Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site:  http://www.consumerfinance.gov/

    Deputy Call
I just received a call from a Deputy Christopher Jones calling with the Franklin County processor and says that the he has been instructed by the DA's office to contact me. I've been getting calls from a Bronstein-Weiss - Arbitration and not returned their calls. This has got to be fake. Has any one else heard of this??? I'm tempted to call the police. I know there's no such thing as criminal charges for having some debt but how far will they go??

    1. It is illegal to claim to be the  district attorney's office.
    2. REAL process servers do NOT call before arriving.
Do not waste your time with this caller.  You can NOT be arrested even if you do owe money.  It is also illegal to make threats like that.

Contact your state attorney general AND the Franklin County DA's office.

Thanks for the information. It's scary when they call and say all this stuff. I googled a lot of what he was saying and nothing came up including his name. It's kind of sad that you know they're getting money from someone with they're threats. I'm so tempted to call them back to let them know that the state attorney general has been contacted and so has the Franklin County DA's office. ugh.

Report it to your local DA.   Tell them what you've written here.  See BigA's notes!

    Report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection  (Threatening criminal prosecution to collect a civil debt is a clear violation of the Federal Fair Debt Collection Act)

Also contact your local attorney general

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  You might have to yell at the scammer and talk over him or her.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them .

Scam.  No legitimate process server calls you up and tells you he or she is coming by.  This is just a scam call to try to scare some money out of you.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  DIME  until the debt is validated.

Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.

    If they are bothering you,

    Report them:

Also contact your local attorney general

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  You might have to yell at the scammer and talk over him or her.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them . They are a registered NY corporation.

CAUTION: I am not entirely sure if this is a scam as they have yet to send documentation but it definitely doesn't sound legit.
The original caller ext. 418 Ultra Brown originally claimed she was returning my call then confirmed my name and last 4 so I went along with it. She told me I had 72 hrs before litigation so I repeated what she said, then she denied ever saying it. I requested the business information and she gave me their address of 3380 Sheraton Dr Suite 340 Amherst, NY 14226. I told her my attorney requested validation of debt and she said she would forward to my email which I then request USPS mail which she said was fine. I asked again what the 72 hr time-frame was and she said it was a request for a statement then they would be filing paperwork. I asked what exactly they were filing and where to and she just said "filing out of the office" I asked where and what does that mean and she explained all they do it get a statement and send it back to the debtor. I asked her where the whole litigation came into play as she mentioned before then she read some script that didn't have that phrase in it. She then continued to ask for money saying I needed to pay the restitution and I could take care of that now. I said I wouldn't pay anything until my attorney looked at it since the debtor didn't sound familiar and she got upset and yelling at me that I was "defaulting" and "being uncooperative" and would make note.

I guess we'll see what happens next

Called my business, said name was Peter Williams with "Middle Tennessee from Murfreesboro" and told my employee that our utility bill was 2 months overdue. (it is current) and that power would be disconnected. Said person responsible for bill needed to call 1-855-260-3607 ext 1518. Definitely a scam, our account is current and the name of the utility company was wrong.
