- AlexI got a call today. Stating I got a loan from Bank of America. Past due from 2013. And that i now owe the over $2000 including legal fees.. Etc. I think its a scam ive never even delt with Bank of America. They were trying to get me to pay today.

- Dee replies to MATT| 1 replyI was told the exact same thing. I have never got a payday loan in my life. Supposedly it was for $400 and I owed $875 or they we're going to sue for $2,375. And the loan was through archway holding never heard of them.

Glad I checked this site. - BigA| 2 repliesThis is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place repeatedly in an attempt to shame you into paying. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I knew right away it was s scam so I blocked the number.

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

- JamesI got a phone call yesterday and these people now my info but I did not confirm any and they call my mothers house phone which I don't even know and left a message that they were looking for me but did not tell them anything thing that was going on and said I took a pay day loan for 400.00 and that I could clear it up for 700.00 and something but I had to pay today and then they told me I could set up payment plans or the were gonna go to court for like 2300.00 in all fees but I asked them to send me a copy of the debt validation form and then they said what is ur address and I told them it should be on file but I never confirmed anything and I have not received any phone calls or emails again since so we will see what happens...

- Roger replies to BigA| 1 replyThe most correct thing to do is to submit a tip online at fbi.gov or show up at your local fbi office and request to report a federal crime. The fbi investigates financial crimes and online fraud. Provide them with the phone number and or record the call and send them a copy. If anyone can get thier mailing address or how they attempt to take payments, it would make this a lot easier.
