The caller asked for me by name.  When I confirmed that I was who he had asked for, he identified himself as an investigator with the IRS legal department.  I then asked him to provide his name and he told me it was Jack Davis.  When I asked for his telephone number, he said that it was the number he was calling from and then asked why I wanted it.  When I told him that I wanted to verify that this call was legitimate, he immediately became very hostile and threatening.  He asked if I had an attorney and I gave that information to him.  He told me that I had been audited and found guilty of tax fraud.  He said that it had occurred between 2009 and 2014.  He indicated that the amount of miscalculation was $2,486.23.  He mentioned the word “affidavit” a couple of times.  When I asked if I could get this information in writing, he asked if I lived at [my address].  I told him that I did.  I can’t be sure because it was hard to understand him, but I believe he then said that they had tried to serve me there but found nobody at home.  He told me that this phone call was the only contact that the IRS would make with me and I must decide how to proceed right now.  He said that they had proof that I had willfully deceived the IRS, using terms like “under-reported, willfully defrauded, violation of four IRS codes (then only gave me a couple that didn’t sound official), theft, willful misrepresentation”.  He said that I, alone, would answer for the charges and that nobody could save me, not even a lawyer.  He said that if I went to court, I would lose and would probably be sentenced to 3 years and 22 days in prison.  He told me that a lien would be issued against all of my property – house, car, & wages – and that it would all be seized.  He said that it would be reported to the credit bureaus and that my credit score would drop by 100-150 points.  He threatened that upon hanging up, the IRS would file a lawsuit and contact the authorities.  He said that the local sheriff would be coming to arrest me.  At one point, he said that 911 would be calling me back (which should have been a no-brainer tip off, but I was too upset to fully comprehend it).  When I said that I thought that I should be able to defend myself in a court of law, he continued to reiterate that I would lose – that they had proof that my action was willful – and that this was my last chance to make it right.  He said the judge would ask for $20,000 dollars and if I didn’t pay, I would surely go to prison.  When he asked if I could pay that amount, I hesitated, but then told him that I thought I could.  He never asked for any personal information that I can recall.  He talked fast and kept me under pressure during the entire call.  During the call, which was made to my cell phone, I decided to call my attorney from my work phone.  While I kept "Mr. Davis" on the phone in one ear, I briefly explained the situation to my attorney in the other ear and asked him to advise me on how to proceed.  He told me to get the caller’s name and phone number and tell him that my lawyer would be contacting him.  My attorney told me that the IRS would not be handling the situation like this and informed me that he thought it was a scam.  I followed his advice and ended the conversation with "Mr. Davis".  I have heard nothing further.
