! THERE IS AN ALERT ON ROTECH HOLDINGS LTD !
BBB has seen a major increase in collection agencies starting business in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with federal and state law, we have asked fo r specific information from all collection agencies located in our service area, including proof of licensing, bonding, and or registration required by NY state or other governments where the business is located, as well as proof of licensing required by any state in which the business operates. This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act. BBB advises consumers to become familiar with their rights under the Act, which can be found at ftc.gov. - Lorraine in Vegas| 2 repliesReceived a Call from 844-461-8712 on March 5th,2015. I do not accept calls on my cell phone unless they are listed in my contacts but the lady left me a voice message. Her name was Shelby Harris and she was looking for Amy C. She was calling about a formal complaint and summons that was faxed over to her office. She gave me the address of Amy C and told her she had one chance to contact the plaintiff to resolve this matter. She said" Amy C. , you have been officially notified". She gave me the case number. Now, MY voice mail states "Hi, This is LORRAINE, here comes the beep...". SO, I called the number Shelby left and I got a man who told me his company was called "RC" and that they were a litigation arbitration company. I told him that Amy C. has another address but I did not know it. I asked how he got MY phone number and he said "that's a good question!". He said he would try to find out. If they could not reach Amy C, then they resorted to calling a neighbor. Not sure if this is legal because I did not want to be bothered nor do I think I should be told about my neighbor's problems. Our mail carrier did inform me that someone else resides at Amy C's address now. Perhaps next time I will not call back.
- Caller: "RC"
- Slim replies to Lorraine in Vegas| 1 reply>> Perhaps next time I will not call back. <<
Excellent idea!
Although collectors can contact employers, relatives, friends and neighbors of a person who owes a debt, FDCPA law states that the collector cannot describe the debt to the called person.
In addition, a collector CANNOT issue a summons, and an email or FAX is NOT legally "official notification".
So, it appears you were called by a law breaking collector (see CWG40's posts). - Lorraine Y replies to SlimThanks for the info...
- whatsinaname| 1 replysimilar scenario....called saying that my mother was about to receive a "failure to appear in court." Gave me a reference number, asked them how they got my info, they said that my mother gave it to them. I told them to remove it, they said they couldn't do that. gave my mom the message. Mom said it had to be a scam. I called them back and ask who they were, and they said "We know who you are, Sally (sally wasn't the name they said, but they said my mother's name)." He proceeded to argue with me, telling me that when I could grow up they would talk to me, they told me that I was lying, and that they would not remove my information from their system. DO NOT ANSWER THIS CALL FROM THIS NUMBER!!! I had my lawyer friend call them and threaten them with a lawsuit. Sure enough, they stop calling. DO NOT LET THESE COMPANIES BULLY YOU!!!! I made the mistake of calling them back to figure things who they were. Learn from my mistake, dont fall for their games!!!!!

- Wondering Again| 2 repliesGot a call on cell phone from unidentified number with message for someone named Robert Pennington ? or Cunningham ? Jr. The message giver said his name was "David Hill. He left this number 844-461-8712 to call regarding case No 266-063-****. Message also said "you have been officially notified" and also something about a warrant. Too bad there is no one to stop this. I did not return the call. Hope this helps someone.

