- Reese| 6 repliesI am currently dealing with the same law firm. Rosen & Loeb contacted me at work several times despite me telling them that I could not have personal calls on my work no. I had to file papers with the courthouse to have any information on the account that they were collecting. I agreed to a stipulation payment arrangement in leiu of being sued. They took my case to court anyway and put a lien on my bank account. It took me two weeks to clear this up with my bank and have access to my paycheck.

- Stop it already!!!Most readers here are well versed in collection law and know what can and cannot be done. We've also seen dozens, maybe hundreds of these bad actors trying to frighten consumers. It doesn't work. In fact, it backfires because no reputable firm would need to try such a thing.

Stating that they had placed a judgment against me for an old charged off credit card. Woman stated their next steps would be to garnish wadges and lien bank accounts. She said that this judgment would be on my credit report forever. I received a case number from her and managed to locate the case documents, one of which is a summons stating that I was being sued dated one year and 3 months ago. The court documents also claim that I lived in a home I haven't lived in in almost six years.
I think I will be contacting a lawyer, considering I was never served papers in any court case, and was never able to appear on my behalf.- Caller: Rosen and Loeb Atterneys at law

- Knowitall2 replies to ashley| 8 repliesSimilar BS attempts from these guys. Remember, Unsecured loans/debt such as credit cards, etc, can not be taken out of your account with any judgment! Collection agencies can harass you all they want but they can not take money out of your bank account or garnish your wages or get court judgments against you for the debt.

I used to think that is true, but I have two judgments against me, mind you they are default judgments, but they are both for unsecured cc debt. One of them is in the process of garnishing my wages... If you are sure about what you are saying, please document, as I would love to the these judgments overturned.

From that site: "Many people get called at work by debt collectors threatening to tell their boss what a deadbeat they are, or threatening that if they don't pay in full now, the debt collection agency will garnish their wages (take the money right out of their paycheck). This is illegal, and a violation of Section 807 of the Federal Trade Commission (FTC) Fair Debt Collection Practices Act. Here's an excerpt that applies to them lying about your wages being garnished:
Section 807(4) prohibits falsely representing or implying to the consumer that nonpayment "will result in the arrest or imprisonment of any [53 Fed. Reg. 50106] person or the seizure, garnishment, attachment, or sale of any property or wages of any person . . ."
If debt collection agencies do call you at work, tell them to stop, your company does not approve. Whatever money they tell you that you owe, tell them to send you a written notice with all the terms and you'll pay by check.
Any legitimate collection agency will do this. Everything should be in writing. I had about 9 charged off credit cards. And I not only had my wages garnished, but also a lien on my bank account - twice. Mind you - the original amount I defaulted on was less than $5000. I guess it depends on whether a law firm or collection agency is handling the case.
- cjI was called by this firm and was spoken to by Yvette? Martinez. She said this was in reference to another person. I called her back and she could not find my records. She DID ask for my Social Security number to find those records. I declined to provide it. She said after putting me on a long hold, that she would have to call me back. I guess I'm fortunate that she has not returned my call as of yet. I don't owe anyone anything, but the person she called about (whose name she couldn't even pronounce) certainly could be in debt (always was). I am very leery. Yes, she was VERY rude, abrupt. MUST be a credit recovery. I told her I didn't want to hear from her company, to which she replied that it is a LAW FIRM. Oh, please.

I will continue to not answer the calls I guess.My credit is good, however i did have a charge off credit card in 2000. im not paying some sleezy collection company because if you make arrangements with them then they will update the account on your credit report and do so continousely making negaitve reports month after month. They cant sue me unless i am served and thats not going to happen I too like many people have friends who are attorneys so let them try anything!!!!!!!!!!

Loeb was in partnership in Northern CA and was able to lump 3 credit cards we had defaulted on due to medical reasons. They put a lien on our bank account and when the settlement for the 4 hip replacements came through, they whacked $14,000. right out of our bank account.
Now I'm on disability, and my husband lost his well paying job and is only making 1/3 of what he was in 2006. Now they want MORE than the original amount from HSBC card. Apparently, HSBC or any other credit card company can 'write off' the bad debt to the gov't and STILL sell the papers to any collection company.
Thanks to congress and the credit lobby, it's now almost impossible to file for bankruptcy if you're a senior citizen. - I am so right replies to CLL7070READ THIS CAREFULLY: No Creditor can put a lien on your bank account! You are either confused or they ripped you off and you don;t know it! Get a lawyer.
- new hireHeard a voicemail message today for the chap who previously had my job (he got laid off in 1st QTR 2009). I was going to return the call and see what I might do for the caller, assuming it was business relating to this company. Glad I've read these notes, as it seems the call was personal (and shouldn't come to an employer/office number anyway). I'll ignore it for now, but will protest to the caller (Dave Barr) should he ring this number again! Is anyone aware of the agency i can complain to if this firm continues to ring? Am I required to notify them that the person they'd called for is no longer employed here?
