The lady is rude and they said they would serve a subpoena. What freaks me out is this debt is 13 years old and isn't on my history anymore and they have alot of my personal information.

- Nicole replies to ajaI got a call from them yesterday. its very sketchy. They told me their company name was McBryd and Associates Law Firm, based in LA. When i asked for address or for more information on my acct. she declined, when i call back they say Corporate Services. If you begin to ask too many questions they hang up on you. I believe its a SCAM! Report it to the BBB or the Federal Trade Commission office!

Also, here are the instructions for a 1099-c from the IRS which lists who can file the form and for what type of debt. I am certainly no tax attorney or account but in my opinion I don't think that they can file after 13 years. Furthermore, if you read the instructions the original creditor has to put a valid phone number where they can be reached on there. This would leave a paper trail and if it was proven that they falsely filed this form they would be in a lot of trouble with the one organization in the whole world you don't want to be in trouble with.
Also, please read slims post above about your rights when dealing with a debt collector, and since they talked to you they are required by law to send you a letter with their name, address, amount of debt, creditors name, and your right to dispute the debt. This letter must be mailed within 5 days of talking to you.
My guess is you will not get the letter, nor the 1099-c. - Nicole replies to BigA| 1 replyThe spelling the man gave me of the company was McByrd and Associates. Its the same man and woman who answer. Also, I googled the company and the number and nothing exists in LA only a realtor company not a debt collection agency or law firm.
- Veronica| 2 repliesI was called today as well stating that I am going to be served with a subpoena but as soon as I asked for the date & court of it he stated he had to go. I called back & a very rude woman answered & started yelling at me when I was simply asking for account details. Seems fishy but I am still worried. This is over a car loan from 2003. She said I made a pymnt in 2013 which is simply not true.

- MJG replies to VeronicaIF you were really getting a summons, the server would show up UNANNOUNCED! They do NOT call first. If in doubt, contact your local courthouse- civil division. They can explain in more detail.
- BigA replies to NicoleI found some lawyers that specialize in bankruptcy cases, but they are not in LA, if I remember right they were in Oklahoma. This wouldn't be the first time these people have used the name of a real law firm to confuse their victims. I would not engage them again on the phone, but if you end up doing that just simply tell them that Federal law states they must give you all the information in writing and sent by US Mail. They should have the proper address, if they ask you for your address, simply tell them that they should tell you what it is and you will verify it. If they give you a wrong address then they are simply fishing for victims too scared because they do not know their rights under the law that will pay them.
This is a very common occurrence these days and these criminals try to get as much out of their victims as they can. Also again, do as i said and check out Slim's links to Federal Law and learn your rights. You can also check your State Attorney General's website for information as all of them have something on there. - BigA replies to VeronicaYes please read Slim's post and go to those links and read my answers to Nicole as well. Educate yourself and choose NOT to be a victim of these people.

They said they would hate to disrupt me and embarrass me at my place of work. They said that they are scheduled to serve me "papers" tomorrow morning. I don't even know what it's in regards too. Seems very fishy!!

- KiloZI recently got several blocked calls on rapid succession over a two day period and then got a message. It informed me that I was going to be served the next day and that if I had any questions to call the number reported on this page. I was given no ref number or company name. When I called they they pulled my name up from my phone number. "Corporate Services" then transferred me to "the legal dept." A man, who only identified himself as a lawyer with Byrd and associates, told me I was being served the next day for a 35k debt from 2000. Before I could say anything he informed me that in WI judgements stay active for 20 yrs. He said I could pay or go to court. Without skipping a beat I said GO TO COURT. He then confirmed my address and hung up. Two things.. 1) what list are these people looking at and how did they get it? I do have a auto loan deficiency from around then,but the principal was only 3-4k. And I never got a bill from the original lender. 2) Why go for such a high amount? Honestly, if it were In the 1500-3000 range I might have actually listened to an offer. Although, I am almost positive the statute of limitations ran out long ago. These Guys got to get a better angle. When a person hears that high of an amount most will risk it in court. It's not like a lot of people with auto loan deficiencies will have 35k on hand to pay an old debt?

- debbieI just received a call from an unknown caller, which I never answer. After they called a second time they left a message for my brother in law. They said it was an urgent message they needed relayed to him about delivering documents for him to sign the following day and it was a civil matter. They left the name and number, as well as a reference number. Apparently they had also called my brother in laws home phone and left the same message. Scammers! I won't call or give any info to anyone I don't know.

- LinNE replies to ajaReceived a similar call today with claim of a civil suit for a debt written off more than 10 years ago. They answered the phone, "Corporate Office", said they are a law firm and got rude when I asked how a "Law Firm" in another state could sue me. Do not speak with these people.
