    I don't  owe any debts, but I continue to get calls from 855-234-1304

    going on. I believe our personal information been compromise.

    I got a phone call from 855-234-1304. The guy recited my social security number and threaten me about a supposed debt loan I took out online 7 years ago. How did he get my s.s. number? He's threatening me about a loan I never took out? I don't want my personal information compromised. So, I'm hanging up and asking the police about how to get to stop calling and how they acquired my s.s. number.

    First time getting a call from who ever these ppl... VM was just some lady sounded like automated system saying the same number that called me.. don't know who they are or for what reason they are Calley just very irritating calling while I'm at work

    I get a call from this so called collections agency claiming there had been a complaint filed against my telephone and Social Security Number. I asked ok who's the creditor? The person I was speaking to told me who it was and I told him to send me proof of the debt that was allegedly taken out in 2008 he said he would do just that ok so I checked every ten or twenty minutes and to no avail nothing had come in. Now when a call comes in with this number on the caller ID I ignore it. I even tried to file a complaint with the Federal Trade Commission only to find out that the FTC is on shut down no thanks to Obozo.

    They left a message about serving me some papers and to call back this number. I have no clue who they are needing to speak to or who they are. I live in a state where it is a consumer friendly state. I left a message stating ro remove me from their list and I know they are a scam and when the government reopens I will report them to the FCC.

    This number called to threatened me about a pay day yes loan service. According to them I apparently took out a loan with them like years ago and said they would come after me, the message said it was Howard Gates? but when I called to ask  for him he does not work there. I spoke to James Stone who sounded just like the guy who  left the message. He said he would send me an email  regarding the account. I did not receive anything when I called the second time the answering service said it was PMG. I decided to go to the Pay day yes online website to research and left a message with them to clarify but I have not gotten a response from neither. So I called the bank to cover my account.

    Neither phone, email or fax is legal proof of any debt owed, it must be sent in writing via US mail!

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
    (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employer

    guy named Howard left msg that says my number is attached to a debt and they will either be at my place of residence or my employer within 48 hours to sign something... and I need my supervisor as a witness? when I called number back I told them the debt they were referring to was in a bankruptcy over 3 years ago. he told me this is a criminal proceeding????? and he said I did not file bankruptcy and will see me in court???? wth?

    I just received a call from the same man, I called him back apparently this debt was acquired about 8 years ago when my last name wasn't Cates, I told him that he said I still owe the debt and that he was coming to my place of residency and or my place of employment within 24 hours,,, I asked him was this a threat he said take it as I want but it is a serious matter, so after he said that, I gave him a bit of some serious information which was I just retained an attorney and had file chapter 7 bankruptcy I proceeded to give my attorny's name and the man hung up, I called him back and he said lady you just told me you filed bankruptcy I said yes and I'm attempting to give you the file case number and the phone number and he said he didn't need it I told him not to bother me any more or I will have my attorney sue him personally and the company that he works for and his client and he hung up, I have it all logged on my cell phone the time I called the first time and the second time for proof just in case he calls back I can sue them.

    Some dude called to tell me he would see me at my work to served me with papers with in 48 hours said have Id ready or my supervisor to verify who I was.. however he couldn't tell me where I worked or even what town I was in... so I told him I'll see him when he shows up..its been a week now and still no show...just a scam artist trying to scare ppl out of their hard earned money cause they are too lazy to get a real job

    I had the same message left on my answer machine yesterday from a Howard gates, telling me he would be coming WITH 48 hrs to serve papers and to have ID's or supervisor to verify. I dont understand how they can get away with this.

    They're scammers.  They won't send documentation proving you owe a debt and that debt is owed to them - because they have no proof.  Refusal to mail proof of debt/ownership of debt is a violation of the FDCPA, which means you owe them NOTHING.  

    Plus, no one gets a heads up they'll be served - the court process server just shows up.  You don't need ID to get a court summons.  Report the calls to the FTC, FBI, Dept of Justice and your state's Attorney General.  Advise the caller that you've reported them and that you're recording all calls they make to you on the advice of your attorney (whether you have one or not).

    I got a call from 855-234-1304, GREGG ANDERSON FROM PMG ASSOCIATES CALLED AND SAID TO CALL HIM BACK BECAUSE HE HAS A LEGAL DOCUMENT READY TO GO TO COURT AND THIS IS THE LAST TIME FOR US TO APPEAL. PEOPLE OF THE STATE VS ME. WTF! I CALLED 855-234-1304, THEY SAID NO GREGG ANDERSON THERE. SCAMMERS! NEXT THING I KNOW THEY CALLED MY BROTHER IN LAW'S HOUSE & SISTER-IN-LAW'S  SAYING THAT I NEED TO COMPLY ASAP!!! CALLED THEM AND SAID WE OWE MORE THAN $1,000. ASKED WHAT DOES PMG ASSOCIATES STANDS FOR, GUY CAN'T EVEN ANSWER ME. TOLD THEM I NEED THE INFO IN BLACK AND WHITE AND GUY WAS ASKING FOR MY ADDRESS AND THEY SAID THEY CAN FAX ME THE LEGAL DOCUMENT.     This is the exact same thing that happened to me yesterday. When I questioned him about the debt and stated to him I needed proof, he proceeded to get nasty and defensive. I still have not received the email I asked for. Same VM and same person once I got on the phone. Th call ended with him hanging up on me.