- Alfalfa replies to Wondering AgainHow can I verify whether or not a debt collector is legitimate?
Here are a few warning signs that could signal a debt collection scam:
The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.
The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.
The debt collector refuses to give you a mailing address or phone number.
The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:
Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.
Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.
Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
Charging your existing credit cards
Opening new credit card or checking accounts
Writing fraudulent checks
Taking out loans in your name
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.
Stop speaking with the caller. If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.
Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.
Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).
http://www.consumerfinance.gov/ - Pissed off MotherReceived a Call from 844-461-8712 on March 13th,2015 @9:40 AM. I did not accept this call on my cell as it was an unknown caller but a lady left me a voice message. Her name was Tracy Domm and she was looking for my daughter. She was calling about a formal complaint and summons that was faxed over to her office. She needed me to tell my daughter she had one chance to contact the plaintiff to resolve this matter. She said my daughter has been "officially notified". She gave me the case number. So, I called the number Tracy left and I got a man who told me that his name was James. I asked for the name of his company I was calling. He would not tell me the name of his company, as he said "the message stated where you were calling when I called in the two time before". I did call two time before and know one answered the phone. I told him that my daughter was not at this number or address. He told me to be a better mother and get her the message ! I asked him again, whom he worked for and asked him to stop calling me and serval different family members. He stated he did not call, they are only aloud inbound calls. I gave him the name of the person that called me and he proceeded to cut me off again and told me again to do my job as a mother ! I then asked how he got my phone number and he said "that's damm good question!". He then said you are not my problem. I replied with you made it my problem when Tracy Domm left me your number to call back to. Along with my mother, brother, uncle and 84 year old grandmother ! He proceeded to call me a f---ing lier and hung up the phone. This is one debt collector that should be put our of business ! I can't not believe people chose to work for a company like this, let alone sleep at night !
This can not be legal ! - Pissed PersonThis number called me looking for someone with the same last name. Like many of you I told them that they have the wrong number and to remove me. They were looking for a man and I am clearly a woman. This female began telling me that I know this person and to send him the message blah blah blah. When I asked how she got this number she said that he put me down as a point of contact. I told the lady I have no idea why my number was put down and that I need to be removed. She ultimately called me a liar and hung up on me. Well I am an [***]. SO I called back and left a message letting them know if they don't remove my number or if they ever call me again that we were going to have some problems and I stand by that. They better not try me.
- Lisa| 1 replyTed Shore states there is a judgement against me. I have no credit..
- Lisa replies to Wondering AgainI received for the second time the same message only its Tad Short.. stating they gave me my one chance and now they will serve me at my home or job. Good luck with that. I dont have any debt but someone did steal my info last year as well as a hospital and several stores who have breached my privacy. So at this point it could be anyone. and yes they have contacted both my kids. It goes direct to Voicemail for them shows no call my phone always shows restricted.. So yep they can kiss my ass.......
- Lisa replies to whatsinanameMaybe your lawyer friend could do the same for me..
- J.H.| 1 replyI received a call from an unknown caller on Mar. 18th on both my cell and work number. A voice mail was left by a lady named Diane Moore regarding a formal complaint & summons against me were faxed over to her office. According to the v/m, I have one opportunity to contact the plaintiff to resolve this matter personally and was given a phone number of 844-461-8712 to call back. They gave me a case number and said I had officially been notified. Shortly after that, my sister, who had been at my house, called me and said that one of my "neighbors" came by with a message for me and handed her a piece of notebook paper with that same phone number and case number on it. I am a little freaked out to say the least!!! I ran my credit on creditkarma.com just to make sure nothing strange was going on and there was nothing on my report to indicate that any debt collector should be looking for me. I am not sure what to do....call a lawyer? The police?

- AW| 1 replyThis morning they called my ex husband, my oldest daughter & my neighbor stating they are going to summons me. Freaked me out so I called them back. They said I am writing fraudulent checks & gave me the bank name. Said if I send them $1705.00 today then I won't be summoned to court, which will cost me 3 times the amount. I had closed that bank account years ago. So I talked to the bank to verify I hadn't done something wrong. They said I never even had checks with them, only a debit card & when I closed my account I had a zero balance, left in good standing & if I wanted to start an account back up with them, they would gladly take me. My mistake was calling this number back. Now they have my phone number. They keep calling me from an unknown number. I answered the 1st time the unknown number came up. It was these people, I informed them to never call me, my kids, my ex or my neighbors again. She said they will keep calling me until I called back. And so far they have called six times, which I don't answer. I figure if they already know my address (they gave my neighbor my address & asked my neighbor if they lived by me) then someone would of come to my door with a summons.
- Melissa Holmberg| 1 replyThis number keeps calling and threatening me with being summons by the state of IL.
- Caller: State of Illinois
- RDP| 1 replyI received an "UNKNOWN" phone call yesterday in regards to my mother stating that she had been notified about a summons against her. She is bedridden and on Hospice with Stage 4 cancer all though-out her body. My sister who lives with our mom called me to see if I knew anything about this and I told her that I had received the same call. Today my daughter comes by and we are talking and she tells me about receiving a phone call by her grandmother is going to miss her court date and they are going to come arrest her. No one ever called my moms phone, but called 3 different family members who all have different last names and harassed all of us. It is bad enough that we are trying to take care of our mother who is dying and then to have this phone calls....This is illegal and should be STOPPED!
