glad to know I'm not the only one who has gotten these emails and calls.  They had me so flustered on the phone that I was doubting myself!!

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

Thanks! I just finished reporting to quite a few people. Frankly "Mark Johnson" ticked me off once I was able to think clearly off the phone with him! I called LA and talked to the district attorney, called my bank, reported to the credit bureaus, called Kansas Attorney General, also spoke to the real Mr Johnson who is a lawyer and forwarded him the info they gave me, then reported to the FTC. Then I decided to let the "Mark Johnson" who emailed and called know that I won't be sending him anything ever and how easy it was to make a few phone calls and do a little web searching! :)
